Trask, Custance, Shannon, slake and-Gildreast' were present, The Supt, of Public Works and the Cleric were also present. He intended to write to Mr. Davis . Keniston also, asking him for his opinion in regard to the placement. of the standipie en Turkey Hill and whether or not he would approve it. At the joint meeting held in Arlington last Tuesday, the Board of Selectmen of Arlington were much in favor of placing the standpipe on this location. A suggestion was made that the tank might be built low and have fieldstone around the outside and that would''not be as objectionable as a tall standpipe. Letter was received from the Town Counsel in which , he enclosed a form of release of damages when a water Releases. gwftntee is signed, He advised that he felt that this form of release would be better than the one that was formerly used by the Water and Sewer ].rtment. He also advised that this be used asIT!,o unac eepted streets inasmuch as when the cw n lays out a street they require the rights in the street. 1 The Clerk reported that Mr. Neil McIntosh desired a decision on the matter of rebate on water guarantees which he felt he was entitled to owing to the diff'erance in the construction and size of the pipe,.and the hand labor and machine labor. Mr. Custance stated that he would report on this matter next week. As far as he could see at the present time, he felt that Cdr. McIntosh might be entieled to a rebate on Wachusett Drive but that was the only street he might be entitled to. Complaint was received from Vence;nzio DIAngelo of the condition of the house in which he lives located at the corner of Ward and Ash Streets owned by Joseph Defelice. The owner's son occupiers the second floor and Mr. D'Angelo the first floor. In this house there is but one bathroom and the water has been shut off in the bath- room since Dec. 7th. Mr. D'Angelo,•his wife and four children, found it inconvenient and therefor complained of the odors from the outhouse which they are.compelled to use. It was decided to refer this matter to the Health. Inspector -to investigate and report next Tuesday evening. The Board approved the follming reports r#r the Town report. Committees Appointed at Various Town Meetings Complaint, DtAngelo. A joint hearing was held with the B6ard of Appeals on the application of the A. G. Davis Ice Co;, Robert L. Innis and Dougal McLennan, owners, to store 4O,000 gallons of fuel oil. . Mr, Glynn 6f the Board of Appeals wead the notice of the hearing, and the Chairman of the Soard of Selectmen called the meeting together. Cdr. The tanks would be instalbld to meet the requirements of the underwriters. On the sketch ii was proposed to build a fieldstone garage abutting the Town of Lexington property with a capacity bo hold fifteen cars. ,The arse house and office are proposed to be left as they are now. Adjaeent to the garage, a pump room was to be installed to pump . the oil from the underground tanks. On the front of tha, lot facing Grant Street, it was proposed to build a block of stores. Next to the Town Ha,11 lot' it was proposed to build a high wooden fence to hide the view of the buildings from the Town property. Inquiry was.made as to whether or not there was a siding there to get the ail from. Mr. Goldman stated that, he thought there was a siding back of the Town Hail, and tl-AV Mr. Innis could get permission to extend that about 150ifeet up on to his property. Mr. Innis would have to pay the expense of this extension. The'Board of Selectmen discussed the application of A. G, Davis Ice.Co. and voted that permission be granted to install four tanks of not more than a total capacity of 40.9000 gallons of fuel oil, and same to be installed as show on plan showing first sketch of development on property of A. G. Davis Ice Co, Lexington, Mass., as prepared by G. N. Mitchell, Architect and S Myrick, Landscape Architect, dated Jan. 19, 1932, this permit to ;r be granted with the understanding that all developments �bn th3.a lot of land in the future shall be carried out substant- ially-as::.s on the plans numbered one, two and three a copy .of which will be kept on file in the Town Office. Letter was received from the Town Counsel in regard tAo the bill in equity brought against Joseph V. Boinay. the Board of Appeals decided not grant Mr. Boinay a permit for &'roadside stand when TA recently applied for the same. This decision 6.f, the Board of Appeals was sent to the"fas Counsel and he now inquires whether or not the Board desires to have him proceed