HomeMy WebLinkAbout1930-10-21318 SELECTMENIS MEETING OCTOBER 21, 1930. A regular meeting of the Board of Selectmen was held at the Selectmen's Room, Town Office Building, at 7;30 P.M. Messrs. Burnham, Custance, Blake, Shannon and Trask were present. The Supt. of Public Works and the Clerk were also present. Warrant The Board signed the Warrant for the State Election. signed. to be held November 4, 1930. At 8 P.M. bids were received on the $50,000 Water Loan for the extension of water.mains, to be issued In fifty coupon notes of $1000 each dated November Bids on 19 1930 and payable $5000 yearly, 1931 to 1940 Water Loan. inclusive at the rate of 41. The bids were as follows Harris Forbes Co. 101.57 Estabrook & Co. 101.34 First Nat. Old Colony Corp. 101.63 Lexington Trust Co. 101.41 The bid was awarded to the First Nat. Old Colony Corp. Letter was received from Mr. Thomas S. Grindle, Supt. of Schools, in which he stated that the School Committee had received a letter from parents of children asking for police protection for their children Request when crossing the street at Fletcher Avenue and for Woburn Street and Mass. Avenue going to the Munroe Police School. Protection. It was decided to refer the letter to the Chief of Police with a request that he inform the Board whether or not he felt police protection was necessary at this point and whether he could control the same by police officers. Mr. William P. Herbert came before the Board and presented a petition in whihh he asked -that an Request a-tiele be inserted in the Town Warrant asking for change that the section at the corner of Mass. Ave. and, in Marrett Road near the Lincoln Line by changed to a district. business district. Mr. Herbert was informed that he would have to communicate with the Planning Boarrd, inasmuch as they were the Board that should report on his location before any action.could be taken at Town Meeting. . Letter was received from Edward J. Gavin who owns the property on Mass. Avenue near the junction of Marrett Road, asking that he be awarded $2000 E.J.Gavin damages on account of the construction.of the new re land highway. He stated that he had not been aware that damages. 1 the street was to be reconstructed and he'felt that ' the land taken and the fact that the street was built higher thah it originally was.bmeking his land low, entitled him to the sum of $2000 damages. Letter was received from the Town Counsel in which he called attention to the violation of the Zoning Law by Pasquale Morretti on Bow Street, wherein Mr. Morretti had built a two family house in a one family district, and asked what action the Board desired to have him take regarding the enforcement of the Zoningg Law. The Board.decided to inform Mr. Wrightington that they would not proceed to:enforee the Zoning Law as far as prohibiting the use of the house entirely, but they felt that he should proceed to prohibit him from using the house for more then one family. In regard to the letter of the Town Counsel regarding collecting costs in the Bean -Perkins case, the Board decided to request the Town 'Counsel to proceed to collect the costs in this case. Letter was received from Mr. Edwin B. Worthen in which he stated that he had been offered a gift of a picture of Francis Hayes Sr. and asked avhather or not the Selectmen desired to have it for any of the town public buildings, or if not, if Mr. Blake desired to accept the gift. The Board infonned Mr. Worthen that they would have to decline the gift with thanks inasmuch as they did not have any place in which they could put the picture. Mr. Blake declined also inasmuch as he already has a picture of Mr. Hayes. 319 Violation of Zoning Law, Morretti Bean -Perkin: Case. E.B.Worthen re Hayes picture. Letter was, received from the Volunteers of America in which they requested permission to have a Tag Day in November or December in Lexington. Tag Day. The Board'voted not to grant them permission to have the Tag Day. The vote of the Planning Board relative to Oakland Street extension was before the Board. in this connection, Mr. Custance reported that he was having further studies made of the extension of Oakland Street to Grant Street by the Town Engineer. and until these studies were made, he requested that no action be taken on advertising the Board of Survey hearing. ' The Supt. of Public Vvorks placed before the Board a cut of the proposed Police light which he felt could be erected at the entrance to the Police Station from Mass. Avenue. Ite reported that the light would probably cost about $100 to have it installed by Mr. Bills and the dig?ing of the trench could be done by the Highway employees. Dakland St. Extension. Police light. 20 Order of Board of Health. Meeting with Vine Brook Drainage Com. Scientific Valuation. The matter was referred to the Sixpt. of Public Works to attend to. Mr. Ruseell4lo Prentiss 'Leonard Je3lis and Dr. James J.- Walsh came before.:the Board. ,:relAtive. to the caserof Tetanus.and cerebro spinal meningitis that was reported in Santino Casell0l,. Dr. Walsh reported that he was called on Friday evening to the boy and he determined the case as one of Tetanus and removed the boy to the Dass. Homeopathic Hospital, and on Sunday he passed away with a diagnosis by the Mass. Homeopathic Hospital of cerebro spinal meningitis their diaga osis being made by the fluid laboratory examination. Mr. Jellis who lives near the family, was rather alarmed on account of the possible spread of the disease. It was found that the boy had stepped on a nail in the vicinity of his home and ransed 'the injury to his foot which eventually caused his death. Mr. Prentiss reported that the neighborhood was covered with old tin cans, broken bottles, parts of automobiles, wherein several of the children of the neighborhood might also become infected by cuts, there being a general spread of the disease which is fatal. The Board considered the evidence submitted to them and acting as a Board of Health, under authority of General Laws, Chapter 