HomeMy WebLinkAbout1930-06-17Woe SELECT IS MEETING. June 17,.1930. The regular meeting of the Board of Selectmen was held at the Selectmen's Room, Town Office Building, at 7:30 P.M. Messrs. Burnham, Custance, Blake, Shannon and Trask were present. The Supt. of Public Works and the Clerk were also present. Petition was received fromthe residents of Hancock Street and owners. of the property .a.djacent or near to the property owned by Patrick J. Fitzgerald of 66 Hancock Street complaining of the damage done to their gardens_and property by the cows_bel.onging to said Fitzgerald, stating that the annoyance had been of long standing. The Board informed Mr. Gilmore that they felt that this was a matter that should be taken up by his attorney, and that he could also have the assistance of the Police Department to whatever extent they eould assist. J 1 Invitation was received from the City of Medford Invitation to attend the "Pateant of the Mystic" to be given to on the Brooks Estate, West Medford, June 23, 24.25 Medford. and 30, 1930 and July 1 and 2, 1930. Mr. Custance stated that -he would probably attend, as this is part of the tercentenary celebration of the City of Medford. Letter was received from.Ralph. E. Lane in which Lane request he asked if the repair work on the concrete sidewalk for repairs that is being .done on. Mass. Avenue from the Cary Library to sidewalk. to the Glidden placd could be carried along in front of his house, inasmuch as there are depressions in this sidewalk. The Board inquired of the Supt. of Public Works if he had -sufficient funds in the Highway Department to do this works and referred the matter to him for his attention, The Supt. - of Public. Works. reported that the sidewalk is in very bad condition. Clapp The Supt. of Public Works' attention was called sidewalk. to the fact that Mr. Robert P. Clapp -:,wanted some repair work done on his sidewalk. Sidewalk The attention of the Supt. of Public Works was near Blake also called to the fact that_he_should_repair the Candy Store, sidewalk in front of Blake's__candy store filling_ it in with granolithc, inasmuch as it is now in a dangerous condition. J 1 199 ' Letter was received from the Town Counsel in which he stated thatasfar as, the Building Law of Donnelly the Town is concerned he felt that the chances of billboard. winning a bill in equity were about 25% to enjoin the maintenance of the billboard recently constructed by John Donnelly & Son. He stated that he has arranged for a hearing before the Dept. of Public Works when the application for a renewal of the permit is made. He also stated that is will be necessary for the Board to offer reasons why they do not feel that this billboard should .be located on the premises .of Mr. F, E, Viano near the corner of Bow Street and Massachusetts Avenue other than the fact that the Building Lawn prohibits billborads as _a. whole. Txe Board did not know of any reason for prohibiting the billboard other than that of appearance, and inasmuch as the Town . Counsel did .not feel that there was much chance _of_w.inning.the cas.e,_the Board did not decide to ask him to proceed _with _a bill in equity, Hearing was declared open at 8 P.M. on the appli- cation of Charles H._ Rice for. pe.rmiss.i.on..to maintain Rice garage a four car garage at.his-premises on Bedford Street. hearing. No persons appeared to object,and it was voted to grant the permit. Letter was received from Edwin B. Worthen in which_ he stated. that. he _ had suec eeded in s ecuring the did Adams hand tub which was sold some forty years Old Adams ago to the town of Brownville, Maine, and it was to hand tub, be added to the collection of historical relics. He asked for the assistance of one of the town de- partments to take it off the freight car. The Board suggested that he store it iii the Public {forks Department property oh. Bedford Street rather than on the town farm. The Board voted to revoke all the traffic re%ulations peviously adopted and to adopt the Parking re - following regulations for parking motor vehicles gulations, in the center of the town. June 17, 1930. Acting under the provisions of Chapter 40, section 22 of the General Laws all Traffic Regulations adopted by the Board of Selectmen are hereby repealed and the following orders to control the parking of ' vehicles are hereby given by the Board of Selectmen: MASSACHUSETTS AVENUE, EAST SIDE. Diagonal parking forty-five degrees from Grant Street 200 to the cross walk opposite the northerly side of Waltham Street, unlimited. Parrallel parking