HomeMy WebLinkAbout1930-06-10 189 SELECTMEN'S MEETING June 10,1930. A regular meeting of the Board of Selectmen was held at the Selectmen 's Room, Town Office Building at 7 :30 P.M. Messrs . Burnha4, Custance, Blake, Trask add Shannon were present. The Supt. of Public Works and the Clerk were also present. Mr. Edward W. Taylor, Chief of the Fire Dept. came before the Board to call attention to the tragedy which occurred at the Lexington Reservoir in the death of a child fourteen years old, named Purchase of Patricia Kendall, on June 8, 1930. Mr. Taylor a lung motor. called attention to the fact that the pulmotor in the Police Dept. was not in good condition, and he felt that an inhalator should be purchased as this could be used in many cases where a pulmotor could not be used, for instance, gas poisoning cases, and feelin ? that it should be purchased he ordered one. After Mr. Taylor retired, Dr. James J. Walsh came before the Board to discuss the same matter. He reported that while using the pulmotor on the K ndall child it went bad, and they had to send for the Town of Arlington to bring their pulmotor. He stated that if the child 's life had been lost on account of the inability to operate the pulmotor, the Town would be severely criticised. As a matter of fact in this particular case, the child died from heart failure. However, they may have an incident when it might mean the loss of a life. He praised very highly the work of the Police and Fire Dept. in endeavoring to resuscitate the child. Dr. Walsh explained that he had sent for information regarding the lun* motor and found that the cost of one would be $215. plus an additional oxygen tank, the cost would be $6. or $7. more. He felt that this was necessary for drowning accidents, and it would not be safe to send back the present lung motor for repairs until another one had been purchased, and then he felt that that piece of apparatus should be sent back and probably the sum of $50. would be all that would be charged for repairing it . He recommended that an inhalator be purchased for the Police Dept. also and for each piece of fire apparatus in the Fire Department . The Board after considering the matter, felt that inasmuch as the Fire Dept. had purchased an inhalator, that they would purchase a lung motor for the Police 111 Dept. and have the of er lung motor repaired, plus securing ad additional tank for oxygen. 190 o. The matter wa^ left with the Clerk to place CJ the order and take the matter up with the Appropriation Committee to secure their aproval inasmuch as at a later dat - the Police Dept. and Fire Dept. will have to ask for additional money. The Board considered this an emergency. Title to It was voted to authorize the Town Counsel Marshall to examine the title of the property which the Town property. voted to purcha^e from Lillian G.& Lois M. Marshall adjacent to the Cary Memorial Library. Mr. T. A.Custance was instructed to secure bids on the removal of the bu i1 din zs on the Marshall property. At 8 P.M. hearing was declared open on the Ross Tire & application of Ross Tire & Battery Co. for permission Battery Co. to install an additional 1000 gallon gasoline tank at the premises at 3 Depot Square, for special gasoline. No persons appeared at the hearing, and it was voted to grant the petition. Letter was received from Raymond L. Works and also to the Town Engine r to look up the dedds to see whether or not the Town agreed to take care of the fence. The Town Engineer called attention to the fact that some name should be given to the Old County Old County Road near Allen Street where it is proposed to Road. erect a new school house. He also called attention to the fact that the layout of the street should be changed somewhat to avoid building a retaining wall along the Lima property. Mr. Custance reported that he had spoken to Mr. Howard S. 0. Nichols regarding the matter and asked the School Committee to look the situation over and send in whatever recommendations they might have regarding the matter. A 191 Permission was granted to the E.E. I.Co. and the N.E.Tel . & Tel . Co. to attach to two poles on Pleasant Street at Follen Road. This permit is Attachment necessary to carry out the changes in the corner to poles . which are now being made in placing a curbing in front of the Park at the junction of Pleasant Street and Follen Road. Letter was received from the Town Counsel Letter to enclosing copy of letter which he sent to Mr. Attorney Mayberry, Attorney for the Donnelly Advertising Mayberry. Comapny. The Board signed the order for the extension of Clarke Street to be recorded at the Registry of Deeds. The order reads as follows : COMMONWEALTH OF MASSACHUSETTS Micdlesex, ss . Town of Lexington. At a meeting of the Board of Selectmen of the Town of Lexington held the 10th day of June, 1930 it is ORDERED: Whereas the Board of Selectmen of the Town of Lexington, having determined and adjudged that common a'onvenience and necessity require that a town way be laid out in the location hereinafter described and having complied with the requirements of law relating to notice, did on the 28th day of January 1930, lay'I:Jdt-ai' a tOwtt *ay the way known as Clarke Street Extension accordingly and duly filed their report of such laying out with the boundaries and the measurements of the same in the office of the Town Clerk of said town on the 29th day of January, 1930, and whereas at a town meeting duly called warned and held on the 9th day of June, 1;)30 , in accordance with the provisions of law applicable thereto, it was VOTED: That the Town accept the layout as a town way of an extension of Clarke Street as laid out by the Board of Selectmen, under the Betterment Act, and shown on plan on file in the Town Clerk 's Office, dated August 27, 1929, and for the purpose of con- strIcting said street the