The meeting- was called to order by the Chairman, Dr. Kessler, "

'Engineering Department representative Jerry Martin, Administra-
tive Assistant David Hughes and League of Women Voters observer
Edyth Sandy.
Hatch Act Procedure. A letter from the Chairman of Board of
Selectmen requests assistance of concerned departments and pre-
r; sense of representatives at Hatch Act hearings For new Hatch
Act administration Commission recommended that applicant be re-
quired to produce evidence that all other necessary permits have
been obtained from local authorities before a Notice of Intent
be considered "timely" (HMK, FF, ESG)
Hamilton-Baldwin. Following report that repeated attempts to
get in touch with Mr. Hamilton through his lawyer have brought
forth no reply, the Commission VOTED to request the Board of Se-
lectmen to initiate eminent domain procedings, subject to ap-
proval by Town Counsel.
PUBLIC HEARING REGARDING NOTICE OF INTENT OF TOWN OF LEXINGTON
THROUGH ITS AGENT, PERMANENT BUILDING COMMITTEE TO ALTER CER
TAIN INLAND WETLANDS ON THE SOUTHERLY SIDE OF MARRETT ROAD
(CLARKE JR H.S ) , IN THE VICINITY OF THE CLIMATIS BROOK, LEXINGTON.
The hearing was opened at 8 30 p.m. by the Chairman of the Con-
servation Commission, Dr. Howard M. Kessler, who read -the duly
advertised, posted and written notification of this hearing,
held in accordance with the provisions of G.L.c. 131, Sec. 40
(Hatch Act) as amended under Chapter 1020, Acts of 1971.
Present were all the above-listed people, plus the following'
Representing 'the Permanent Building Committee Robert V.
Whitman, 'Chairman, Robert Bradley of Drummey Rosane Anderson,
and Harold W. Moore, P.E. of H.W. Moore Associates, Boston.
Visitor; Weiant Wathen-Dunn.
Mr. Bradley reviewed the DNR requirement of a water-retention
area of 480 cu, yds. below the 206-foot level (bottom of stream
channel at 200 feet) , a condition of the Hatch Act permit issued
early in 1971. Excavation will be 2 to 3 feet below the 206 ele-
vation.
At permit-renewal time, construction of the water-retention area
looked more feasible on bordering conservation land. Permission
for this use of conservation land has now been granted by both
HUD and DNR. Plan change requires new Hatch Act permit .
PBC and Commission mutually agreed that Mr Larson and the archi-
tects should confer as soon as possible - before any earth work begins

Concerns expressed by the Board of Health were reported bf ,lk A

representative explained that standing water was caused by the V , F"'
contractor' s dam so that he could line the stream and construct
the bridge across it under dry conditions. ,,... °
Dr. Kessler asked for further questions, and there were none.
The hearing was declared closed at 8 40 p.m.
Discussion of the Hearing. It was reported that the Town has
agreed to maintain the ponding area. VOTED to request DNA to
_ issue permit to PBG as soon as possible. Concerns of Board of
health were discussed briefly, including mention of mosquitoes.
Concensus that Board of Health should recommend PBC put up a
sign in an attempt to keep horses from school and muddy area.

Spring Street. Letter from Fir. Manning of September 10 and Com-
mission' s letter of September 20 to the information meeting were
noted. (KINK)
Rte 2 Impact. Letter incorporating comments of the Commission to
be drafted "Impact minimal to Lexington now" , with Cambridge
Reservoir to receive most impact. Recommended salt and silt be
kept at minimum. Effect of related Mass. Ave reconstruction may
be greater. (DW, LN)
Hearing (Board of Appeals) on Titelbaum October 17. Concern ex-
pressed about "visual barrier" another house on the hillside
would present. Letter to be drafted. (DW)
Lot on Fessenden Way which is wet, with much drainage through,
subject of inquiry by developer about Hatch Act. (JF, ESG)
Grey Nuns Concern expressed not only for preserving the vista
along Mass. Ave but also about the traffic and trash from the
proposed nursing home, subject of a Board of Appeals hearing
tomorrow night. A mucky area, use of which would involve a Hatch
Act hearing, was pointed out: Mrs. Rawls will appear at the
hearing on behalf of the Commission, who recommended she not also

Following an executive session declared at 9 50 p.m. , the meeting
adjourned at 10 59 p.m.
