HomeMy WebLinkAbout1930-01-14 q SF.T.F,CTMEN 'S MEETING - JANUARY 14,1930. A regular meeting of the Board of Selectmen was held at the Selectmen's Room,Town Office Building at 7 :30 P.M. Messrs. Burnham, Custance, Shannon, Blake and Chamberlain were present. The Supt. of Public Works and the Clerk were also present. Approval of the appointment of Osborne J. 0. J. Gorman Gorman as Moth Supt . and Forest Warden was appointment received from the State Forestry Department. approved. Commitment of sewer rentals in the amount Commitment, sewer of $1445.26 was signed by the Board. rental. Abatement of sewer assessment on Inde- pendence Avenue on lots 63 and 64 owned by Robbins & Smith was signed by the Board. Reports approved. The following reports were approved by the Board for the Town report with the ex- ception of a few suggestions to be made in the Town Engineer 's report: Town Engineer Sealer Weights & Measures Building Inspector Animal Inspector Cemetery Commissioners Plumbing Inspector Health Officer Statistical report of Library The following Agent's licenses were granted by Agent's licenses. the Board. Colonial Garage, Lex. Automobile Co. , Frederick E.Johnson Letter was received from the Board of Trade in which they requested that all town departments Board of Trade make their purchases in Lexington. re purchases. The Board directed a reply that they would .call the matter to the attention of the Supt. of Public Works, but they also wished to call attention to the fact that there is a law that compels towns to purchase the prison made goods, and for this reason a great deal must be purchased from the State . Attention was also called tothe fact that some of the merchants cannot competewithlarger concerns in price. However, the Board wouldbe glad to cooperate in any way passible. The Board signed the descriptions covering Precinct the establishment of four precincts in the town, Descriptions and also the map showing the boundary lines of the signed. precincts, and directed that the same be filed with the Registrar of Voters, Assessors and the Town Clerk. Blake Francis Chamberlain January 14, 1930 Board of Selectmen The following bids were received for printing the placard bearing the dexcription of the voting list: Hadley Press Inc . 100 of each of 4 Precincts (400) $48.00 Bids on 400 of each of 4 Precincts (1600) 60.00 Voting Size of sheet not to exceed 11" x 17". List. Mercury Printing Co. 100 of each precinct ' $15.00 each precinct 500 each preoinet @ 2200 each precinct. size of sheet approximately 13" x 20". The bid was awarded to the Hadley Press, Inc. who was the lowest bidder. Letter was received from Lombard Williams of the Paul Revere Golf Club en Cedar Street in Golf Club which he explained that the assessed valuation of assessment the Paul Revere Golf Club property had been increased considerably this lest year, but that no improvements had been made by the Town on the street which wa's narrow and dangerous. The Board requested the Supt. of Public Works to look the condition over and they would advise him at a later date what could be done. Letter was received from Edwin B. Worthen regarding the town seal. Mr. Worthen explained that Town Seal the Lexington Historical Society would not meet for some time, and that he gave his personal views regarding a change in the Town. Seal, :and stated that he approved the consideration of the change and suggested the Minute Man statue, the Monument on the Common, the Belfry or the Boulder on the Common, any one of which might be adopted. He himself was inclid®d toward the ancient monument. He suggested that Mrs . Beulah S. Locke might be requested to d^aw three or four designs and Mr. H. Dudley Murphy advise the Board about the a adaptibility of the designs to the Town Seal. Mr. Blake suggested that Mr. Fred C. Ball .has some very fine photographs of these monuments , and it was decided to view these photographs before considering the matter further_. The Board seemed to be in favor 9f making a change. 21 The Board signed an order for the layout of. Hill Street, the same to be filed at the Registry of Deeds, East Cambridge. There is to be no betterments assessed because of the fact that releases have been received from all of the owners of the property on Hill Street releasing any claim Hill Street for damages. order. The following is a copy of the order signed: COMMONWEALTH OF MASSACHUSETTS Middlesex, ss. Town of Lexington. At a meeting of the Board of Selectmen of the Town of Lexington held the 19th day of November, 1929, it is ORDERED, Whereas , the Board of Selectmen of the Town of Lexington, having determined and adjudged that common convenience and necessity require that a town way be laid out in the location hereinafter described and having complied