SELECTMEN'S MEETING C4
JUNE 21, 1932
A regular meeting .of the Board of Selectmen was
held in the Town Office Building, Selectmen' s Room,
It 7:30 P.M. Messrs. Trask, Custance, Gilcreast, Ferguson
and O'Connell were present.,
Hearing was declared open at 7:46 P.H. on the petition
of the E. E. I. Co. for permission to eriot and maintain
one pole on Pinewood Street approximately 280 feet west
of Summit Road.
It was voted to grant the permit.
Mr. Nicholas Alterioso and Mr. Longbottom, Building
Inspector, came before tee Board.
The Board at a previous meeting authorized the Building
Inspector to proceed against Mr. Alterioso for building a
building on Mass. Avenue opposite the Sullivan property
without a permit.
Mr. Alterioso stated that he did not know that the
Building Laws required that he get a permit. He also
stated that he did not find the building posted as the
Building Inspector stated he posted the building. 4e
wanted this building for a tool house to put his to ls,in
so that he could get the ground ready to build sometime ,
next year. He stated that he appealed from the decision
of the Building Inspector to the Selectmen owing, to the fact
that he should be allowed to use this building for a locker
,for his tools.
. After discussing the matter, the Board voted to inform
him that they would uphold the decision of the Building
Inspector.
Mr. Frank Bougie, who 'lives on School Street, came
before the Board together with the Building Inspector.
Mr. Bougie presented a summons that he had received
on the complaint of the Building Inspector that he violated
the Building Laws.
Mr. Longbottom explained that he had given Mr. Bougie' s
daughter a permit and that she had paid the fee of $2. When
he went up there, he found that they were not building in
accordance with the application and he gave him back the
$2. and tore up the permit. Re told Mr. Bougie not to
do any further work, and Mr. Bougie laughed and said that it
was only a repair job he was doing and did not need a
permit.
Mr. Bougie explained that he did not understand about
the application; that his daughter, who is 26 years old
and married, got the permit for him and told him that it
was all right to go ahead.
The Board inquired whether or not he understood he
had to have a permit, and he stated that he felt it was only
a repair job. On further investigation, he stated that he
also intended to do plumbing work in the building himself
but owing "to the fact that Mr. McNamara was out of work

he had him do it for him. Hf intended also to do that
without a permit. Mr. Bougie explained that this property
was a two-room camp that Caterino had. He stated that there
was no cellar under the house.
Mr. Longbottom explained that the house sets on blocks
of wood and that you can see the plumbing underneath all
exposed. However, Mr. Bougie told the Board that he
could fix the place up any way tha they wanted it fixed.
After he retired, the Board discussed the matter and
felt that they should eontinue the matter in ‘%ourt.
Mr. O'Connell wanted to be recorded against taking
the matter to the Superior Court inasmuch as that would
mean expense to the Town and Mr. Bougie has had his notice
that he had got to comply with the Building Laws and he is
now willing to do anything the Board asks and the Town will
get what they want without going to Court for it. He also
objected to the case being tried in the Superior Court
rather than the Concord Court.
The Board therefor decided not to do-anytt*pig on the
matter until they requested the Town Counsel to come before
them and explain why he took the matter to the Superior
Court rather than the Concord Court.
Mr. Custance reported that he had viewed the dump that
is on Cliffe Avenue near Bow Street, and while there are trees
and bushes growing up there now that partly cover the dump,
it appears that there has been dumping there in the past. Dumps.
The Supt. of Public Works was requested to take one of
the unemployed men with Mr. John Collins and have him clean
up the dump and post it With a ono dumping" sign.
Attention was also called to the dumping on the Philip
Leaf property on Cottage Street near the Boston & Maine
R.R. tracks. It wax dewided to request Mr. Leaf to prohibit
further dumping on his property.
the Building Inspector informed the Board that he had had
an application to change over the roof of the three family Bldg.
house on Shirley Street. The application was for a pitched Inspector.
roof. Mr. Custance suggested that if it was brought down to
the second floor that the place might be more attaactive.
The Building Inspector stated, however, that the plan
did not appear to make the place look any worse than it does
at the present time.
Mr. Pasquale Moretti, his daughter, and Mr. Casimiro
Bertini came before the Board. Mr. Moretti wanted more work
on the Unemployment Relief. The Board inquired of him in Mr.
regard to the property he owns, and found that he owned one Moretti
house in which them are three families. His own family, re more
a married daughter and a married son lived separately at work.
SO Bow St. On this house there is a mortgage of $3500.
in the Arlington Co-operative Bank. They own another house
on Melrose Avenue where two families live, for which they
receive a rent of $56.00 a month. This house is mortgaged
for $3200. held by the ArlingtontFive Cents Savings Bank,

