JANUARY 13,1931
Board regular meeting of the of Selectmen was
held at the Selectmen's Room, Town Office Building at 7 :30
P.M. Messrs . Burnham, Custance, Trask, Blake and Shannon
were present The Supt. of Public Works and the Clerk
were also present .
Letter was received from Mr Kendall of the County
Commissioners calling attention to the fact that when
appraisals are made of animals destroyed by dogs , if the
Appraisers amount exceeds $20, the Chairman Of the Selectmen shall
re damage act as one appraiser, the seconri shall be chosen by the
by dogs . party to whom the dama;e has been done and the third
shall be chosen by both of these parties .
Commitment of sewer rental charges for the second
Commitment . section of the Town in the amount of $1403.87 was signed by
the Board.
Alcohol license for John C ?helps , Paul Revere
Garage, was signed by the Board, the license expiring
April 1st, 1931, for the year 1931.
First class agents license was granted to Calvin
Agents Childs , 409 Mass . Avenue, granting privilege fdr a
License. Ford Agency.
Mr. Custance and Mr. Trask presented a rough draft
of the Selectmen's Report which they had prepared and
Selectmen's read to the meetng. The Bou rd discussed the report
Report . and approved it with certain changes .
Letter was received from Mr. Wri_ghtington re-
garding the letter of the Bo:trd relative to the
O'Connell O'Connell case. He stated that while he continued
case. to have charge of the case , he would take the
necessary time and proper preparation to proceed
with the case with due regard to its importance.
Letter was received from Mrs . E. King, corner
of Reed and Ash Streets, in which she stated that she
could not _rive the names of the persons owning the
Dogs dogs in her neighborhood .
The Board replied that if this information could
not be furnished that the only thins she could do was
to find oAt the names of the owners of the dogs and
sum.. o-^ them to Court for mai_ntainifg a nuisance.
Notice was received from the State Department
of Public 'corks calling attention to the fact that
many stores are selling alcohol without a license and
suggested that the Police Dept. check up as to the
persons who are selling denatured alcohol without a
license.

II" Letter was received from the Supt. of Public Works
in which he called attention to the condition existing
on Forest Street and. Muzzey Street , which should be
corrected hefoee an accident occurs on account of the parking
of automobiles in front of the Christian Science Church.
It was decided, before making any regulations to Parking

Letter was received from Mr Felix Viano in which

Letter was received from Roy W IIutchins,
Consulting Eneineer of Malden in which he enclosed maps
which could he made for the Town of Lox n •ten, showing
the historical places in the Town and giving the prices Maps
of same. showing
The Board decided to acknowledge rec ipt of the historical
letter and to find out whether the Historical Society places .
might he interested in the maps .
Letter was received from the Somerville Printing
Company in which they quoted the price of $2 . 50 per page prices
for printing^ the asse sed values of the 'town for the r
Town Report They also state teat for the price of 41.00 Some.
per page, they would furnish 1000 copies of the individual Printing
report separately hoind , based on the previous assessed
values printed, the price would -Lmount to approximately Co. re
$228.00. /Report .
Letter was received from kr W. Jr. Ballard in f Negotiatior
wuich he acknowledTed receipt of the vote; of authorization Scott

Company.
Mr. Ballard stated t at in assisting Mr. Wrightington
to find a real estate owner who was willing to testify O'Connell
in the O'Connell case , tai ± he might Interest Mr. Case.

Letter was received from the Town Counsel in which
he stated that the Chief Justice of the Supreme Court
had sent him a cony of the letter written to Mr Owen

denying the motion of re-argument in the case of
Ryder vs . Burnham.
Request for Letter was received from Mr. Lyrus M. Dolbear
flags. 28 Wave Ave., Wakefield asking for the us'e of the flags
which the Town owns for a Ladies' Night for the Masonic
Lodge.
The Board decided to inform him that the flags
were a gift to the Town and that it was not thq custom
to loan the flags for alfairs of this kind.
Letter was received from the Mayors Club of
Notice of Boston in which they i_iformed the Board of a hearing
hearing. to be held at the Hotel Manger, January 15, 1931 at
2 P.M.
In regard to the acceptance of Dexter Road
it was found that the Town Engineer could not secure
the information for some time to come and inasmuch as
the plan has not been made, it was decided that it
might be more rea:.onable to purchase the plan from the
Dexter Enginee-s who made the plans for the Lexington Building
Road. Trust land, than have t: e Engineering Dept. endeavor
to get this information.
Mr. T. A. Custance agreed to handle the matter.
The Board, therefore, did not sign the intention' to
layout Dexter Road from Fuller Road to Williams Road.
Letter was received by the Board of A.;sessors from
Mr. Creelman, Tax Commissioners Office, in which he
stated that the tax on the Middlesex & in
Street
Railway Co. property could only be apportioned or
transfered from the Reserve Fund.
M. & B. It was therefore decided to request the Aprrop-
Tax. riation Committee to make a transfer to care for this tax
of $380.80, from the Reserve Fund.
Traffic Nothing was done about the adoption of new
Regulations. traffic regulations.
The Board discussed the editorial written in
the Lexington Times Minute Man regarding Coolidge
Avenue, in which it was stated that Coolidge Ave.
Coolidge cnnstruction work cost $10.00 per foot.
Avenue. It was decided to have the Lex. Times Minute Man
print a facsimile copy showing that all of the om ers
of the property signed for the estimated assessment.
It was left with Mr. Custance to see that the
Editor printed this facsimile.
Mr. Custance presented suggestions for a sign
for the Dept. of Public Works located at North Lexington,
on which will be printed "The Department of Public works,
Lexington, Massachusetts."

