SELECTMEN'S MEWING
JULY 22, 1930. 1
A regular meeting was held at the Selectmen's Room,
Town Office Building, at 7:30 P.M. Messrs. Burnham,
Custance, Shannon, and Blake were present. The Supt .
of Public Works, the Town Counsel, Sydney R. Wrightington,
and the Clerk Pro-tem were also present.
Wadman Letter was received from the Town Counsel in
Innholder's answer to our letter to him asking his opinion as to
license. whether the Board of Selectmen, or the Board of Appeals
could grant to Mr. Wesley T. Wadman, 23 Hancock Street,
an Innholderis License, to do business at that address.
He advised that Mr. Wadman petition the Board of
Appeals to vary the application of the ZoningBlaw
under Section 9 to penult him to obtain an Innholder's
License, and it was decided to notify Mr. Wadman to
that effect.
Brophy A summons was received by the Inhabitants of the
accident. Town of Lexington to appear at the Second District
Court of Eastern Middlesex at Waltham on Saturday,
August 30, 1930 in the case of Charles Brophy who had an
accident on Waltham Street and Concord Avenue. A
claim has been made in the amount of $5,000. , and the
Board felt that this matter should be turned over to the
Town Counsel.
Garvin The Town Counsel. brought up the matter of Mrs. Mary E.
case. Garvin's Innholder's License, which was granted to her
and then revoked because of the fact that the Cary
House where she desired to do business was in an R-1
District. Her attorney asked Mr. Wrightington for
information on the case, and he desired to get permission
from the Board so that he could give out whatever
information he thought best.
Phelps At 8 P.M. hearing was declared open upon the
garage. application of. John C. Phelps to erect a two car garage
on his premises at 42 Percy Road.
The Building Inspector was present at the hearing,
as was Mr Phelps.
Mr. Phelps already has a two car garage on his lot
and desires to build another to correspond with the
pr esent corm.
Question arose as to whether he could receive a
permit for storage of two more cars under the Zoning
Law, and upon perusing same, it was decided that another
garage could be built.
It was therefor decided to grant Mr. Phelps a license.

The Building Inspector presented a letter Heaney
relative to garage partly remodelled by John F. garage.
Heaney, 47 Chase Avenue. This man moved an old
building and partly remodelled it without a
permit from the Building Inspector, and upon
receiving a notice from Mr. Tibbetts to abstain
from finishing same and restore it to its original
state, Mr. Heaney left the building about ten feet
from his line and as a result it is a source of
annoyance to the next neighbor.
The Town Counsel stated that the next step
would be to file a bill in equity to enjoin
Mr. Heaney from using the building, and he desired
to take the information regarding this building
and study the matter.
Mr. Case of the Engineering Department, and Insurance
Mr. Murphy of the Claim Department, Employed r conference.
Liability Assurance Corp. , together with Mr.
Albert A. Rees of the Water and Sewer Dept. came
before the Board to discuss with them the matter of
Wolskmen's compensation insurance, as for several
years the accidents have been great and somewhat
expensive for the company.
Mr. Case stated that if he could sell to the
foremen and workmen the idea of safety he felt
that it would help to some extent. He cited a case
IIin Fall River where he had several times talked to
the workers, and the employees went for over three
hundred days without an accident by using what he
called a safety sheet. Every accident Was reporded
on this sheet against the man's name, and it was a
source of interest and pride to keep the number of
accidents down to the .minimum. He also said that
experienced and younger men would be more satisfac-
tory as the risk of permanent disability is a great
deal less than in older men. He suggested that
a thorough examination be given to men hired, and
that a systematic examination of tools and equipment
should be made about every two weeks. He also
stressed the fact that every minor accident should
be reported.
Mr. Murphy informed the Board that whenever
possible they would like to have the patients appear
at their clinic where they can be given special
attention and. care.
The representatives. were asked to put their
recommendations. in. writing.
The Board authorized Mr. Ross to extend the , Extension
water main 200 feet in Tucker Avenue to take care of Water

water main in East _Street., these extensions to be
subject to the usual guarantee.

7.13Mr. Ross brought up the fact that more money
Mass. Ave. is needed to complete the installation of the 12
main. water main in Mass. Avenue. It will take about
$2700. to complete the 900 feet to Child's Garage
in order to connect on to the 12" main in Masa.
Avenue already installed, and about $3000. to
complete the section where the trefoh is now open.
The Board authorized Mr. Ross to continue the
water main to Child's Garage as they considered
it to be an emergency measure, owing to the fact
that if the connection is not made to the 12" main
already there, the pressure will not be improved
at all.
Letter was received from the Sopt. of Public
Works in which he stated that Wallace Weisinger had
Kidder dog. struck a dog owned by Edwin C. Kidder, North
Hancock Street, on Oct. 28, 1929. Mr. Weisinger
could not have avoided hitting the dog as he rushed
out on to the road 3n the path of the truck,
although Mr. Weisinger turned out. Mr. Alexander
Quinn was a witness to the accident, and the Board
felt that the Town Counsel should take this matter
tag, as Mr. Weisinger was and is employed by the
Town, and he had been summoned to Court.
Water test. Letter was received from the Chief of the Fire
Dept. in which he enclosed a report of the test *ado
rectot],y of the equipment of the Fire Dept.

