Officers.
SELECTMEN'S MEETING
AUGUST 10, 1937.
A special meeting of the Board of Selectmen was
held in the Selectmen's Room, Town Office Building, tt
3:30 P.M. Chairman Ferguson and Messrs. Giroux and
Potter were'present. The Clerk was also present.
Upon motion of Mr. Potter, seconded by Mr. Giroux,
it was voted to appoint the following election officers
to serve until September 1st, 19384

Mr. Potter moved that the
license be granted
to Mr, Bornstein of 4 Sylvia Street.
Mr. Giroux seconded
the
motion and it was so voted.
Letter was received from S. F.
Bell, Assistant
Manager of the Crane Co., praising
the Police Department
for
its cooperation and service in
locating a member of
that
firm from Chicago who was passing
through Lexington.
Mr.
Giroux moved that a copy of the
letter be handed to

the
Chief of Police and mention made
of the incident in
the
local paper. Mr. Potter seconded
the motion, and
it was so voted.

Letter was received from the Town Accountant thank- '
Town ing the Board for granting him military leave from
Accountant July 23rd to August 5th, under the provisions of
Military Ch. 205 of the Acts of 1935. He attached a copy of his
leave. orders to active duty, and also a statement certifying
that he was on active duty during that period.
Letter was received from the Arlington Board of
Drain in Public Works relative to the storm drain in Hibbert
Hibbert Street. The letter stated that Arlington had no right
Street. to spend money for a drain outside of the limits of the
Town, and for that reason, Arlington would be able to
extend the drain to the Town line only.
Signs Letter was received from the West Lexington
indicating Improvement Association requesting that signs indicating
children children be erected at Concord Avenue, in the vicinity
requested. of the Teeter house; on Lincoln Street on the curve near
the Starrett Road end, and on Shade Street. Mr. Potter
moved that the matter be referred to the Supt. of
Public Forks. Sir. Giroux seconded the motion, and it
was so voted.
Letter was received from D. J. O'Connell informing
the Board that Theresa B. Cummings of 475 Mass. Ave.
Cummings' had referred to him for attention a claim against the '
claim. Town for damages resulting from the taking by Eminent
Domain of a parcel of land owned by her for the
purpose of deepening, widening, straightening and
relocating a brook running through her property. Mr.
Giroux moved that the matter be referred to the Town
Counsel. Mr. Potter seconded the motion, and it was
so voted.
Letter was received from Frederic A. Crofts
Thompson, bringing claims against the Town of Lexington in the
etc. claim name of Clifford D. Thompson, Richard Derby, Thomas
for damages. Morelli, and Irving Saar for alleged damages resulting
from the defects in Waltham Street near the Route 2
overpass. An automobile which Saar was driving over-
turned at this point. Mr. Giroux moved that the
matter be referred to the Town Counsel. Mr. Potter
seconded the motion, and it was so voted.
Mr. Giroux moved that the Supt. of Public Works be
Loam for instructed to place some loam in front of William
Marshall Marshall's house on Independence Avenue. Mr. Potter
house. seconded the motion and it was so voted.
Burke, Application was received from Leon A. Burke, Jr. '
Guide of 81 Bedford Street, for Guide's license. Letter
license. was received from the Lexington Historical Society stating
that the boy had passed his Guide's examination. Mr.
Giroux moved that the license be granted. Mr. Potter
seconded the motion and it was so voted.
The Town Clerk appeared before the Board for the
drawl of two jurors, Mr. William R.'Greeley, architect,
of 1944 Mass. Ave., was the juror drawn to serve at the
Civil Session on Tuesday, September 7th (3rd session).
Mr. Clyde E. Steeves, steamfitter, was the juror drawn
to serve at the civil session beginning Tuesday,
September 7th, (first sessionj.
Upon motion of Mr. Potter, seconded by Mr. Giroux,
the following order for the extension of the water main
in Sherburne Road was signed:
ORDER OF TAKING
By the Town of Lexington of Easement for the Construction
of a water main.
SHERBURNE ROAD.
(From vine Brook Road a distance of approximately
200 feet southwesterly).
WHEREAS, at a meeting duly called and held on
March 15, 1937, and adjourned to lurch 22, 1937, the
town meeting of Lexington, pursuant to an article in the
' warrant of the meeting for which due notice was given,
duly adopted by unanimous vote the following vote and
made an appropriation therefor:
"Noted: That the Selectmen be authorized to install
water mains in such accepted or unaccepted streets, as
may be applied for during the year 1937 in accordance
with authority contained in the By -Laws of the Town,
subject to the assessment of betterments, and to take by
eminent domain any necessary easements therefor, and for
the purpose of said installation the sum of $2,000.00
be appfiopriated, this money to be provided by the transfer
of X1,650.00 from the mater Assessment Fund, and the
transfer of 8350.00 from the Water Department Available
Surplus Account."
AND WHEREAS, the right of way and easement hereinafter
described and taken are necessary for the establishment
and maintenance of the said water main;
NOW, THEREFORE, the Board of Selectmen of the Town
of Lexington, acting as a Board of Water and Sewer
Commissioners, for and in behalf of the said town, by
virtue of the authority conferred upon them by the fore-
going vote and of every other powet them thereto enabling,
herebyiadopt this order of taking by eminent domain, for
the said public improvement for the purpose of constructing

