SELECTMEN I S MEETING
MAY 16, 1933. '
Mr. O'Connell reported that the Sacred Heart Church
desired to use Cary Memorial Hall on May 26th at which
Cary Hall, time they intended to hold a benefit, the proBeeds of
which"would be given to the pastor of the Sacred Heart
Church, who has been ordained for twenty-five years.
He requested that the hall be given at the minimum rate
of $15. and.the Board so voted.
Applications for Peddlers Licenses to peddle bakery
Licenses. goods were signed for Roy A. Patterson and Charles Be
heath= Both boys are employees of the Hathaway Baking
Company.
Program of the British Naval and Military Veterans
British Assoc. giving}activities to be held in Lexington May 81st
Veterans -was received.
Program The Chairman reported that he requested Mr. Gilcreast
to represent him in greeting the veterans.
Letter was received from the Town Clerk in which he
enclosed claim for personal injuries caused to Paul
Bloustein Bloustein, alleged to have been caused by defect in the
claim. sidewalk in front of premises #12 Sylvia Street, said to '
have occurred on April 29th at 11 A. M.
Supt. of Public Works was requested to take a
photograph of the conditions and present the same to the
Board at their next meeting.
A regular meeting of the Board of Selectmen was held
in the Selectmen's Room, Town Office Building, at 7:30
P.M. Messrs. Trask, Gilcreast, Ferguson.aiDtConnell and
Lyons were present. The Clerk was also present.
It was voted to grant the Lexington Drum Corps the
Cary Hall
use of Cary Memorial Hall on May 17th to conduct a dance
at the Minimum charge of $15.
Letter was received from the Town Accountant in which
he advised temporary loan in the amount of $175,000, dated

It was voted to ,authorize the Treasurer to bring in
bids on this loan at the next meeting of the Board.

Hearing was declared open on the application of the
U. S. Bond and Mortgage'Corporation for permission to

was voted to grant permission to maintain a two car garage
subject to the approval of the Building Inspector.
Mr. Gallagher came before the Board and presented a
proposition of War Memorial partraits. He explained
that he appeared before the American Legion and explained
the proposition and he again appeared at their meetinglast
evening and they were in favor of the proposition as a
memorial to the Lexington dead heroes. He presented
the type of portrait which was made from the original
and explained that it is a copper plate with a gold finish
which is guaranteed to keep for a great many years. He
gave statistics on the number of pieces they had done for
Boston, Cambridge, Lynn; and other places about and stated
that many months sometimes are spent in securing the

portraits of the dead heroes and that they must be en-

larged and the proper uniform used on the picture and
they are then made a uniform size. When the pictures are
completed there is usually an unveiling ceremony. He
stated that the project has the approval of the State
Dept* of the American Legion.
He also understood that in 1924 the Town was

awarddd the sum of $3617. as their share of the amount
returned on poll taxes, the same to be used for War Memotials
and that the money for these portraits could be expended
from this fund legally.
The Board informed him that they would take the
matter under advisement.
Mr. Lyons stated that he would communicate with the
Legion to see whether or not they were fully in accord
with the project and report back to the Board at their
next meeting.
Mr. J®ft J. Garrity, Supt. of the Park Department,

came before the Board with the Supt. of Public Works. -
The Supt. presented bids for the filtering system
at the swimming pool at.,the playground and stated that
the lowest bid was received from the Lakeside -Engineering
Corp. of $1050. He also reported having receiged bids
from various companies on the pump but he had not

Mr. Garrity stated that the present pump, he under-

stood, would take up to fiftden pounds pressure but
would not take any beyond that. He stated that they would
have to, therefore, back -wash every day.
Supt. of Public Works felt that the pump, when
installed in the swimming pool, was Jjig enough, but was
not intended to take care of the filtering system.
Mr. Garrity was requested to get additional information
from other places where there were swimming pools in regard

to the pump as this would not have to be ordered
immediately.
Mr. Garrity did advise, however, that the filtering '
plant be ordered immediately so that it would not delay
the swimming season for it would take probably three
weeks to get it here.
It was therefore decided to accept the bid of the
Lakbside Engineering Corp. at their bid of $1030. and
to lay the matter of purchase of pump on the table.
Hearing was declared open on the notice of the Board
of Survey for approval of plans for layout of streets over
property of Harry E. Johnson, known as the Lexington
Board of
Brick Village, located on Mass. Avenue near Sylvia Street,