from opposite the northerly ' side of Waltham Street to the southerly end of Depot Park, limited to one hour, from nine A.M. to six P.M. Diagonal parking foty-five degrees from the southerly end of Depot Park to.the northerly end of Depot Park, unlimited. Diagnoal parking forty-five degrees from the north- erly end of Depot Park to Meriam Street, limited to one hour, from nine A.M. to six P.M. MASSACHUSETTS AVENUE, WEST SIDE. Parallel parking from opposite the northerly side of Grant Street to Waltham Street, unlimited. Parallel parking from Waltham Street to opposite the northerly side of Meriam Street, limited to one hour, nine A.M. to six P.M. Notice was received that an examination for police officer for the Town of Lexington will be held Examination under date of July 11, 1930. police It was decided to refer the matter to the Cheif officer. of Police for his attention. Middlesex Coy Extension Service thanking the Board Ext.Ser. for the use of the Cary Memorial Hall for their letter of annual meeting and for the greeting extended to them. thanks. Lettere-was received from the Planning Board in which they stated they would have to have the Oakland St, estimate of the cost';of extension of Oakland Street Exte before they would make their recommendation. Letter was received from Town Counsel in which he stated that he did not believe the Board could allow or grant any license for Sunday golf practice golf in the town, inasmuch as the town has not accepted practice, the provision of Chapter 406 of the Acts of 1928 which became law on initiative petition, and which substituted new sections 21-25 in communities -which accepted these new sections, but preserved intact the provisions of sections 21-28 of the General Laws in towns which did not accept the 1928 statute, and the town therefor has no right to allow permission where admission is charged directly or indirectly. 202 He also stated that under the Zoning Law he did not believe that gold practice could be permitted. Application having been received from Mr. Harry A. Burgess for permission to have golf practice on Sunday on the Marrett Gardens property on Marrett Road and on the,,Bean property on Bedford Street, Mr. Burgess appeared before the Board with his appliction. %e Board explained to him the advice given by the Town Counsel, and informed his that they did not see any way that they could approve his application for a permit for Sunday golf practice. Preston, Letter from President of the Lexington Trust Co., in which he E,G. Preston. thanked fhe Board for their cooperation in assisting the Trust Company in getting ready for their opening on June 7, 1930, H. J. Grape Common Victuallers license was granted to Harry license, J. Grape to do business on Marrett Road at the -corner of Bridge Street. Letter was received from Metcalf & Eddy in which they enclosed a bill of 4224,35 for engineering Metcalf & services in connection with the Vine Brook drainage, Eddy bill, Inasmuch as the appropriation for the engineering services was not made at the Town Meeting, it was decided to lay this matter on the table and con- sider it at a later date, and ascertain in the mean- time whether or not the appropriation committee will allow a transfer from the reserve fund, In regard to the letter of Raymond L. Nickerson Nickerson relative to fence between his property and the school re.Fence, property, the Supt. of Public Works reported that the Town Engineer did not find that the deed recorded at the Registry of Deeds had any reference to maintenance of a fence. The Board decided to refer the matter back to the Supt. of Public Works for a further report, 'Notice to It was decided to send a notice to Walter Pratt, Pratt, tenant in the property recently purchased from A.A. Marshall & Son, Inc., inasmuch as Mr. �2ustance reported that he would have bids by next Tuesday evening for the demolition of the buildings on the property. 