to obtain an injunction against Mr. Boinay. He &Zoo inquired about any evidence that might have been found about Mr. Boinay's sales of ginger ale or tonic and if the Police Dept. could furnish any evidence of such sale. Memorandum was received from the dierk that the Police Department had no evidence of any sales. The Board of Appeals discussed the matter with the Board of Selectmen and it was decided that the Town Counsel be notified that the action against Mr. Boinay be temporarily withdrawn, and in Oise Mr. Boinay.attempts'to open the stand 'without a permit agiin, the Town will be forced to take detion. Application foe' the use of Cary Memorial_Hall for the Girl Scouts was referred to the Chairman. Cary Applicatibn'for the use of the hall by the American Memorial Legion Aiixiliary at reduced rates was. aljso referred to < Hall. Chairman. - The Supt. of Public Forks was requested to get figures on the operation cost of.the Cary Memorial Hall and present the same to the Ohariman so that he might set -the rate for the use of the hall,. Letter was received from Paul M. White, Town +Counsel 1 1 u 1 Cl 343 of the Town of Arlington, in which he enclosed a petition signed by the Selectmen and Board.of Public works of Arlington requesting the abatement of $913:38 with the interest, $46.44, these amounts being the sewer betterment assessment levied against the Town of Arlington when a Town of sewer was constructed in Fottler Avenue., The sewer Arlington being of mo'benefit to the Town of Arlington, the Board Assessment. of Selectmen requested the Board of Assessors to abate this amount; the Town of Arlington in turn would abandon their suit for damages which was filed to offset the betterment charges made agifast`them.. Mr. Gilcreast reported that he had visited Emma A. Quimby and Ralph A. (4uimby, 21 Muzzey Street, who applied for Old Age Assistance. He stated that one daughter did, at one time, worlf for the Internal Revenue, but now is waiting for a position. The daughter's husband with whom they live has an income of $40, per week,, having been.Mtttw&0As on his income. The daughter in Washington pays for his Quimby $.300. insurance which he carried in the Royal Arcaiaum and Old Age alto sends them.coms money. Mr. Gilcreast recommended $6.00 per week Old Age Assistance for each person, In regard to the application for Old Age Assistance of Vienna 0. and Charles W. Johnson, letter was received from the Dept. of Public Welfare of Lm ell in which they stated that they did find Mr, Johnson living in Lowtli from 1911 to 1930.; but they felt that the application shouldbeinvestigated Very•carefull7. Johnson was a contractor in business in Lowell and gave up the business in 1926. in then he has been living on the funds that he had. Johnson, Old Age. Upon recommendation of Mr. Gilcreast, the Board voted to.grant Old Age Assistance in the amount of $6. a week eaoh for Mr. and Mrs. Johnson,, Letter was recq'ived from the Dept. of Conservation Moth In which they approved the appointment of Osborne J. Gorman Supt. as Moth Supt. for the ,year 1932. `'=wetter was received from Patrick J. Neary in.regard to the deplty able condition of Oak Street. He .called attention to two bad accidents which occurred there by cars skidding on Oak Street and requested that the street Oak St. be heavily sanded. He also called attention..to the parking of cars at the Lexington Times -Minute -Man office and to the danger of the street for that reason. .The Chairman was directed to reply to the letter. Notice was received from the Town -Counsel in which street he stated that he knew of no requirement that required a 1syeasts. The Board discussed the Reed Street drainageapnd felt that this drainage work should be dons next year as a part of the drainage program. Mr. Custance called attention to the fact that in Woburn Street there should be installed a sewer before any reconstruction work is done., A sewer job would cost about two or three thousand dollars., He felt that Woburn Street could go until that Highway lesdone. Available Surplus to the Maturing Debt,-and it was voted hnt.to,make any transfer this near. '. The.Board discussed whether or not they Would keep a record of the committees appoint at the various Town Meetings in the"Town Report. The Town By-law states that the Committees should report at a `foam Meeting or automacally Cease to function. it.was .decided .to notify all .Committees 'that had- ot,,Y-99 reported that'they must report at the Annual ov6M`ftetipg in March..