Mr. Joseph Selwyn, 86 Clarke Street, Belmont,

engineer for Mr. Johnson, appeared before the Board and
Village,
presented the plans which the Town Engineer stated had been
approved by the Planning Board. The plans had previously
been rejected for changes in the grade of ten and twelve
per cent which had now been reduced to ten per cent.
The Board voted to approve the plans and signed the
same for record.
At 8:15 P.M. joint hearing of the Board of Appeals
and Board of Selectmen was held on the application of
Esther R. Barnes for permission to maintain a garage
on land at 12 Sheridan Street.
The Chairman of the Board of Selectmen announced
that the hearing had been duly advertised in the Lexington
,
Minute -Man and the Clerk of the Board of Appeals read the
notice of the hearing of the Board of Appeals which had
been advertised in the Lexington Minute -Man.
Dr, William L. Barnes, representing Esther R. Bar nes,
appeared and stated that the lot was triangular in shape
and the street is an unaccepted street, and in order
to place the garage on the lot it would be located within

be able to give it to them. In this connection he also
called attention to the bridge across the brook which he
built up so people could go across although he did not
see why he should have to do it as he'felt it was a duty
of the Town.
Dr. Barnes, upon question asked by a member of the
Board of Appeals, stated that he was not sure whether
he could loegte a one car garage on the lot without
coming within twenty feet of the street line owing to the
fact that the street is not accepted. He presented two
plans and stated that he would prefer the plan that the
garage be located on the same line with the house.
There was no opposition to the application.
The Board decided to lay the matter on the table for
one week.

Letter was received from the Health Inspector in which
he called attention to the condition of the back of the
First National Stores and stated that he had requested the
manager to clean up several times, but he had received no
cooperation.
It was decided that a letter should be written to the
manager and if he did not cooperate, that the Health Inspector
should tale the matter to Court.
Mr. Lawrence Allen came before the Board in regard to
having a repair shop in the building owned by Mr. Denham
in the rear of the Marshall property on Mass. Avenue.
He presented a letter signed by Lester Smith in which
it was stated that Harry Osgood did repair work for him in
this building during the year 1925 and 1926.
He also presented statement of Walter Rose that he
operated and maintained a service station for the repaft
of automobiles in this building prior to the adoption of
the Zoning Law. There were, however, no dates in his
letter which would prove that it was in operation before
the Zoning Law,
Mr. Allen was requested to present more definite
information in regard to the use of the building prior to
the Zoning Lawp before the Board could take any action.

Letter was received from Mr. Edward Mara in which he

stated that in his bid on the painting of Cary Memorial
Building, he would strip six pairs of doors, '

Letter was received from the Supt. of Public Works
in which he stated that Mr. Sam Lippa requested that an
Water article be inserted in the Town Warrant for the next
Mainbj, meeting authorizing the payment to him of the cost of
Fottler installing the six inch water main in Fottler Avenue .

the article in the Warrant.
Information was also to be received in regard to the
bankruptcy of Mr. Lippa.
Supt. of Public Works reported that he was all finished
Pollen with the Pollen Road job except for the driyeway in front
Road.. of Cain's property.
The Board requested him to have the street cleaned up
as soon as possible.
Mr. Lyons called attention to the Pact that Mr. Healey
called him in reference to the grass border in front of ,
his property and stated that Mr. Custance promised that
the border would be seeded by the Town and that it had
Grass not been done.
Borddr, Supt. of Public Works stated that the border had been
Healey. seeded, but the children trampled it so that it did not
grow. This having been done once, it was felt that no
further action should be taken on the matter as all
persons about the Town plant their own grass borders.

The Master Service Station being the lowest Bidder, it
was voted that the Supt. of Public Works award the bid to
them.
The Chairman reported that he felt that the traffic
light at the corner of Bedford Street and Elm Avenue should
be shut off.and put on the yellow blinker at all times
except Saturday afternoons, Sundays and holidays, and the
Board so voted and instructed the Supt. of Public Works to
see that this was carried out.
The Supt. of the Water and Sewer Dept. was authorized
to turn over all sewer rental charges which he has been
unable to collect to the Town Counsel.
The Chairman reported that he redeived a call from
the State District Health Officer and was informed by him
that toe Town had no right to use Tewksbury for Lexington
Cases. He was referring to the case of Walter Webster
who was recently sent to Tewksbury.
The Chairman also reported that Mr. Webster Sr.
requested that his son be moved from Tewksbury to 'Rutland
Sanatorium.
The Clerk reported that the information was brought to
the attention of Dr. DeWolfe from the Social Service Dept,
of the Mass. General Hospital, Tonight Mr. James Webster
reported to the Chairman that Dr. DeWolfe had telephoned
him from Portland, Maine, that his son should be moved to
Rutland by the Board of Health.
The Clerk also reported that the Middlesex Co. San.
examination showed that Mrsa Walter Webster had minimal
tuberculosis and that tato of the children they had advised
be sent to vamp this summer, and they also advised that
Mr* Webster be moved immediately from the home but there
would be no admission for probably four months for him at
the Middlesex County San. The circumstances were explained
to Miss Burton's office and she gave permission to have
Mr. Webster moved to Tewksbury.
The Board voted to approve the application of Walter
Webster for admission to the Middlesex County Sanatorium.
It was decided to take no further action in the matter
other than what has already been taken except that the
Chairman communicated with Dr. DeWolfe stating the

