DECEMBER 29, 1931
A regular meeting of the Board of Selectmen was. held
In the Selectments Room, `sown Office Building at 7:30 P.M.
Messrs. Trask, Blake, Shannon, Custance and Gilcreast were
present. The Supt. of Public 'Works and the Clerk were also
present. `
It was voted to approve the following licenses for
the transportation of garbage subject to the approval of
the Health Inspector:

Carroll Bros., Allen Street, Lexington
Frank Reynolds, south Rd., Bedford
Chester A. Fogg, Woburn St., Lexington

Garbage
Licenses.
At 8 P.M. hearing was declared open on the application
of Ernest r. MacPhee for permission to ma'ntain a one car MacPhee
wooden garage at the premises on lot #35 Vaille Avenue. garage
Mr. MacPhee appeared before the Board. hearing.
No persons appeared to object and it was voted to
grant the license.
The Town having voted at the annual Town Meeting to Audit.
authorize.the Selectmen to have an audit of the 1931
accounts, the Board decided to notify the Dept. of Corporations
and Taxation that they desire to have an audit of the acoounts
made.
The Supt. of Public ?Works, on request of the Chairman,
presented an amendment to the Traffic Regulations to cover
the traffic conditions at Bow -Street.
The Board voted to adopt the following amendment to
the Traffic Regulations:

No parking on the west side from the Boston & Maine
Railroad to Massachusetts Avenue.
Notice was received from the County Commissioners giving
the amount of the assessment against the Town of Lexington Assessment
for the ididdlesex County Tuberculosis Hospital as $38,658.18.
Notice was received from the State Forester stating
that the Town of Lexington would be requested to expend

$5000.,tbis year under Chapter 133, section 14 of the
General Laws.

Supt, of Public Works reported that Mrs. Martha L.
Rauh, 46 Farmcrest Avenue, reported that on or about the
11th of December when walking along the east side of
Muzzey Street opposite #26, She stepped into a hole
in the sidewalk, caught her foot which threw her to the
ground causing damage to her clothing, tearing her dress,
silk stockings, gloves and broke her umbrella. She also

cut her knee badly, causing expense for bandage. The
total damage she reports as $22.75.
Mr. Scamma.n stated that he investigated the place and
found a piece of tar broken out of the old tar sidewalk
about eight inches long and four inches wide and one inch
deep which would have caused her to trip.
It was decided to refer the ri.atter to Mr. Seamman
of settling the damage.
The Supt. of Public Works recommended the purchase

authorized the Supt. of Public Works to purchase the same.
Tapping The Supt. of Public Works also recommended the
machine purchase of a taping machine for the water department
at a net cost of 1145.
The Board authorized him to rake this purchase.
Mr. Gilcreast reported having visited Mrs. Vienna F.
Johnson and Mr. Charles Wesley Johnson of 406 Concord
Avenue, Lexington, both being over seventy years of age
Johnson, and having applied for Old .age Assistance. They have
old Age lived here for one ,year with their son, Curtis W. Johnson,
lssistance. at that address.
Mr. Gilcreast felt that the father and mother were
a different type of people than the son. the father was
at one time a contractor, but has been unable to get any
work.
It was decided to lay these two applications on the
table for the present.
Petition was received from the A. G. Davis Ice Co.
Fuel Oil for permission to install undergrolzid tanks fn the capacity
of 40,000 gallons of fuel oil on the premises at 3 Grant
Street. '
The Board decided to hold a hearing on this application
three weeks from this evening.
Estimated cost of constructing Hunt Road from Mass.
Ave., to Slocum Road was Aiven in the amount of $1500.

Mr. Custance requested that a petition be drawn up

for the two owners of the land abutting on this street to
sign.
The application of Annie Dare, notification of which

Attention was called to the hearings to be held on
Wednesday evening on Burlington Street at 7:45 and East

The Board voted to notify the Town Counsel that they
would abate the following commitments against the 'Town of

Mr. Neil McIntosh came before the Board to discuss
the guarantys charged to him in various parts of the town.
Mr, Albert A. Ross, Supt. of the eater And r Dept.,
also came before the Board, to discuss the matter.
Mr. McIntosh could not understand the difference in
price for the various jobs. Mr. boss explained to him that
the different jobs were done at different times of the
year. When a job was done in November, it naturally cost
more money as the ground is harder and the digging costs

more. He also explained to him that if a job is

done by hand labor it makes a difference in the cost. Mr.

Ross explained to Mr. McIntosh that he was allowed credit
in every case where a ten inch main was put in and was
only charged for the cost of installing six inch mains.
Mr. McIntosh called attention to the fact that the trench
would be wider for a ten inch pipe thereby making an
additional cost. Mr. McIntosh requested the Board to give
this matter consideration inasmuch as he felt he was
entitled to a discount for the charges made. He also
called attention to the fact that he felt one of the bonds
on Wachusdtt Drive was changed after it was signed in that
the number` of feet requested was increased.
It was decided to lay this matter on the table for
one week.

Property
Mr. Ross reported to the Board that a fire occurred
in and of the Town trucks. He presented an estimate of
Mr. Barry, the mechanic in the department, of $135.214.
and one from Calvin W. Childs of 209.50.
The Board decided to leave the matter of settlement
of the claim on the fire to Mr. Sca'mman.
Mr. Custance reported the following figures as his
estimate on the damage to Eugene Buckley on account of
the layout by the Board of Survey over a street on the
Quinn property:

The Board discussed the matter at length, add discussed
whether or not they would be liable for any damages for
the layout of the highway. Mr. Custance felt that Mr.
Quinn was entitled to consideration inasmuch as he has been
held up for several years pending the decision of the
Board of Survey on a layout. Some of the members of the
Board felt that this new layout was an improvement to
Mr. Quinn's property. They also felt that unless the entire
project of having the street cross over to Hancock Street
was laid out that this section would be of little value for
the expenditure that would have to be made.

The Chairman felt that the total cost probably would
be about 435000 for the entire project and he did not feel
' the Town would be justified in spending; that amount of money
for a by pass.
Mr. Custance was requested to bring in some figures
on the estimate of what the total cost of the job from
Hancock Street to Woburn Street wo,Lld be, and he stated that
he would do so.
The Supt, of Public Work's attention was called to
the fact that some time ago he stated that the State
Dept. of Public Norks agreed to trim the trees at North
Lexington on Bedford Street and the work has not been done
as ,yet. The Supt. was requested to check up with Mr. Sabin
to see when this would be done.
Mr. Custance called attention to the fact that
the Supt. of Public "forks notified the Supt. of the
Highway Dept. that the pay of all. men would be reduced in
the highway department to the same amount. He called attention
to the fact that the schedule adopted,at a previous meeting,
showed a difference in the rate of piny and he felt that these
men should be notified of the reduction in pay and also of the
half time work which will be allowed the first of the year
to the regular employees.
The meeting adjourned at 11 P.M.