1 1 203 ' Petition was signed by the Board directed to the County Commissioners asking for the relocation and Lincoln St, specific repairs of Lincoln Street from Mass, Ave, to petition. the Lincoln line. Surface patching was done in Edgewood Road, Eustis Street, Hancock Street and Mass. Ave, The grader was used. on Westview Street, Blossom Street, and Allen Street. The fence on Hill Street was.removed. Next week the regular maintenance work will be attended to and the surfacing of Concord Avenue started. Moth and Shade Tree Dept. Two sprayers were occupied with the spraying of trees in the streets in different ports of the Town. Inasmuch as the committee to investigate the subject of inoculating the dogs in the town recommended that all dogs in the town be inoculated,t he Board Inoculation discussed the matter and for further information of dogs, decided to inquire -of the Animal Inspector whether or not inoculation injures the dog in any way, inasmuhh as it has been reported that hunting dogs are not lively after inoculation. It was decided also to have the committee insert an article in the next warrant for a by-law on inoculation of dogs. The Supt. of Public Works was instructed to get the streets marked for parallel parking and forty- Street five degree parking in accordance with the regulation markings, adopted'by the Board. The Supt. of Public Works was also requested to Street get the strec6t signs up as soon as possible inasmuch signs, ' as the Tercentenary Committee are anxious that the Town be marked as well as possible fbr this year. Regular maintenance was carried on, construction work at the new tennis courts, painting at swimming pool; painting new pipe fence, and grading at Center Playground. Shrubs were planted on Belfry Hill. Next week the department will be occupied,'with the regular maintenance. Repaired leak in main In front of High School.. Repaired leak in main in Woburn Street which was broken by blasting of the Gas Company. Water Construction. The 10" and 12" mains in Pleasant Street from Watertown Street to Concord Avenue, Concord Avenue from Pleasant Street to Walnut Street, Walnut Street from Concord Avenue to County Hospital have been completed, and a total of approximately 57001 of 10" and 12" pipe has been laid. ' Sewer Maintenance. The following services were inst&lled: Green, 1377 Mass. Ave., and Phalen, Smith Avenue, Engineering Department. Highways. Lines and grades for curbing and granolithic walks, Bow Street lines for prop�rty owner. Three days were spent to check Winthrop Road laymt. The only existing plan of same was of same was hopelessly incorrect. Sewer. Grades for Plass. Ave. connection. Water. Completed location of water pipe and fixtures along Pleasant Street from Watertown Street to ' Concord Avenue. Sidewalks., Figured sidewalk assessments for 15 parcels and L-1 1 u recorded same at Registry June 11th. Miscellaneous. Agreed to complete information for Mr, Edwards of the Met, Planning Division; concerning the.East Street and the Summer Street Extension cut-off projects by August 1st. The subject of installina water main was discussed with Mr. Albert A. loss., Supt. of the water and Sewer Dept., and Town Engineer, John T. Cosgrove. Mr, Custance reported that Mr. Ross had Mr. Ki]ham of the Metropolitan Water Commission, come out to discuss the matter during the week, and Mr. Kilham recommended that the 16" pipe be Um talled in Mass. Avenue from the Arlington line up to the East Lexington station, rather than go over through the Star Realty Co. property. The Board after discussing the matter, decided to abandon the route proposed of the water main by Metcalf & Eddy, and to install 16" pipe from the Arlington line to East Lexington station, and to continue the 16" line to Pleasant Street at a later date, The Supt. of Public Works was instructed to order pipe for this work and to follow the finances of the Water Dept. during this construction, Ir. Custance reported that the engineering plans showing locations of water mains were not in good condition, and recommended that an engineer be placed on the Water Dept, plans alone for a term of about three months to get them in proper condition. It was voted to leave this matter with Mr. Ross and Mr. Cosgrove to work out, and recommend to the Board at the next meeting what they feel should be done. 205 Water main discussed. Water main plans. Mr, Burnham reported that one of the Selectmen of Proposed Winchester informed him that they Winchester board are Highway very anxious to have the street put through that would Winchester come through the`�,Vinning Farm property, and asked that Lexington. Lexington do v4iat they could to force the issue. The Supt. of Public Works was instructed to oil Oil Streets, the Old County Road near Allen Street and Wood Street, 20-6 Mr. Custance agreed to bring in specifications P. W. Dept. for the heating of the Public Workd Dept. property heating. on Bedford Street and secure the estimates on same for the next meeting. He exhibited a new form of heating especially devised for high studded.rooms, and recommended this type of heating for that building* the meeting adjourned at 10zlo POM.