with the requirements of law relating to notice, did on the 5th day of November, 1929 lay out as a town wayway the known as Hill Street from Bedford Street to Cedar Street, accordingly and duly filed their report of such laying out with the boundaries and the measurements of the same in the office of the Town Clerk of said town on the 15th day of October, 1929, and whereas at a town meeting duly called, warned and 111 held on the 16th day of December, 1929 in accordance with the provisions of law applicable thereto, it was VOTED: "That the Town accept the layout as a town way of Hill Street from Bedford Street to Cedar Street, all as laid out by the Selectmen under the Betterment Act, and as shown on plan_ on file_ in the Town Clerk's Office." The above description is intended to conform to the plan of said street entitled, "Plan of Hill Street, Lexington, Mass. , as laid out by the Board of Selectmen, Scale 1 inch - 40 feet, Oct. 1, 1929, John T:Cosgrove, Town Engineer, " said plan is divided into five lengths on sheets numbered from 1 to 5 inclusive, which plan 3,0 on file in the Town Clerk's Office in said Lexington and a copy of which will be recorded with Middlesex South District Deeds with a copy of this order. All trees upon the land taken are included in this taking. Betterments are to be assessed for this improvement. The area which it is expected will receive benefit or advantage other than the general advantage to the community, from such improvement is described as follows : The same being lands now or formerly of Marion E. Woodworth, Elizabeth Mansfield, Franklin H. Pike, Lester L. Andrews, Anna Patterson, James M. Bullock, John Bullock, John F. & Ida F. Cranston, Nellie Dalrymple, Jemima F. Haynes, Lexington Golf Club, Matilda Tewksbury, et al, Esther N. Adler, Robert & Catherine L. Watt, Catherine A. Kimball, Frances M. Robinson et al, and Grace M. Lennon, as shown on a plan entitled, "Plan of Hill Street, Lexington, Mass . , as Liid out by the Board of Selectmen, Scale 1 inch. - 40 feet, Oct. 1, 1929, John T. Cosgrove., Town Engineer. " The said area comprises the several lots shown upon the plan hereinbefore referred to, which are designated in the schedule hereto annexed and made a. part hereof. 24 We estimate the betterments that will be (� assessed upon each parcel of land to be as shown in the schedule which is hereto annexed and made 11a part hereof. Blake Clarence Shannon Theodore A.Custance HILL STREET ESTIMATED ASSESSMENT OF BETTERMENTS TO ABUTTORS No assessments to be made. Letter was received from the Chairman of the Planning Board regarding the enforcement of the Zoning Law in connection with roadside stands and gasoline stations . He asked that the law be enforced more rigidly this year in connection with the roadstands, and that gasoline stations be prohibited from advertising oils . Zoning Law Mr. Beery suggested that the Police Department enforce- might cooperate with the Building Inspector and meet. report cases of violation of the Zoning Law. Letter was received from the Chief of Police in which he informed the Board that the Police Department go over the town in the summer time in a motorcycle and also in winter in the police car and any violations are always reported. But he stated that he would be very glad to cooperate in the matter. However, on the enforcement of the Zoning Law to give more complete information, he felt that the present officers are now overworked, inasmuch as he has to use the men that have served on night duty to do day duty to protect the school children. Opinion was also rendered by the Town Counsel to the Building Inspector regarding enforcement of the Zoning Law on roadside stands . The Board decided to acknowledge receipt of the letter of the Planning Board. Letter was received from the Mass . Department of Agriculture setting forth article to be inserted in the warrant for the control of mosquitos . The Board recently signed a petition askidg for a survey of mosquitos in the town, inasmuch as it was understood that there would be no cost to the town. It appears that on further information 25 received that there will be a cost to the Town to Mosquitos establish a department to check up on the mosquito breeding. The Board, therefore, decided to drop the matter, and to so advise the Department of Agriculture. Letter was received from Latimer Seaver in which•he asked what the status of the sewer assess- ments was, bills for which were paid under protest in connection with Forest Street. It was understood by the Board that at the time that Forest Street was accepted no mention was made of assess- ments. The only assessments which were referred to at the meeting were the highway assessments, and these betterments were not assessed to the property owners . At a later date it was considered proper to construct the sewer, and for this reason the Board did not see why the assessments should not be made and paid. The matter was left with the Supt. of Public Works to make a report on the assessments . Hearing on a proposed act to provide for the layout and construction of a through way in the Metropolitan district was to be held Wednesday, Hearing on January 15, 1930 at 10:30 A.M. at the State House. proposed way. This is a matter which Lexington is interes-tedin, inasmuch as the highway will begin at the Lexington- ' Arlington line and continue along the line of Slimmer Street to the place where Summer Street is now a State Highway, and begin again at Lowell Street, Lexington, until it is, intersected with Maple Street, thence along Lowell Street to a point where it is intersected with East Street, thence over public and private ways and public and private lands to a point on Bedford Street, Lexington. Mr. Custance was requested to represent the Board at the hearing. Hearing was to be held at the State House on January 16, 1930 upon the petition of the Selectmen to revoke certain sections of the Tenement House Act. Hearing on The Board discussed as to whether or not they Tenement House would take action on the revocation of this act Act. and decided that it would be weal to have this action taken so that if in the near future the Stuart-Marshall Realty Company proposition is completed or not and any other proposition that may arise in this connection is at hand, they may be then able to place the act before the Town for acceptance. Town Counsel, Sydney R.Wrightington, advised that the Board see that no tine limit be placed in the act for acceptance so that they will not be tied up again, and have to coo back to the Legislature. .tom 26 Mr. Marshall, of the Stuart-Marshall Realty 'Z] Comoany, came before the Board together with C. Sgdney R. Wrightington, Town Counsel. Mr. Marshall desired to explain to the Board that he has done everything in his power to bring about the signature of the Scott TeacCompany so that they might go ahead and complete the negotiations Marshall with the Town to parchase the front land for highway Proposition. purposes in front of the Boutelle block, so-called, Mr. Scott promised him many times that he would sign up, but he has some idea in his head that the Town of Lexington will pay more money for the land. Mr. Marshall has not paid the taxes on the property, inasmuch as he agreed with Mr. Scott to pay the taxes when he signed the agreement. Mr. Marshall explained also that he tried to cooperate and even secured architect 's plans for the building which cost them considerable and also that they have not leased the stores in the building, and that they did this at an entire loss to them. They had an interest in the matter and wanted to erect a first class building with shops on the first fltor that would not be like the ordinary stores , but a better type of shop. Mr. Wrightington advised that bhe matter therefore be dropped, inasmuch as the Town has no intention of paying any larger sum to the Scott Tea Company for the land. Letter was received from the Town Counsel regarding the Ea t Lexington meadows, and in which he stated that the Town of Lexington might become E. Lexingtonthe owner of tax titles of the property in question, Meadows. inasmuch as the taxes are not paid upon the property, and then the question of the whole area could be placed before the Land Court, and if the proceeding was successful the Town would have 4 marketable title, if it was unsuccessful, it would probably disclose the owners of the property and they can be properly assessed in the future . Mr. Chamberlain called Mr. Wrightington's attention to the procedure he advised when the school house lot on School Street was discussed and which he thenadvised the posting of theproperty and then the Town taking a title. Mr. Wrightington agreed that possibly this Idg}tt be done, but it was decided first to ask the Assessors what laws they could work under, and what their authority would be to accomplish any of the suggestions made. Letter was received from the Town Counsel re- Robbins garding the purchase of land from Robbins & Smith & Smith and he advised that the Board could purchase the land, land. inasmuch as they would not have to have an authorization for the borrowing of money, they would not have to have a street layout . 