there is no mortgage. He owes $380. taxes, and he felt that
he should be given additional work so that he could pay the .
taxes. ►•.0
He stated that he built the brick house on Melrose
Ave. six years ago. There are seven persons in his own family, '
none of whom are working except the employment he gets on the
Unemployment Relief.
The Board requested the Building Inspector to look into
the correspondence and the permits granted to Mr. Moretti
to have a two family house on Melrose Avenue and the use of
the house at 80 Bow St. for three families and report to the
Board.
Mr. Casimiro Bertini stated that he had lived on
Hillcrest Ave. for about eight years,and the water had not
been installed on that street although the Town at one time
Mr.Bertini voted to install the water, and at that time the people
re water would not sign the guarantee.

on the street.
The Board explained to Mr. Bertini that the proper
plans and profiles would have to be filed and the Board of
Survey would have to approve the plans of the layout of
the street before the water could be installed.
It was also decided to write a letter to Mr. Bertini
explaining the matter to him and enclosing a copy of the
Board of Survey regulations so that he could get an
engineer to provide the proper plans.
Hastings Communication was received from Herbert J. Kellaway '
Park. in regard to his services on Hastings Park, and .it was
voted to approve the bill of $30.00 for his services.
Mise. water Miscellaneous sewer charges in the amount of $442.25
& sewer was stitned by the Board, also mientili3.neous water charges
charges. in the amount of $515.12.
Letter was received from the Town Accountant in
Temporary which he advised the issuing of a temporary loan of
Temp. $175,000. dated June 29, 1932 and payable April 18, 1933.
The Board dltetided to authorize the Treasurer to request
bids for the loan.
The Chairman stated that Mr. W. Benjamin C. Meady
Mr.Meady desired to have some action taken by the Board on his
damage letter of April 22nd, in which he stated further an

re aa- amount which he claimed as damage to his property
ert$. alleged to be caused by deficiency in the drainage situation,
the total amount of the claim being $5,821.00.
The Board discussed the matter and decided, after
viewing the premises, that they do not believe the damage
was caused by the Town, and decided to notify Mr. Meady
that they would take no action in the matter.
The revdstbn_.of the Jury List was laid over for one '
week.
Mr. Benjamin Santosuosso of 91 Bow Street came before
the Board and stated that he desired to have more work. He had

five children, one boy 21, another 18, and a girl working part

He was getting four days a week, and desired more time.
He has seven in the family.
The Board thought that Mr. Santosuosso' s sons should be
able to get something to do, and felt that he should only
have three days a week.
The Town Engineer presented plans showing the installation
of a sewer in Shirley Street. He felt that the sewer should
be installed in Tewksbury St., Sargent St. , and the lower
part of Shirley St., at a cost of approximately $10,000. Sewer,
The Engineer was requested to bring in to the Board Shirley
figures on the cost of installing a sewer in the lower St.
part of 'hirley St., and the whole length of Shirley St.
The Supt. of iublic Works presented figures on the
installation of a drainage pipe in the Curve St. brook
amounting to $1,000. Also an estimate for continuing
from the end of the 30" pipe to a new culvert under the Drainage.
railroad tracks amounting to $1080.00.
It was voted to lay the matter on the table until
the next Town Meeting.
Letter was received from the Plutbing Inspector in which
he called attention to the plumbing work partly done in the
house of Mrs. Erwin on Milk St. Mr. Robert Watt had partly
completed the work and left it so that it would be a cause Plumbing
of sickness in the house. He stated that he was sending Inspector,
a sketch to the State Board of Examinors for their criticism
for whatever action they might take. The Board felt there
was no action for them to take in the matter at this time.
The Chairman reported that although Mr. Denney re-
ported to the Board that he could not make the turn down
Fairview Ave. owing to the grade, and that he had to go up
Alpine St., and that he shoveled the snow out in the winter
to theold Mass. Ave., be had found out from Mr. Bashian
that Mr. Denney used Wood Street in the winter time instead of
coming out old Mass. Ave., and that Miss Meyer who lives on
Fairview Ate., and that Miss Meyer who lives on Fairview
Ave. did all the shoveling out onto Mass. Ave. Mr.
Mr. Bashian felt that Mr. Denney might be forced to Denney.

