SEPT. 162 1937.
A special meeting of the Board of Selectmen was held
in the Selectmen's Room, Town Office Building, at 1:30 P.M.
t Chairman Ferguson and Messrs. Ross and Giroux were present.
The Clerk was also present.
The Clerk reported that the Commissioner of Civil
Service had informed her that the matter of Officer
Harvey's suspension from the Police Department was purely
a local problem. The Town Counsel had advised that General
Laws, Chapter 31, Section 42A contained the requirements
for procedure in removing or suspending a policeman and re-
lating to notice and hearing. Mr. Wrightington said that
the Board which appointed the Officer had to suspend him
and therefor notice of suspension should go direct to
Officer Harvey and not to the Chief of Police. The
Statute says that a Police Officer may be temporarily sus-
pended without notice when necessary as a matter of Police
discipline, but only for just cause and for reasons spec-
ifically given him in writing within twenty-four hours after
such.suspension. The Officer has a right to request a public
hearing within three days after the suspension and the public
hearing must be held in not less than three nor more than
fourteen days after the filing of the request. Mr. Ross
moved that in accordance with General Laws, Chapter 31,
Section 42A, the following vote be adopted: "Voted: that
Patrolman Henry H. Harvey be suspended for thirty days
from this day in view of the decision of the Lower Court
and his appeal to the Higher Court which has not acted on
the case". Mr. Giroux seconded the motion and it was so
voted.
A Proclamation issued by His Excellency, Charles H.
Hurle7. Governor of, Massachusetts, was received. . The
Goverlior designated Friday, Sept. 17th, 1937, as Con-
stitution Day, it being the 250th anniversary of the
signi of the Constitution. The Governor called upon
all institutions of learning and public buildings to close
at 12 o'clock mid-day on that day. Mr. Giroux moved that
the Town Office Building be closed at 12:00 o'clock mid-
day, Friday, Sept. 17th, 1937, in order that the employees
night enjoy the observance of Constitution Day. Mr. Ross
seconded the motion and it was so voted.
The meeting adjourned at 1:45 P.M.