Mr. Custance reported communication with land
owners at North Lexi.nFton and the plan as presented at
the meeting appelred to please them.
The Board discussed the matter of snow plow service
to the Boston & Maine Depot yard, inasmuch as M-. A. B. Tenney
communicated with tne office and called attention to the
fact that the sidewalks and drives were not cared for.

therefore , to have the sidewalks and drives sanded and depot yard.

The Clerk reported the case of Mary Yodwish who
lives in the house owned by ' rs. Bornstein at the corner
of Mass . Avenue and Hibbert Street, and enquired if the
Board would approve payin rent in this case.
From infrmation the Cle-k obtained, this woman had
been arrested in Lexinton and was found duiltv in the
Concord Court of keeping and exposin intoxicating liquor
for sale.
The family were also arrested five times in os ton
for the same offense. The Board informed the Clerk that
they would approve doing whatever was decided pest in this
case .
Mr. R. L. 'Arcier came before the Board and stated
that he had paid all of his prope-ty t , es on the property
on L ncoln Street known as the Aldrich property, ,-ut he
had not paid the sewer tax. His brother , C. W . Ryder received
the bill for the sewer tax, althox7h all tax bills have always
been sent to him for all of the nyder property. e put the
bill in his pocket and not realizing that he should make a
request for apportionment of the tax, he forgot about it until
the bill for the property was received, with the entire amount
of the tax the-eon.
Upon aoulication, he ound tha,. it was too late to Ryder
have it apportioned: Mr. Earle insists upon having the money Sewer
Paid to pay up his commitment for 1929. tax.
He stated that he went in to see M-. Creelman in tie
Tax Commissioners o fice and Mr. Crellman informed, him that
it was his duty to interpret the tax laws for the Town, art
that if the Selectmen desired, they could accept a bond that
wolld protect them if they desired to cancel and reapportion
the sewer tax. The entire tax with interest amounted to
$1307.04.
The Board decided to request Mr. Ryder to retire until
1 they discussed the matter, and after discussing it voted
to accept a guaranty bond provided the matter is taken
up with the Town Counsel and he agrees that it can be done.
The Board discussed the matter of the construction of
Hill Street and decided that the work should be completed Hill St.
on this street if possible this year.

A report was received from Mr. Harold B. Lamont, 0
Chairman of the Tercentenary Committee, and was accepted
by tle Board. In retard to tl e report to be printed in
Tercent- the Town Rep -t on the Tercentenary, it was decided to
enary request Mr Lamont to make a more compact report.

In regard to the report of the Supt . of Parks,
it was decided that rr. Shannon should go over the report
Park Dept . with the Sapt. of Parks and suggest changes .

The following is the weekly report of the Supt.
of Public Works .
For the week ending January 10, 1931.
HIGHWAY DEPARTMENT
It was necessary to use consid -rable sand on
streets and sidewalks during the oast week.
Work was continued on the widening of Hill Street
considerable gravel and stone being place in low places
where it will do for base course.
A number of catch basins were cleaned and brush
was cut out in several bad places .
Also, some work was done at the Public Works Bldg.
Next week the work on Hill Street will be con-
tinued, regula" maintenance attended to and any necessary
snow removal work will be done .
MOTH & SHADE TREE DEPT.
The treatment of the gypsy moth nests with creosote
was continued through the past week and will occupy
the department next week.
PARK DEPARTMENT
The regular maintenance work was carried on during
the past week and will be attended to next week.
WATER & SEWER DEPARTMENT
Water Maintenance
Installed water service for Brown and Ester on
Bertwell Road. We started today, January 13th overhauling
hydrants .
Water Construction
We have completed the new Wood Street water mains
and have laid 4400 feet of 10" pipe, and 2477 feet of 8"
pipe . Thirteen (13) hydrants have been installed on this
line.
I hr(ve estimated that it will require 23,870
gallons of water to fill this line and the water will
be turned on some night in the very near future.
Regular maintenance work is planned for next
week.