111, Section 122, and subsequent sections determined that there exists a nuisance, source of filth and cause of sickness, as found on the premises owned or occupied by Aargaret J. Fleming, Warid St., Nelson J. Fleming, Earle.St., William H. Travers, Earle St., John H. Sippel, Wells Beach, Maine, Everett uvilson, 48 Willett St., Albany, New York, Patrick H. Ryan, 31 Richardson St., Somerville and Frank Canisius, Erle Street, and the Board orders the said nuisance, cause of sickness and source of filth to be .removed by the owner or occupant of said premises within one week of the date of receipt by said owner or occupant of the notice of said order, and they direct that notice of said order be given to the said owner or occupant in accordance with General Laws, Chap- ter 111, Section 122 and subsequent sections. Only the signatures of three members of the Board were obtained on the orders to be served inasmuch as only three'of the members were available on Oct. 231, 1930. Letter was -received from the Vine Brook drainage committee requesting the Selectmen to meet with them on October 22, 1930 at 8 P.M., It was iggreed. that all of the members would be present. Letter was received from the Lloyd Thomas Co. 220 Broadway, New York, in which they called attention to a statement of the Tax Commissioner of Massachusetts in which he comrented on the scientific valuation.of property. The Board decided to write a letter to the Lloyd Thomas Co. asking them to give us a figure on '77 D 1 321 1 a scientific valuation of the Town of Lexington provided the Town would be under no obligation. alcohol license was signed for Mr. A. ' At 8:30 P.M., kr. John Devine came before the Board to discuss with the Board the matter of establishing a building line in connection with the building line and relocation intended to be established in front o€ the O'Connell and Hunt properties. Mr. Devine has had considerable experience in cases of this kind, and he carne before the Board to give John Devine them the benefit of his experience informally. re Building. The Town Counsel, S. R. Wrightington was also line. present. The proper method of proceO-ure to establish the building line was considered. As to whether an appropriation whould be made in connection with the establishing of a building line, there appeared to be a difference of opinion, and the Town Counsel was requested to take the matter un with Mr. Waddell, Director of Accounts, State House, to find out if an-apnropriation should be made and if so, the Board would then have to determine how much they would have to appropriate. After Mr. Devine retired, the Board discussed the procedure they felt should be taken at the next Town Meeting regarding the building line and decided to establish a building line through the O'Connell and Hunt properties and to make a relocation of the highway in front of the O'Connell property t` only. It was decided to draw a warrant -on Tuesday 1 evening for a Town Meeting. Letter was received from Russell I. Prentiss stating that the garbage tmRwk owned by John N. Connors in which he was collecting the Town's garbage under 322 contract, was leaking and he encolsed a copy of the letter sent to Mr. Connors regarding thes ame. Another letter was received from Mr. Prentiss in which he complained that Mr. Connors was not Complaint carrying out his contract inasmuch as he was not garbage collecting the garbage twice a week in the�Town. collections. Mr. Custance reported that he had seen Mr. Connors and Mr. Connors informed him that many of the houses in the Town were not included on the'liet' he received from the Supt. of Public Works, and that was why the collections had not been made. The Supt. of Public Works stated that since presenting Mr. Connors with this list, he had informed him that he should collect garbage twice a week. It was decided to call Mr. Connor -,Ad attention to the letter of the Health Inspector, and ask that he correct the leaking of the garbage truck and cover the same as required by the Board of Health Regulations. Bids were received on the work to be done on the Public '4orks Dept. Building as set forth in the specifications of the Supt. of Public Works, relative to einucour walls, concrete flooring and,conerete ramps. The bids were as follows: Walter G. Reservations and Parks in the Dept. of Conservation." was received.. Mr. Burnham agreed to attend the hearing. Notice of hearing, State House. For'the week ending October 18, 1930. fl HIGHWAY DEPT. Construction work in Fottler Avenue and Taft Avenue will be completed soon. The department removed three jarge trees in t0u� est Ave. Cleaned gutters and catch basins and attended to other maintenance work. Next weak work will be done in Taft Avenue and the regular maintenance work will be continued. MOTH & SHADE TREE DEPT. The department is continuing the work of treating the moth nests with creosote. PARK DEPARTMENT This department is attending to the regular maintenance. WATER & SEWER DEPT. Water Construction Approximately 30OF of 6" pipe has been laid in Taft Ave. Water Maintenance A water service has been installed for'Remick, Spring St. Fire men have been working on water main at car barn property. Regular maintenance work planned for next week. Sewer Maintenance A sewer service has been installed for Wood, Bloomfield Street. Sewers were flushed in various streets of the Town. ENGINEERING DEPARTMENT Highways Refigured betterment assessments from new transfers on York Street. Sewers Started record plans on Mass. Ave. from 323 324 Fottler Avenue to Bowker Street and for part of Bowker Street. Completed_ Cliffe Avenue, Theresa Ave.. and , Hillcrest Ave. record plans and assessments. Miscellaneous Completed location of houses on Bartlett Ave. and. Lowell Street. Located houses in Colonial Hei7hts develop- ment off Wood Street. Assistance to Plater Dept. in preparing plan of town water mains. Completed survey of Bashian property on Mass. Ave. &.Marrett Road. Plotting 40 scale plan of Lincoln Street(entire).