27 Mr. Robert L. Ryder together with his engineer, Mr. Barnes presented an application for the extension of Winthrop Road through the property of Charles W. Ryder. He also presented the plan of the general scheme of the layout for study by their engineer, Winthrop Rd. the Town Engineer, and Planning Board and they Extension. stated that it was approved by the Planning Board. Of the streets laid out on the plan they only desired to have Winthrop Road extended at the present time. The Board decided to advertise a hearing on the application. Mr. Blake called attention to the fact that some light cases of barber's itch have appeared Barber's itch. on persons who visited the barber shop of Mr. Coscia. It was decided to request the Health Inspector to see that the regulations regarding barber shops were enforced. The Appropriation Committee members came before the Board of Selectmen, and asked whether or not there was any way that they could secure Appropriation the information regarding the expenditures of Committee. the various accounts earlier in the season than they do receive it , inasmuch as it did not leave them time enough to make the studies of the various departments. They stated that they had formed their committee into three sub-committees and each of those committees were burdened with the duty of investigating the different departments, it so that they would know in detail ti[h.at the needs of the departments were and they could then inform the general committee whether or not the appropriation should be approved. General discussion of the activities of the Appropriation Committee and the position of the Board of Selectmen was entered into. Mr. Chamberlain explained that as a general rule the companies do not close their books any earlier than the Town Accountant closes his books , and he did not see how it was possible to get out the statements much sooner than they are now out. Mr. Devine suggested adopting a certain policy and adhering to it for the Appropriation Committee and the Selectmen. Mr. Custance presented a plan showing the layout of Hastings Park, and explained that the Hastings Park filling now being taken frgm Hill Street is being dumped into Hastings Park with. a. view to filling up the pond which always formed there, and with, a view also to levelling off the park. The plan had a suggestion of cutting off the point at the junction of Lincoln Street and Mass . Avenue and only one tree would have to be removed. This could be re-planted. 28 The Board felt that the suggestion was a good one and voted to authorize the change as suggested t7 on the plan. Mr. Custance explained that Anthony Ross & Son desired to purchase a part of the land of the Purchase of Middlesex & Boston St. Rwy. Co. which the Board Carbarn was authorized to purchase. He had originally property. offered 3¢ a foot for about l .acres of the land which is located near the under-pass and which does not have a frontage on Bedford Street, but is reached by a right of way owned by the Town. Mr. Ross desired to erect a building and store his equipment which he now has stored in one of the buildings on the Middlesex & Boston St. Rwy. Co. property. Mr. Blake felt that the Town should at least obtain 5f a foot for the land, and requested Mr. Custance to find out if Mr. Ross would make an offer of this amount. The weekly report of the Supt. of Public Works is as follows: For the week ending January 11, 1930. Highway Department. The work of widening Woburn Street by cutting back the high banks on the north side was continued. Where the banks have been cut back there are several places where it will be necessary to build retaining walls. A number of trees have been removed and others have been Supt. of trimmed. This work will improve the safety Public Works conditions on Woburn Street greatly because a Report. number of obstructions to the driver's view have been removed. During the week the steam shovel was moved from Woburn Street to Hill Street and work on this street of relocating, widening, cutting back the high banks and .filling the low parts has been started. A drain at the junction of Washington Street and Eliot Road has been taken up, cleaned, and replaced. Sidewalks and streets have been sanded when necessary. Next week the department will be occupied with the construction work on Hill Street and the regular maintenance work. Moth & Shade Tree Dept. This department removed and trimmed a number of trees on Woburn Street where the highway was being cut back to the proper width. 29 Next week the department will be occupied with cleaning the gypsy moth nests . Parks & Playgrounds . Regular maintenance work has been carried on and will occupy the department next week. Water & Sewer Department. Water Maintenance A water service has been installed for Phalen on Independence Avenue. We are still replacing hydrants that have no steamer nozzles and to date four have been replaced. Sewer Maintenance The sewer cleaning machine has been received and has been assembled so that it is now ready to operate. A sewer service has been installed for Phalen on Independence Avenue .
