SELECTMENtS MEETING
DECEMBER 140 1937
'
A regular meeting of the Board of Selectmen was held
in the Selectmen's Room, Town Office Building, at 7:30
P.M. Chairman Ferguson'and Messrs. Ross, Clark and Giroux
were present. The Clerk was also present.
The Town Clerk appeared before the Board for the
drawing of two jurors. Mr: Peter Robertson, retired, of
Jurors.
39 Somerset Road was drawn to serve on civil business at
Cambridge, January 3, 1938; and Mr. Frederick S. Ormond,
Nursery business, of 104 Bedfcr d Street was drawn to serve
on the Grand Jury at Cambridge January 3, 1938.
The Welfare Agent and George V. Morse appeared be-
fore the Board to discuss welfare matters.
At 7:30 P. M. hearing was declared open upon the

application of Joseph M. Gaffey for permission to maintain
garage
a two car garage at 12 Maple Street, Lexington. Mr.
hearing.
Gaffey appeared and presented plans of the proposed
garage. Mr. Ross moved that the application be approved.
Mr. Clark seconded the motion, and it was so voted.
At 8:00 P. M. hearing was declared open upon the petition

of the Boston Edison Company for permission to place
underground its wires used for the transmission of elec-

tricity, in Nass. Avenue, from Elm Avenue to a point
hearing,
approximately 115 feet west of Forest Street. Mr, Ralph
Mass. Ave.
Young, representing the Boston Edison Company, appeared
in favor of the granting of the petition and presented
a tentative plan. No persons appeared in opposition.
Mr. Ferguson asked when they planned to start work,,.and
Mr. Young said that he doubted if they would start until
next spring.
No other persons desiring to be hear4 the hearing
was declared closed.
Mr. Giroux moved that the petition be granted, and
that an agreement signed by the Boston Edison Co. to the
effect that that company would do the work in 1937 or
19380 be signed by the Selectmen. Mr. Clark seconded the
motion, and it was so voted.
Mr. Raymond appearedbefore the Board. He said that
last week the Board instructed him to write a letter to
Curbing, Mr. Leroy Brown of Harrington Road advising him that a
Harrington curbing project for that street would be submitted in the
Road. 1938 budget. He thought he should be given an opportunity
to work out his curbing program for 1938 before stating ,
that, as he thought that there were other places that
needed it more than this street. Mr. Giroux moved that
' the Chairman inform Mr. Brown that his request would be
considered with the other 1938 projects. Mr. floss
seconded the motion, and it was so voted.
Mr. Raymond said that John Sullivan of 7 Highland
Avenue owed a bill of about $80.00 for a sewer connection.
Mr. Ross communicated with the Town Counsel on the matter,
and Mr. Wrightington found that a mortgage had been
placed on the property, but that this oustanding bill had
not been noted at that time. Mr. Wrightington thought
that the only thing to do would be to bring suit. Mr.
Giroux moved that the matter be referred to the Town
Counsel for action. Mr. Clark seconded the motion, and
it was so voted.

Mr. Raymond reported that the Water Department was
out of hydrants, and he recommended that the purchase of
three 6 inch hydrants be approved at an expenditure of
about $290.00. Mr. Ross moved that the purchase of the
hydrants be approved and charged to the Water Stock
account. Mr. Clark seconded the motion, and `it was so
voted.
Mr. Raymond read a letter from W. C. Paxton, Jr.
recommending that a new 10" Baker snow plow be purchased
from the Dyar Sales & Machinery Co. for $350.00. He
said that they had an old plow on which the company
would give them an allowance of $100.00, making the net
cost $250.00. Mr. Ross moved that the purchase of this
10" plow be approved, the expenditure to be charged to
the Snow Removal appropriation. Mr. Clark seconded the
motion, and it was so voted.

