SELECTMEN'S MEETING �

A regular meeting of the Selectmen was held at the
Selectmen's Room, Town Office Building, at T:30 P.M.

Messrs. Trask, Custance, Shannon, Blake and Gildreast
were present, The Supt. of Public Works and the Clerk
were also present,
Application for the Board of Survey app' oval of

Suggestion was received by the Chairman from Mrs.

The Chairman stated that there would b„ a joint

The Chairman read the letter which• he wrote to
Chairman Gott of the Arlington Selectmen after the '
joint meeting of the Boards of Selectmen of the two
Standpipe, tbwns relative to placing a standlone on Turkey Hill,
Turkey Hill. He intended to write to Mr. Davis 0. Keniston also,
asking him for his opinion in regard to the placement,
of the standipie 3n Turkey Hill and whether or not he
would approve it.
At the joint meeting held in Arlington last
Tuesday, the Board of selectmen of Arlington were
much in favor of placing the standpipe on this location.
A suggestion was made that the tank might be built low
and have fieldstone around the outside and that would' not
be as objectionable as a tall standpipe.
Letter was received from the Town Counsel in which

he enclosed a form of release of damages when a water

form of release would be better than the one that
was formerly used by the Water and Sewer Department.

Mr. Custance stated that he would report on this
matter next week. As far as he could see at the
present time, he felt that Mr. McIntosh might be entieled
to a rebate on Wachusett Drive but that was the only
street he might be entitled to.
Complaint was received from Vencenzio D'Angelo of
the condition of the house in which he lives located
at the corner of Ward and Ash Streets owned by Joseph
Defelice. The owner's son occupies the second floor and
Mr. D'Angelo the first floor. In this house there is but
one bathroom and the water has been shut off in the bath- Complaint,
room since Dec. 7th. Mr. Dtangelo, •his wife and four D'Angelo.
children, found it inconvenlent and therefor complained
of the odors from the outhouse which they are compelled
to use.
It was decided to refer this matter to the Health
Inspector to investigate and report next Tuesday evening.

Committees Appointed at Various Town Meetings
A joint hearing was held with the Board of Appeals on
the application of the A. O. Davis Ice Co, , Robert L. Innis
and Dougal McLennan, owners, to store 40,060 gallons of
fuel oil.
Mr, Glynn Of the Board of Appeals mead the notice
of the hearing, and the Chairman of the Board of Selectmen
called the meeting together.
Mr. Frank Goldman representedkthe petitioners as Attorney,
He Stated that the A. G. Davis Ice Co. had in mihd the
development of the whole property which is ih a business+
dis'trict, and Mr. Mitchell presented the sketch of the Icd Co.

Ice! Company desired to install these underground tanks tit)
meet the demand for fuel oil instead of teal.. The tanks,
will be installed underground and it was his uncle standing
from the State Dept. of. Safety mat there is no fire hazard
302 and that that Department does not even inspect tanks. The
tanks would be inst*lldd to meet the requirements of the
underwriters. On the sketch it was proposed to build a
fieldstone garage abutting the Town of Lexington property
with a capacity bo hold fifteen cars. The ice house and
office are proposed to be left as they are now. Adjacent
to the garage, a pump room was to be installed to pump
the oil from the underground tanks. On the front of the
lot facing Grant Street, it was proposed to build a blook
of stores. Next to the Town Hall lot, it was proposed to
build a high wooden fence to hide the view of the buildings
from the 'own property.
Inquiry was made as to whether or not there was a
siding there to get the oil from. Mr. Goldman stated that s
he thought there was a siding back of the Town Hall, and that-
Mr. Innis could get permission to, extend that about 150 tfeet
up on to his property. Mr. Innis would have to pay the
expense of -this extension.
The 'Board of Selectmen discussed the application of
A. G. Davis Ice.Co. and voted that permission be granted
to install four tanks of not more than a total capacity
of 40,000 gallons of fuel oil, and same to be installed
as shim on plan showing first sketch of development
on property of A. G. Davis Ice Co, Lexington, Mass. ,
as prepared by G. N. Mitchell, Architect and S. Myrick,
Landscape Architect, dated Jan. 19, 1932, this permit to
be granted with the understanding that all developments
be this lot of land in the future shall be carried out substant-
ially as shown on the plans numbered one, two and three a copy
of which will be kept on file in the Town Office.
Letter was received from the Town Counsel in regard
too the bill in equity brought against Joseph V. Boinay.
The Board of Appeals decided not liegrant Mr. Boinay a
permit for a roadside stand when tit recently applied
Byrn** for the same. This decision of the Board of Appeals
case, was sent to thelfarl Counsel and he now inquires whether
or not the Board desires to have him proceed to obtain
an injunction against Ir. Boinay. He Glee inquired about
any evidence that might have been found about Mr. Boinay' s
sales of ginger ale or tonic and if the police Dept. could
furnish any evidence of such sale.
Memorandum was received from the Clerk that the Police
Department had no evidence of any sales.
The Board of Appeals discussed the matter with the
Board of Selectmen and it was decided that the Town Counsel
be notified that the action against Mr. Boinay be temporarily
withdrawn, and in case Mr. Boinay attempts to open the
stand without a permit again, the Town will be forced to
take dation.
Application for the use of Cary Memorial Hall for the
Girl Scouts was referred to the Chairman.
Cary Application for the use of the hall by the American

