At 8:05 P.M. hearing was declared open on the Pole location. petition of the N.E.Tel. & Tel. Co. for permission to locate two poles and remove one -pole on Sylvia Street. Mrs. Jacob Bornstein and Mrs. Bloustein were ' present at the hearing. They had no objection to the location provided the poles were placed where they would do no harm if buildings are built on the lots in the near future. No other objections having been received it was voted to grant the N.E.Tel. & Tel. Co. per- mission for the pole locations. Letter was received from Peter J. Mr. Wrightington having asked Mr. Worthen to give suggestions, it was decided to lay this matter over for one week, until the suggestions could be received. J 1 1 the Town tired to make claim for the property previously used for the East Lexington Stand- pipe --which Robbins & Smith, purchasers of the tract of land believed reverted to the original owners rather than to the Town when the water pipes were removed. The Land Court having decided against the Town, the Town Counsel advised the Selectmen not to take the case any further. The bill for $200 for Town Counsels' services was approved. Invitation was received by the Board of Selectmen from the Vine Brook Hunt Club to attend and anticipate in a series of events in honor of farmer and landowner neighbors to be held at the Hunt Stables, Terrace Hall Ave., Burlington from three to six o'clock Saturday, May 24, 1930. Letter was received from Mr. Hollis Webster, President of the Children's Museum, in which he stated that the Trustees of the Lexington Children's Museum request that permission be, granted them for a room in the Cary Memorial Hall for the safe bestowal and display of their collection so that they may be available for the instruction of the children. It was decided to request Mr. Webster to come before the Board at their meeting next Tuesday evening at 7:45 P.M. to explain just what is intended to be done to establish the childrents museum. It was reported that the official census record given by the National Census Supervisor was 9429 as the population of Lexington. Mr. Custance brought up the matter of Mr. Page's sewer on InddVendence Avenue which matter had been taken up previously, and stated that after looking the matter over, he felt that the situation was similar to that in the Kilgour case where the Board granted an abatement until such time as Mr. Kilgou r can get a sewer benefit from the property by using the lot to be built upon. Mr. Custance recommended the abatement of the sewer asseessment on 501 of the Page property. The Board therefore voted to abate the assessment on 501 and instructed the Supt. of Public Works to prepare the necessary f¢Tm of abatement. 171 Bill for legal services, Robbins & Smith claim. It was decided to place an order for two Telephones telephones to be installed in the Public Works Dept. installed. one for the Water Dept. and one for the Highway Dept., the same to be connected with the switch board. 172 Opinion was received from the Town Counsel regarding the applications for tourist signs. Opinion re The Town Counsel believed that all applications tourist for signs of this kind should be made to the signs. Building Inspector. This letter was sent as a climax to the discussion had by the Board, Town Counsel and Chairman of the Planning Board at the Board's last meeting. Letter was received from the Town Counsel in Salary -'-,of which he gave the opinion of the Town Counsel of District, Arlington when he took up the matter of the salary Nurse:t of the district -nurse with him. It was decided to lay this matter on the table until the Board of Health Appropriation is made in 1931. The Supt. of Public Works' attention was Water in called to the fact that the water runs down the Styglest sidewalk on Oak Street into the Stygles? cellar, cellar. and he was requested to do something to remedy the condition. Mr. A. H. Burnham reported that the G.A.R. Cary Memorial desired the use of Cary Memorial Hall on Hall, Memo- Memorial Day to furnish a luncheon to'the Ahildren rial Hay. who participate in the parade. It was left with the Chairman to make arrangements for the use of the Hall provided no other matters interfere. Letter was received from C.W.