Mr. Raymond said that the Hibbert Street water main
was something that the Town did not want, in his opinion.
When the Highway Department excavated there, they found
that the water main was down only about two feet below
the surface. Mr. Raymond talked with Mr. Geary of the
Arlington Water Department and told him that the Board
would approve taking over the main if Arlington would pay
for the 16" tapping sleeve and gate. Geary was to take Hibbert St,
the matter up with the Board of Public Works at the next water main
meeting, but as only one member appeared at that meeting,
no action was taken. Mr. Raymond talked with him again
yesterday, and told him that he would not recommend that
the Town of Lexington take over the main unless Arlington
lowered it. Mr. Geary informed him today that Arlington
would not lower the main or pay for the tapping sleeve and
gate. Lexington is not supplying any houses from this
main, but Arlington is supplying water to one house in
Lexington. Mr. Ross asked what Lexington would do assuming
that Arlington refused to supply that house in Lexington.
He asked Mr. Raymond if he would rip up the new street
and put in a new main. The Chairman said that the owner

would have to make his own arrangements. Mr. Raymond said '
that he did not see any good reason for taking over the
main. Mr. Ross felt that Lexington would be open to a
law suit if nothing was done. The Chairman suggested
that Mr. Raymond discuss the matter with the Town Counsel,
and the matter was left that way.
Mr. Raymond said that he had received a letter from
Weston J. Willard Hayden stating that if he had to wait until
Street. 1939 before Weston Street was rebuilt, that would be
satisfactory to him if it was the best that could be done.
The Chairman read a letter from Mr. Raymond giving
Cataldo the result of his investigation into the claim of C.
claim Cataldo for damages to his property on account of flood-
ing. Mr. Giroux moved that the whole matter be referred
to the Town Counsel. Mr. Clark seconded the motion, and
it was so voted.

Mr Ferguson left the meeting at 9:00 P.M., and Mr.
Giroux acted as Chairman.

Mr. Clark moved that the bid be awarded to Fleming &
Son, they being the low bidder. Mr. Ross seconded the
motion and it was so voted.
Letter was.received from Fletcher W. Taft, represent-
ing the Board of Trade, requesting that the Board of '

Selectmen publicly endorse the coupon gift campaign that

that organization is sponsoring, and that the Selectmen
campaign.
attend the Community Christmas Party to be held in Cary
Hall on December 28th. Mr. Clark moved that the
Selectmen endorse the campaign and that.the invitation
be accepted. Mr. Ross seconded the motion, and it was
so voted.
Letter was received from the Cemetery Commissioners

Letter was received from the Commissioner of Civil Harvey's
Service advising that the reinstatement of Henry H. Harvey reinstate -

. Letter was received from the Commissioner of Civil Eligible
Service advising that the.eligible list had been estab- list,police

Letter was received from Elmer A. Lord & Co. ad-
vising that compenation insurance in the Employer's Compensatia:
Liability Assurance Corporation expired on January lst. insurance
Mr. Clark moved that the policy be renewed through the
same office. Mr. Ross seconded the motion, and it was
so voted.
The Special report of the Department of -Public Report re
Health Relative to Means and Methods of Remedying the Hardy
P61lution of Hardy Pond in the City of Waltham, made Pond.
under the provisions of Chapter 28 of the Resolves of
1937 was received.
Letter was received from P. J. Neary requesting that Street
the.street sign at.the corner of Baker and Bennett Avenue sign -
be replaced. The Clerk reported that the sign had been Bennett Ave
removed to be painted.
Invitation was received from the Mass. State Guard
Veterans to attend the installation of officers on Dee- Invitation

invitation with thanks.

from Reserve advising that they had approved the transfer of $750.00

Applications for licenses to sell all alcoholic '
Liquor beverages were received from Max Berman of 12 Mass. Avenue
Licenses. and John J. Rudd of 1845-1849 Mass, Avenue. Mr. Ross
moved that Mr. Rudd's license be renewed. Mr. Clark
seconded the motion and it was so voted. It was decided
to hold the Berman application over for one Week.
Letter was received from Frank L. Cheney notifying
Cheney the Board that his`;wife slipped on the ice on Charles
claim. Street on Thursday. December 9th at 10:45 A.M., and broke
her arm. He said that he was claiming damages from the
Town. Mr. Ross moved that the matter be turned over to
the Town Counsel, Mr. Clark seconded the motion, and it
was so voted.
Mr. Giroux asked if many men had been put back on
W.P.A. in Lexington, in view of the increase in the quota
W.P.A. in Massachusetts. Mr. Raymond said that very few men had
been put back. Mr. Raymond was requested to act as the
Selectmen's Agent and to go into Boston in the morning to
see if something could be done to increase Lexington's
quota. Mr. Raymond agreed to go in town In the morning.
The meeting adjourned at 9:25 P. M.
