July .10 meeting, as amended, to be attached to Minutes of f” July "24 meeting t, . ` hg August Meeting Schedule changed to Au 1/4 F g gust 14th and 21st Revisions of the Hatch Act Copies of two new bills giving increased powers to conservation commissions were hand-delivered to the Commission by Rep Lincoln Cole PUBLIC HEARING REGARDING NOTICE OF INTENT OF CAPE AND ISLANDS FINANCIAL CORP TO ALTER CERTAIN INLAND WETLANDS LOCATED ON IDYLWILE FARMS AT MARRETT ROAD AND MIDDLE STREET, LEXINGTON The hearing was opened at 8 30 p m by the Chairman of the Con- servation Commission, Dr Howard M. Kassler, who read the duly advertised, posted, and written notifications of this hearing, held in accordance with the provisions of G L C. 131, Sec 40 (Hatch Act) as amended under Chapter 1020, Acts of 1971 Present at the hearing were the following members of the Con- servation Commission Angela E Frick, Gary Larson, Wendy S Pease and David G Williams,and the following Associate Members of the Commission Manfred P Friedman and Laura F Nichols Representing the Applicant were Attorneys Warren G Miller and C.E, McDermott, of 15 Court Square, Boston, and Engineer Erich Nitzsche, of Robert Anderson, Inc , North Reading The Follow- ing Town officials were present Dr Charles E. Ellicott, of the Board of Health, and Robert C Heustis, Director of Public Health, Others present included Frank Sandy and Joan Crothers representing the Citizens for Lexington Conservation, Steve Politi of the Lexington Minute-Man, Nicholas J Sirianis, of 536 Marrett Road (new readent) , Janet Kassler and Ford Frick Messrs Miller and Nitzsche, speaking on behalf of the Applicant, said that the Idylwilde Farm subdivision plan had been approved by the Planning Board, with the proviso that lots Nos 19, 20 , 22 and 23 not be built upon until a permit has been obtained from the Department of Natural Resources under the Hatch Act Subdivision plan calls for deeding to the Town of Lot 21 (deed already held in escrow by Town Counsel) through which a ditch would be dug to collect and carry water to the culvert under AUG 151972 Conserdat oa Cptnmas`` ,,a .�� M,inutes 7/24/72 Page 2 �n "-�y r Marrett Road Developers- 'have acquired lot 12 for-sewer ,and l', �r additional drainage -access to Marrett Road They at.so stated , that they Would seed all moved earth "within ascertain length of time" and that all slopes more than 1' in 3' grade would be rip-rapped (including part of the end of the pavement of the cul-de,-sac) Q, Would a guard rail be provided at the end of the cul-de-sac? A Plans call for only a curb at this time. Q. Would the high knoll in Lot 21 prevent water from draining? le110 534* u�( A The ditch will take care of all water The developers also stated that they would fill to the full depth of each of the lots to be filled, and that filling would be 4 to 6 feet. The ditch in lot 21 would be 6 feet wide with banks at 1 to 1 slope and (with difficulty in some areas) 1 foot deep Lowest floor level in the proposed development would be at 245-foot elevation. Filling would not be done until building on the lots is ready to commence. Actual time would be flexible The developer said that at the Planning Board hearing the Engin- eering Department indicated that work to improve drainage on the other side of Marrett Road would be done this year In answer to questions, the Cape and Islands representatives said that material excavated from the ditch would be removed so as not to interfere with drainage, that all elevations would be made from field survey using the bench mark on Middle Street as reference; that the presently stockpiled topsoil all lies upon lots 10 an1ll on Marrett Road, not owned by this developer, and that the "stop order" issued by DNR recently was merely "a form" The hearing was adjourned at 9 05 p m Discussion by Commission at conclusion of hearing brought out the following points (of fact Or agreement) Water table now stands at a fairly high level of 241 feet. Water level is now at the top of the 18-inch pipe under Marrett Road. The Town should repair drainage on the other side of Marrett Road satisfactorily before any Idylwilde Farm alterations can begin Developer should apply erosion control to any grade more than 5 to 1 slope within a week of earth-moving Communications were received and read from the Board of Health and Planning Board and awaited from the Engineering Department A letter will be drafted fo r approval at the Commission' s July 31 meeting, reporting results of hearing to the DNR Cons' . vation Commission umanutes 7/24/72 Page 3 Hall-Meek Plans , approved by the Hills , given to Engineering Department for final work.-up (AEF) Patricia Terrace Problem Solution being worked out with owner fi. and Engineering Department (HMK) ' Fores-try. Intern, Mr Williams reported on his contact with ,Mr Bond at U' Mass , Amherst It was recommended that this offer of help in land management be held for future use, and that r Bond keep 'the Commission informed of developments Great Meadows The joint Lexington-Arlington Great Meadow Committee is preparing a statement for the Boards of Select- men fi of both towns that the Great Meadow should be left in its natural state Through newspaper articles it was learned that one member of the joint committee, who also represents the golf course interests, has proposed an article calling for feasibility study of a golf course to be brought ,up at a special town meeting in Artlington this fall A joint meet- ing of the Boards of Selectmen of the two towns is anticipated (AEF) Executive Session was declared at 10 02 p m The meeting ad- journed at 10 37 p m , until Monday, July 31, at 7 45 p m Respectfully submitted, e,, 2D�, Mrs Erna S Greene Secretary to the Commission