&.R.L.Ryder in which they stated that in view of the action taken at the Town Meeting regarding the question of Vine Brook drainage, they desired to know what attitude the Board would take now. They stated they were .willing to develop the property Ryders re along the lines that would be a credit to the.Town, drainage. but they cannot do it without the cooperation of the Board and the Town. They asked whether or not the Board would continue to try to put the program of drainage through or to remove the obstructions, lowering and relocating certain sections of the main channel from Vine Brook Road to Hayes Lane. They asked for an early decision as to what the Board proposed to do, inasmuch as they propose to develop the land mw and will submit another plan 'to the Planning Board, meeting the minimum requirements, inasmuch as they feel they will sell to the public whether there is any further drainage or not. The Ryder Brothers also asked that the signed agreement be returned to them inasmuch as the Town failed to approve the same. 1 Letter was received frau Dr. William L. Barnes in which he stated that several years ago he was about to begin work putting Vine Brook, where it runs through his property underground so that he could properly grade the grounds and enhance the value of the property. He was asked by the Board of Selectmen to hold off, giventhe promise that the Town intended to deepen and widen and cover the brook in that section, and wanted to have it done according to the Engineer's specifications, and not the way he intended to do. He has mdw waited over three years for some action, inasmuch as the proposition to lower'Vine Brook was voted down at the Town Meeting. He stated that if he had been allowed to go ahead as he had planned, he ,would have disposed of his two houses at top prices, but now having waited in good faith until real estate values had sagged, he was faced with the proposition of covering the brook himself, and he could not get as good a price for his property as he could a few years ago. He felt that he had suffered considerable damages, and he wanted to know if the Board would have any objection to his going ahead now and covering the brook himself oter his property, and if the Board intended to lower and widen the brook wilaout covering it, or if they intended to bring the matter up again at Town Meeting. After dis cu ss ing the matter, it was decided to recommend to Mr. Ryder that a committee of not more than twenty-one be appointed to study further the Vine Brook drainage program, none of whom shall be members of the Board of Selectmen. The following is the weekly report of the Supt. of Public Works: 173 Dr. Barnes re Vine Brook Drainage. Barber shop Regulations Posted. 1.74 Supt.'s report. For the week ending May 17, 1930. Highway Department. Spring Street, south of Concord Avenue, and all of Middle Street were graded and rglled, a covering of tar applied, covered with pea sone and rolled. This process was also started on Burlington Street but was not canpleted. The work of connecting the catch basin in Lincoln Street near Hastings Road with the drainage in the playground was started. Surface patches were made in Mass. Avenue, Concord Avenue and Middle Street. The road grader and roller were used leveling and dressing the Park Drive. The setting of edgestones at the Trust Companjt's new building at Mass. Avenue and Muzzey Street was started but has not been completed. The setting of edgestones at Robbins Park and in front of the Sacred Heart Church and the grading of Robbins Park is under way. The construction of granolithie sidewalks was also started during the past week. Next week the regular maintenance work will occupy the department as well as the -continuation of the work of setting edgestones and constructing granolithic sidewalks. Moth & Shade Tree Department The department was occupied with the work of trimming trees on Belfry Hill, treating tent caterpillar nests with creosote and preparing the equipment for spraying. Next'week this usual maintenance work will be attended to. Park Department. The department did considerable grading and leveling at Hastings Park. 536 loads of fill and 71 loads of loam have been received at Hastings Park during the pest two weekas Mowing, raking and other regular maintenance work was attended to. Next week the work in Hastings Park will be continued as well as the regular maintenance. Water & Sewer Department Water Maintenance. Three houses on Bowker Street have been connected with the new main. Moved hydrant back on Hill Street where road has widened. Seven men have been digrying boiler room pit at the carbarn. Taw men have been repairing hydrants in 1 175 ' various parts of the Town. A service has been installed for Silva on Concord Hill. Water Construction Approximately 75t of 6" pipe has been Ikid in Valley Road. We have opendd up 5501 of trench, but due to the shortage of pipe, could not lay any more. Made connection at Valley Road with main in Bedford Street. We have been trucking pipe to Walnut Street. Sewer Maintenance. AL service has been installed for Silva on Concord Hill. One man has been cleaning out brooks The work contemplated for the week ending May 31st is as follows: preparing to lay 12" pipe in Pleasant Street from Watbrtown Street to Concord Avenue and 10" pipe in Walnut Street from Concord Avenue to proposed site of hospital.