to hale the report published in the Lexington Times,

It was voted to authorize the Town Accountant
to issue notes for $120,000. at 4% for ten years on

the Allen Street Grade School, letter and schedule School
having been received from Mr. James Stuart Smith relative House.
to same.
Letter was received from the Town Engineer
relative to granolithic sidewalks. This letter- was
written in reply to the request of the Board for a
report on the sidewalk of George W. Emery, 42
Somerset Road.
Mr. Emery stated that the new sidewalk is too
low, as the center of the street is higher than
the sidewalk and his lawn is highter in one place
than the sidewalk. Mr. Cosgrove stated that if the
correct grade had been used by Mr. Emery when he
built the house that his lawn would correspond with
the sidewalk,and he also stated that at no- place was
the sidewalk low enough to allow the gutter to drain
on to the sidewalk even if the turf strip were cut
away.
The Board desired to meet at the property and
view the sidewalk, a d a meeting was decided upon far

Resignation was received to dale from July
1, 1930 from Bartholomew D. Callahan, Regisnation,
8 Fletcher Avenue, from the Board of Registrars, which Callahan .
was accepted, ghd the name of David F. Murphy was
offered to fill the vacapcy until the expiration
of Mr. Callahants term, ma -ch 31, 1931.
The Supt. of Public Works was authorized to Street
install 2 street lights on Coolidge Avenue. lights.
Miss Jewett who had an accident on Pleasant
Street., again called Mr. Burnham in regard to same, Jewett
stating that she was not entirely satisfied with the accident.

liable for any damages to her car as the signs were
posted stating that the road was closed.
The Hoard still feels that they must stand by
their decision, and Miss Jewett was notified to
that effect.

It was d'cided to refer these bids to Mr.
Edward W. Taylor for his recommendation on the

Mr. Custance presented a bill received by
Ready Mrs. Catherine Ready for work done in repairing ceiling
Ceiling. broken by blasting by the Water Department. Mr.
Custance reported that Mrs. Ready would Agree to the
Town paying half of the bill which would be 20x00,
and it was decided to pay this amount out of the
Water Department appropriation.

The matter of having garbage collected by
contract in the town was discussed, and it was felt
that the Supt. of Public °orks should write to Garbage
contractors in regard to this matter, and it might contract.

Mr. Blake reported that a Mr. Mason on Woodland Mason
Road keeps quite a few dogs and they are becoming a dogs.

Mr. Sydney R. Wrightington, presented agreements
from Daniel J. O 'Connell to the Town of Lexington O 'Connell
which he had had drawn for Mr. O 'Connell to examine. matter.
As he will be away for practically the w ole Mass. Ave.
month of August, Mr. b°drightinpton stated that
noting could be done until he returned, One
agreement was made out in case the Town laid
dowti a building line. These agreements would bind
Mr. O 'Connell to abide by the decision of the
` oard of Arbitrators as to what they would award to
Mr. O 'Connell as damages, and they would not bind the
Town in any way.
Mr. Custance suggested that a hearing be held
whe Mr. O 'Connell arrives home on establishing a build-
ing and laying out a street, both hearings to be
hel on the same evening, then have the Board of
Arbitrators make an award of damages, •!hen present
it bo the Town at a Town Meeting to be voted upon.
It was decided to lay the matter over until
next week at which time Mr. Wrightington will be
present.
It was also decided to invite Mr. Gleason to be
present at the next meeting.

HIGHWAY DEPARTMENT
Spring Street was patched, gutters cleaned and
street cleaned up .
Gravel applied and leveled at the corner of
Lincoln St. , and Marrett Road.
Cleaned gutters and sidewalk on Hillside. Terrace.
Surface patches were made on Waltham Street,
Eustis St. , Lowell Street and Prospect Hill Road.
Gutters were cleaned in various streets and other
maintenance work attended to.
Next week the department will work on the
eon truction of recently accepted streets and the
re lar maintenance.

MOTH & SHADE TREE DEPT. l7
Trees were trimmed in Hastings Park, Hastings
Road and Mass. Avenue.
Next week the department will carry on the work
of trimming the trees and cutting out brush at various
locations.
PARK DFP ARTMEN T
Spreading loam and grading at Hastings Park and
regular maintenance.
Next week the department will take care of the
regular maintenance.
WATER & SEWER DEPARTMENT
Water Construction
We have laid approximately 7101 of 16" pipe in
Mass. Avenue from the Arlington line to Bow Street.
A 16" gate has been inserted at the Arlington line.
A 12" branch has been laid into Mass. Avenue off the
16" main at Bow Street.
We have unloaded two carloads of pipe.
Six men worked one afternoon at the carbarn
property cleaning up.
The work contemplated for the week ending August 2nd
is as follows : continuation of the Mass. Ave. job,
water and sewer services, etc.