blocking up old Mass. Ave. he agreed that he would pull the
stones away allowing Mr. Denney to go through providing
Mr. Denney would do something in regard to the Colonial
Heights development.
The Town Engineer reported that Mr. Bashian had this
evening informed him that he and Mrs. Denney were willing
to sign the papers to help straighten out matters on
Colonial Heights.
Mr. Ross informed bhm Chairman of the Board that he
felt that Eleanor M. Lowe should be appointed as Water
Registrar, inasmuch as she signs a great many letters Water
writtent by the Water Dept. , and felt that she should be Registrar.

The Board voted to appoint Miss Lowe as Water
Registrar.

The Chairman reported that he had written to John
N. Ocnnord and that he stated that he would remove the
pigs from Lexington at an early dare.
Mention was also made of the fact that the garbage
collection is not being made as regularly as it should

all complaints put in writing so that some specific
complaint will be on hand.
Mr. Custance reported that he understood that the
garbage was not collected on Parker Street at all last
week.
The Supt. of Public Works reported in regard to the
game played by the Fire Dept. called water polo. He stated
that the game is played on the B. & M. R. R. land in rear of
the freight house on Mariam Street, and the water
is taken from a hydrant on Oakland Street. The game Is
similar to hockey there being five players on each team. He
stated that the game consists of three five mute periods,
with a two minute rest period,. and ties water was shut off

polo. Mr. Gilereast stated that the complaint was made that
the water was not shut off during the rest period.
Mr. Scamman stated that the Lexington Firemen have
played other teams in water polo, and it appears to be a
game played by the fire departments.
Mr. Scamman was requested to find out just how much
water was being used and the cost to the Town.
Old Age. Application for Old Age Assistance of Mary J. Rogers
Assistance. of 29 Waltham St. was referred to Mr. Gilereast for
hie attention. .
Letter was received from the Supt. of Public Works
in ii]'h.ahh. he stated that Mr. H. S. Johnson of 5 Forest St.
Windshield stated that he was driving over Waltham St. between
damaged. Blossom St. and Stedman Rd. on Wednesday, June 15th and a
stone picked up by a car going in the opposite direction
hit his windshield, damaging it so that it had to be
repaired.
Mr. Seaman stated that it was necessary to make
repairs on Waltham St. between Concord Ave. and Stedman
Rd. , and that after the asphalt was applied it was
covered with pea stone, and rolled, and some of the pea
stone rolled in the gutter. On that afternoon some of the
pea stone was scattered over the asphalt and evidently
had not been rolled won. He had driven over the street
at nine o 'clock and found that there were no loose atones.
The Board felt that there was• no liability on the
part of the Town and decided not to take any action.
Report was received from the Supt. of Public Works I
in which he stated that the charges on sewers in the
Hewer Metropolitan District were made under authority of General
charges. Laws, Chapter 92, sections 5, 6-, and 7.
He also stated that the total sewer charges in 1931