situation and also wrote to Miss Burton requesting that
he be allowed to remain in Tewksbury until transferred I to Middlesex County Sanatorium.
The Clerk reported that the State Accountants advise
that the Town adopt the By-law in regard to purchases so
By-law. that the Selectmen would have authority without having
additional votes on record. -This By-law was turned over
to Mr. O'Connell some time ago and he ggreed to get an
opinion from the Attorney -General. He stated, however,
that he would bring the matter before the Board next
Tuesday night.
In regard to the contract of the garbage collector,
the Chairman reported that he had written him a letter
Garbage recently calling his attention to the violation of the
Contract contract by keeping his wagon uncovered, and he also
stated that Mr. Connors had come to him and agreed that
he would comply with the contract.
No further action was taken on the matter.
State It was voted to grant Mr. Edwin B. Worthen the use of
flags the State flags owned by the Town for the International
Rotary Club.
Letter was received from Mrs. William Hannam,23 Lincoln
Street; in which she again complained of the noise caused '
Complaint by Mr. Grieves dogs.
re dogs The Chairman presented a letter which was read to the
Board and approved by them in which it was stated that
Mr. Grieves had complied with the request of the Board
last winter In keeping the dogs in his house and cellar
and the Board did not intend to take any further action
on the matter.
Letter was received from the Bureau of Old Age
Johnson Assistance in Lowell in which they stated that they would
Old Age not approve the increase in old age assistance granted to
Assistance. Mr. and Mrs. Charles W. Johnson of Concord Avenue.
The Matter was referred to Mr. Gilcreast for his
attention.
Letter was received from the Town Counsel in which he
gave instructions in regard to the action to be taken in
Trunk donnection with the trunk line sewer. He instructed
Line that the Town Engineer determine the exact location of
Sewer the sewer and the land to be taken, and that an article
be inserted inthe Warrant for the next Town Meeting
authorizing the taking.
Town Counsel and the Supt, of the Water Dept. and the
Town Engineer came before the Board and discussed the '
matter of betterment assessment for water mains to be
constructed in Simonds Road,
The Town Counsel having advised that betterments may
be assessed for water mains, the matter of the amount to be

assessed to the owners of the property was discussed.
Town Counsel explained that the charge should not be
more than the benefits to the land.
Mr. Ross stated that Holyoke was the only city he
knew of that assessed betterments and they assessed $1.
a foot. Town Counsel stated that they must have a Special
Act allowing them to do this.
The question of whether or not 100 per cent of the
betterments should be charged was also discussed or whether
a flat rate for a lot of certain length should be charged.
However, no definite decision was made except to set the
estimated betterment at 100 per cent.
The Board signed the order for water main construction
in Simonds Road to be filed at East Cambridge,
Mr. Pasquale Moretti came before the Board and stated
that he had a tax bill which amounts to $116. odd dollars;
that the Town is paying him $40. a month rent for his house
for his son and his son -in- law who are receiving assistance
from the Town. He has to pay $50. a month to the bahk and
he had no income other than the house. One house he owns
is in the Co-op. Bank in Arlington and the other is on ,6he
straight interest charge. His son Joseph is working four
days out of which he receives 8. for his family and 04,
is held for rent which is paid to him.
The Board advised Mr. Moretti that they would take the
matter under advisement. No action was taken on the matter.
Mr. Joseph Vitale came before the Board and asked that
he be given some extra time so that he could pay his taxes.
He stated that he had to expend money for his mother Car
doctor bills. The Board informed him that he should have
the services of the Town Physician.
The Board referred him to Mr. Mitchell.
The meeting adjourned at 10:45 P.M.