sum of $3500 be appropriated and assessed. NOW, THEREFOR, we, the undersigned, being a majority of the Board of Selectmen of the said Town of Lexington, duly elected, qualified and acting. as such, do hereby under and by virtue of the provisions of Chapter 79 of the General Laws and of any and every other power and authority us hereto in any way enabling, take the right or easement to use for all the purposes of a town way for the use of said Town of Lexin ton, the land in said town bounded and described as follows : 192 PARCEL "A" C, Beginning at a stone bound in theosoutherly line of Parker Street, thence south 57 191 west distant 245.9 feet to the center line of Vine Brook, thence southeasterly along the center line of Vide Brook distant about 42 feet, thence north 57 19' east distant about 19 feet to a stone bound, thence continuing along the same line north 57° 19 ' east distant 196.88 feet to a stone bound, thence north 32° 04 ' 42" west distant 28.41 feet to the point of beginning, containing 6560 square feet. PAR( EL "B" Beginning at a point in the southerly line of Parker Street, thence bearing to the right with a curve of 20 .00 feet radius distant 31.42 feet to a point of tangency, thence south 57° 19' west distant 256.3 feet to the center line of Vine Brook, thence southeasterly along the center line of Vine Brook distant 37.3 feet, thence north 570 19' east distant 245.9 feet to a stone bound in the southerly line of Parker Street, thence north 32° 41 ' 10" west, along said southerly line of Parker Street, distant 41.59 feet to the point of beginning, bentaining 5723 square feet. In the above described parcels the most southerly line of "Parcel '.k" and the most northerly line of "Parcel B" are parallel with and 50 feet distant from each other , with the exception of the curved intersection at Parker Street. The above description is intended to conform to the plan of said street entitled, "Plan of Clarke Street (Extension of) Lexington, Mass . , Scale 1 inch - 20 feet, August 27, 1929, John T. Cosgrove, Town Engineer", which plan is on file in the Town Clerk's Office in said Lexington and a copy of which will be recorded with Middlesex South District Deeds with a copy of this order. All trees upon the land taken are included in this taking. Betterments are to be assessed for this improvement. The area which it is expected will receive benefit or advantage other than the general advantage to the community, from such improvement is described as follows : The same being lands now or formerly of Edward Wood and Paul A. Ringland, as shown on a plan entitled, "Plan of Clarke Street (Extension of ) Lexington, Mass . , Scale 1 inch - 20 feet, August 27, 1929, JohnnT. Cosgrove Town Engineer. " 193 The said area comprises the several lots shown uoon the plan hereinbefore referred to, which are designated in the schedule hereto annexed and made a part hereof. We estimate the betterments that will be assessed upon each parcel of land to be as shown in the schedule which is hereto annexed and made a part hereof. We determine that no damages have been sustained and none are awarded. WITNESS our hands at Lexington aforesaid this 10th day of June , 1930 . Albert H. Edward Wood $1475.22 Paul A. Ringland 1590.77 Application was received from Harry A. Burgess asking for permission to have Sunday Golf practice on the Marrett Gardens ah d also on the Bean property on Bedford Street. Mr. Burgess reported that a state Police Golf Practice. offi^er called at both premises and informed them that they would have to have a Sunday Amusement license. The Clerk was instructed to find out from the State Dept. of Public Safety what form of license they referred to , and to also take the matter up with the Town Counsel . Letter was received from Robert C. Merriam complaining about the water pressure on Oakmount Circle. The Board decided to inform him that they Water Pressure are now reinforcing the water supply in accordance Oakmount Circle, with the Metcalf & Eddy plans in the East end of the Town, and it was hoed that when this was done it would help the situation somewhat. Next year they will recommend to the Town the reinforcement of the water supply, extending a main in the Lovell Street section. The present low water pressure in that section has been because of the dry season, and the Supt . of the Water & Sewer Dept. also states that the pressure will never be absolutely corrected in that section of the Town until the residents in that section allow a standpipe to be built. 194 The Board discussed proceeding Immediately with the continuation of the reinforcing of the water supply from the Arlington line to Pleasant Street 111 License was signed for the Lovell Bus Line Inc. giving them permission to operate busses Lovell Bus over the Lowell Turnpike. This permit had permit. already been granted -to the Lovell Bus Line Inc. and they now have received a permit from the Dept. of Public Utilities , State Haase. Alcohol license was granted to_ the Colonial Alatiol garage to seal alcohol at 34 Bedford Street and License. at 1668 Massachusetts Avenue. Letter was received from Mr. William...B. Soldier's Foster, Commander o.f the G. A. R. thantgng lot . the Board for their interest taken in arranging that the Soldier 's lot in the Munroe Cemetery was fixed up for Memorial Day and especially in the Tercentenary year. Lettef was received from the Planning Board Construction in which they suggested an auxiliary line from of Streets, the Arlington Standpipe to Pleasant Street. The Liberty Heights Board having asked the Planning Board for Section. approval of a definite layout of streets over Liberty Heights to Pleasant Street , felt that the Planning Board bad not given tham._the information desired by them and_Mr. Custance was authorized to communicate with the Planning Board and ask them for