and maintaining a water main in Sherburne Road from
Vine Brook Road a distance of approximately 200 feet
southwesterly as aforesaid, the following easement,
namely:
The right to enter upon the land shown as Sherburne
Road on a plan entitled, "Flan of proposed Water "fain
in Sherburne Road, Lexington, Mass., Scale 1 in. -
40 ft., Aug. 10, 1937, Joseph A. Ross, Supt. Water
Dept.", and owned by
Charles W. and Robert L. Ryder, Trs. - Reg. land
Lexington estates Trust Cert. No. 31157
and construct therein a line of water main with all
necessary connections, shut -offs and appurtenances
substantially as shown on a plan of Joseph A. Ross,
Supt. eater Dept., dated August 10, 1937, to be recorded
herewith in the South Registry District for the Land
Court of the County of Middlesex. The easement covered
by this taking includes the right on the part of the
Selectmen of the said town or other duly authorized
agents of the town to enter upon, dig up, open and use
the land embraced within the said way as may be reasonably
necessary for the purpose of initially constructing and
thereafter maintaining, operating, inspecting, repairing,
and replacing from time to time the said water main, (the '
said town being always bound to see that the ground
after the completion of the work in each case is cleared
of all surplus material and surface left in as smooth
and good condition as at the time of entry.)
Betterments will be assessed for this improvement
in accordance with the provisions of Chapter 80 of the
General Laws. The area which it is expected will receive
advantages other than the general advantage to the
community from such improvement comprises the several lots
shown upon the plan of Joseph A. Ross, Supt. Water
Department, above referred to, which are designated in
the schedule hereto annexed and made a part hereof.
We estimate the betterments that would be assessed
upon each such parcel of land to be as shown in the
said schedule.
We determine that no damages have been sustained and
none are awarded.
To have and to hold the said easement to the Town
of Lexington, its successors and assigns, to its and their
own use and behoof forever agreeably to the provitions
of the said Chapter 79 of the General Laws and all I
pertinent acts in amendment thereof or supplemental
thereto.

Letter was received from Mr. E,. B. Worthen stating
that he had been told that Mr. horade Howard was soon to Letter re
retire as janitor at the Cary Library. Mr. Worthen janitor at
recommended Mr. Peter J. Welch for the position. The Cary
Town Accountant informed the Board that Mr. Howard's Library.
retirement would not come up uhtil after October lst.
The Chairman stated that he would inform Mr. Worthen
of this fact, and also said that he would pass Mr.
Worthents recommendation on to the Library Trustees when
Mr. Howard's retirement came up.
The meeting adjourned at 4:00 P. M.