The Supt. of Public Works was requested to get figures
on the operation cost of the Gary Memorial Hall and present
the same to the Chariman so that he might set the rate for
the use of the hall.
Letter was received from Paul M. White, Town Counsel

of the Town of Arlington, in which he enclosed a petition
signed by the Selectmen and Board of Public Works of
Arlington requesting the abatement of $913.38 with the
interest, $46.44, these amounts being the sewer betterment
assessment levied against the Town of Arlington when a Town of
sewer was constructed in Fattier Avenue., The sewer Arlington
being of no benefit to the Town of Arlington, the Board Assessment .
of Selectmen requested the Board of Assessors to abate
this amount; the Town of Arlington in turn would abandon
their suit for damages which was filed to offset the
betterment charges made agiisit them.
Mr. Gilcreast reported that he had visited Emma A.
Quimby and Ralph A. Quimby, 21 Muzzey Street, who applied
for Old Age Assistance. He stated that one daughter did,
at one tire, work for the Internal Revenue, but now is
waiting for a position. The daughter' s husband with whom they
live has an income of $40. per week, having beeneu't` twice
on his income. The daughter in Washington pays for his Quimby
$3000. insurance which he carried in the Royal Arcanum and Old Age
alto sends them some money. Mr. Quimby at one time worked Assist-
for the City of Boston, but owing to his age is unable to ante .
work. Mr. Gilcreast recommended $6.00 per week Old Age
Assistance for each person.
In regard to the application for Old Age Assistance
of Vienna P. and Charles W. Johnson, letter was received
from the Dept. of Public Welfare of Dwell in which they
stated that they aid find Mr. Johnson living in
Lowell from 19;1 to 1930. , but they felt that the
application should be investigated Very carefully. Johnson, Old

living on the funds that he had.
Upon recommendation of Mr . Gilcreast, the Board voted
to grant Old Age Assistance in the amount of $6. a week
each for Mr. and Mrs. Johnson,.
Letter was received from the Dept. of Conservation Moth
in which they approved the appointment of Osborne J. Gorman Supt.
as Moth Supt. for the year 1932.
' 'Letter was received from Patrick J. Meaty in regard
to the depldrable condition of Oak Street. He called
attention to two bad accidents which occurred there by cars
skidding on Oak Street and requested that the str"et Oak St .
be heavily sanded. He also called attentionto the
parking of cars at the Lexington Times-Minute-Man office
and to the danger of the street for that reason.
The Chairman was directed to reply to the letter.
Notice was received from the Town Counsel in which Street

Letter was received from the Ghief Engineer of the
Engineering Dept. of the Employers' Liability Assurance
Corp. in which he enclosed a copy of the accidents which Accidents,
had taken place in the Town of Lexington in the various
departments and in which they stated that the cooperation
on the part of the Town has resulted in a very good record
for the type of work carried on.

The Supt. of Public Works reported on the claim of

The Board discussed the claim and authorized the
Supt. to inform Mrs. Rauh that they declined payment of any
damages.
Letter was received from the Tarn Counsel in regard
Fottler Ave.to water pipe in Fottler Avenue. He inquired whether or
not the present pipe in Pottier Avenue was relaid when
the street was accepted and the Supt. of the Water
and Sewer Dept. was requested to get the information for
him.
The Supt. of Public Works presented an estimate Of
$200. as the cost of installing a spot light near .the
Lexington Theater to provide protection to the Polies
Spotlight, officer stationed at that point. The drivers at that paint
cannot see the officer. Suggestion was made that a temporary
hookup be made on the Theater building which would sews
the purpose rather than expending $200.
License. Fabteurization of Milk 3�ioense was. granted to the
Fair Oaks Dairy, 9 Sherman Street.
Permit was granted to the E. E. I. Co, to set and

In regard to the matter of laying a drain in Shade
Drainage Street, the Board discussed the advisability of doing this
g again, and finally decided that if it were done that it should
be made a part of the drainage recommendations to the Town
at the Annual Town Meeting and should not be done as a part
of the Highway Maintenance.
The Board discussed the Reed Street drainageepind •
felt that this drainage work should be done next year as a part
of the drainage program.
Letter was received from the Supt., of the Water and
Pitometer Sewer Dept. in which he recommended the purchase of a
Pitometer for the WatePDBept*and enclosed a circular
explaining the same.
Letter was received from the Planning Board in which

Letter was received from the Town Engineer in which

The Board discussed generally what work they prdposed
to do on the highways next pear. Mr. Custance Balled
attention to the fact that in Woburn Street there should
be installed a sewer before any reconstruction work is
done. A sewer joh would cost about two or three thousand Highway
dollars. He felt that Woburn Street could go until that work.
Aesdone. It was proposed to finish Allen Street at a
cost of about .$2000. including damages.
The Board discussed whether or not they would make
any transfer from the Water Dept. Available Surplus to
the Maturing Debt, and it was voted tuft to make any transfer

The Board discussed whether or not they would keep
a record of the committees appoint at the various Town
Meetings in the Town Report. The Town By-law states
that the Committees should report at a Town Meeting or
automatically cease td function.