the definite approval of the streets in that section so that th&..layout of the streets suggested. by the Town..Engineer_.may be approved and the water main. could_ .then. be constructed in the proper streets. Letter was received from the Planning Board Prop-seed regarding the layout of theist/met which_ they street from were to study from Hancock S.tre.et._acros.s. to. Street, to Wilburn St. in which they stated that they could_not. do anything further on the matter until. they secured the estimate of the cost of. ,cons true t1 on. .of this street from the Town Engineer. Mr. Custance was directed to reply to the Planning Board that the Hoard did not feel it necessary to secure an oftimate of the cost of construction before deciding the layout, inasmuch as the$ could be done at a later date. Town Counsel 's Bill of the Town Counsel in the amount of bill. $44.00 for his services in the Brophy and McKinnon case was approved by the Board. Commitment . The Board signed commitment of water rates in the amount of $5054. 54 . misc. sewer charges $17 .19; sewer rental $551.13; sewer assessments Mass. Ave. $100.40. 195 Letter was received from F. W. Dean, 4 Eliot Road, in which he called attention to the danger in crossing from Pelham Road Request for across Mabsachusetts Avenue to the Railroad traffic officer. station, and requested that a traffic officer be placed there at such times as the people in that section find it necessary to go to the train and return. The Board felt that the number of police officers in the Department did not warrant their carrying out this request at the present time, and decided to notify Mr. F. W. Dean that they would take this matter under advisement. The Supt. of Public Works was requested to secure information on the collection of garbage, giving the number of persons that the Town collects garbage from., also to get, the number of people on e.ach_.stre.et and .have the Garbage list ready for the Board. next. Tuesday. Collection. Mr. Custance reported that he had received many canplaints about the. collection of garbage, and hefelt the Supt . of Public Works should take the matter up with the men on the trucks.. The use of the dumps. by out of town people was discussed, and. the Supt. of Public...Works was instructed to place signs on the dumps stating that they Were for the use of the Town Town Dumpa. residents only and that any persons using them outside of the people living in the Town would be prosecuted for violation of this rale. The Supt. of Public Works was also requested to have the tree stumps on the Town dumps turned over on the aide of the dump so that they could be covered over. The attention of the Supt. of Public Works was also called- to the fact. that. there had been an accident in front .of the Masonic Hall on account of parking. Parking It was suggested that the parking regulations Regulations. be amended to restrict parking on Muz2.ey Street 200' from Massachusetts Avenue to one hour between the hours of 9 A.M. and 6 P.M., and to restrict also the parking on. both sides of Massachusetts Avenue from Waltham Street to Depot Square to one hour, and have parallel parking on_.both sides of the street. The Supt. of Public Works was requested to have the Engineering Department draw upa plan. showing the proposed parking, .regulatio.ns.. It was also decided_t.o notify the. P.olic:e Department to enforce the regulations against 196 double parking on the highway. "-11 The Supt. of Public Works was instructed Painting to proceed with the painting of the highways; of highways. also to retove a birch tree on Edgewood Road which had been run into by an automobile. The East Lexington Men 's Club having been requested by the Board of Selectmen to bring in East Lex. in writing their suggestions and plan marked Men's Club. with their suggestions thereon, recommending various changes in the traffic situation, left the plan for the perusal of the Board. The Board turned the matter over to the Supt. of Public Works and requested that he study the suggestions and make recommendations to the Board. Oil Allen St. The Supt. of Public Works was requested to oil Allen Street and the Old County Road. The Board dis cussed the advisability of Relocating notifying the Public Utility .Dept. that. . Lincoln St. their intention to relocate Lincoln. treet. from its junction with Mass . Avenue to the Lincoln Line in 1931. The following is the weekly report of the Supt.of Public Works : For the week ending June 7, 1930. Supt. 's Report. Highway Department Completed application of seal coat and pea stone on Mass . Avenue. Repairs made on Lowell Street between East Street and Curlington Town line. Surface patches made in Mass. Avenue, Muzzey Street, Meriam Street, Bedford Street, Somerset Road, Highland Avenue, Washington and Oakland Streets. Contractor is constructing granelithic. .sidewalks . Next week in addition to regular maintenanc_e work repairs will be made. in Concord. _Avenne. Moth & Shade Tree Dept. The Department is spraying .the. public trees and will be so occupie.d .next week. Park Department. Regular maintenance work was .attended_..to by the Department and will occupy the department. next week. 197 Water & Sewer Department Water Maintenance Services have been installed as follows: Lundergan, 9 Sylvia Street ; Burgess , Cor. Merrett ,Road & School Street; Grafe, Cor. Bridge Street & Marrett Road. Renewal for Lassoff, 13 Sylvia St. Water Construction We have laid approximately 575' of pipe in Walnut Street; 700' in Pleasant Street and 310' in Concord Avenue. We have installed 2 hydrants and 1 gate on Walnut Street. We have inserted a blow-off in the 12" main in Pleasant Street at Clematis Brook. The old 6" main in Walnut Street has been connected with the new 10" main and the old 6" main in Concord Avenue has been connected with the new 12" main.