were $4,990.75, There will be no request for entrance
to the Metropolitan Sewer at this time.
Mr. Sam Lippa came before the Board in regard to the
Board's paying $420. to him for * ea water pipe in Fottler
Ave. He stated that the job cost over $2,000. and he would
not be satisfied with the payment of $420.
The Board informed him that they felt that was all
the pipe was worth at the present valuation. Water
He stated that the pipe was put in in 1916 by the pipe,
Suburban Land Co. He stateJthat be owes the Town Fottler
a bill for betterments and the Town owes him a bill, and Ave.
he felt that he should get a settlement.
The Board informed him that the Town did not vote
the sum of $420.
He presented an agreement which the Suburban Land
Co. gave him as a release of the title in the water pipe
laid by the Suburban Land Co. The Suburban Land Co.
included in the release that he was in no way to involve
the Suburban Land Co. in any suit. Mr. Lippa stated that
the pipe cost him $1500, and he felt that he was entitled
to something back.
The Board called his attention to the fact that the
Town re-laid the pipe, but he felt this was through no f ault
of the way the pipe was originally laid.
The Supt. of Public Works called attention to the fact
that a hydrant at 149 Spring St. in front of the property
of John J. Kenney was a menace to the people driving in Hydrant.
the driveway, and should be moved about twenty feet.
He recommended the change.
The Board authorized the Supt. to change the hydrant .
The Supt. of Public Works reported that he was to
have additional information on the tractor, but he was not
yet ready to report on it.
Report was received from the Sapt. of the Water and
Sewer Dept. in regard to the activities of the two men
on the Water & Sewer Dept. truck on June 18.
Mr. O'Connell felt that the report was entirely wrong
inasmuch as he had seen sone one on the truck that day,
He stated that Mr. Ross simply got his information from
the driver on the truck and he did not believe the
information was true.
The Board decided to request Mr. Ross to report further
tin regard to the matter next week.
In regard to the resolution passed by the Town relative
to the contribution of the Town Employees of two days a
week the Board discussed the matter of notifying them, and
Mr. Trask presented a form which he felt would be satisfactory
to have signed by the Town Employees to authorize the
Treasurer to take two days pay from their salary
and decided also to communicate with the heads of the
departments suggesting that they comply with the request,
inasmuch as it is imperative that the work contemplated be
carried on,
The Board discussed various persons who should be
included in this .

The Supt. of Public Works reported. that the following
were on a regular seven day week: Mr. G. French, Joseph
Campbell, Alexander Quinn, the.. Patton, and Mr. Barry.
.It was decided wherever possible o make * five day week so that
the men would not have to contribute.
It wap decided to place George Harrington, George
Ryan . and Joseph Ross on a five day week.
It was also suggested that the men employed by.Mr.
Garrity be employed on a five day week basis.
In regard to the firemen who have contributed $1.00
a week since January 1, it was decided to request them to
pay the balance of the amount up to July lst, and to
contribute one days pay for the balance of the year. This
was also to be done by the other town employees who contributed.
In regard to the work to be done Mr. Trask reported
that Mr. Garrity could start on the sidewalk work on which
he could use ten men, and that the wall in front of the
Murphy property on Pollen Rd. could be done, and also the
Waltham St. drain.
Mr. Custance stated that he felt that dumping should
be allowed in the back of the Public Workd Dept. property.
He felt that in the future there might be an opportunity to rent
the land in the back of the property temsene proposition, for
instance storage of oil tanks or a pOle yard for the E.E.I.
Co. for the New Eng. Tel. & Tel. Co. , and there -Alight be an
opportunity to get some earnings.
It was suggested that the Lincoln St. Dump be closed,
and the people be requested to dump on Bedford St. The
Eoa±adlfelt that persons who do dumping should be
notified that they could dump at the Public at the Public
Works property.
Mr. Trask reported that he would get the landscape
plan of the Public Works Bldg. for the next meeting.
Complaint was made of the Hathaway Baking Co. 's
trucks driving fast on Walth , 5t. It was decided to notify
the Chief of Police and have,-write to the Company.
Report was received from Mr. Weary that persons were
still parking on Oak St. The Supt.of Public Forks was
requested to erect a "no parking on either side of the street"
sign, at Oak St.
The Supt . of Public Works was authorized to purchase
whatever 10" or 12" pipe was needed for the installation of
water pipe on Grant St.
Mr. Custance called attettion to the fact that East
St. should be relocated before the water pipe is installed,
and requested that a formal hearing be set up in two weeks
if the Town Engineer could get the information read►.
It was decided to request the Health Inspector to
inspect the Collentropo property on Cottage St.
The meeting adjourned at 11:50 P.M.
