SELECTMEN'S MEETING - JULY 2, 1929.
The regular meeting of the Board of Selectmen
was held at the Selectmen 's Room, Town Office
Building, July 2 , 1929. . Messrs. Burnham, Custance,
Chamberlain, Blake and Shannon were present. The
Supt. of Public Works and the Clerk were also
present.
At 7:50 P.M. Mr. Arthur Locke came before the Locke's ap-

asked that the Board reconsider their decision
in regard to his application for a permit to build
a ,private garage on his premises at which hearing
Mr. Thomas Doherty objected, stating that the
garage would be detrimental to his premises and
would reduce the value.
Mr. Custance stated that he had been over to
Mr. Locke's property and looked the situation over
and could not see how the garage located as it would
be, would be determintal to the property of Mr.
Doherty. He stated that Mr. Locke had a garden in
the back yard, and there was considerable drop there
and he did not wish to spoil the garden as he had
it fixed up.
Mr. Locke explained that the garage would not
cut off the view from Mr. Doher Ly , inasmuch as on
that side of the house there was only a small pantry
window and another small window on the landing of
the stairs from which they would not look out anyway.
He did not believe for that reason it would spoil
their view.
The Board discussed the situation and voted
to withdraw their decision under dateof June 25, 1929
and voted to grant Mr. Locke permission to locate his
garage in accordance with plans filed with the Board
this evening.
At 8 P.M. bids were opened on theswimming
pool for the Parker Field Playground. Bids were
received as follows on the specifications drawn by
William Roger Greeley and aproved by J. R. Worcester
Company;

which bid figured out to be the lowest, and to

Letter was received from Miss Ellen M.
Tower, 4 Pelham Road, in which she asked that Complaint, pigs

in the Town and stating that she receives a very
bad odor from the piggeries at her premises.
The following report ort was received from
Russell I. Prentiss, Health Inspector, regarding
the premises of Frank Canisius, Ward Street.
June 29, 1929.
I beg to submit the following report on
the Canisius pi_,_ery located on Ward Street:
June 25, 1929.
On Tuesday evening, I went up to the piggery Health Ins.
and found three piles of manure , refuse, etc. report.
outside of the budding, These piles were not covered
with loam or acid phosphate. The odor coming from
the piggery was very strong, and I could smell it
as far away as Mr. Jellts ' house.
Saturday, June 29 , 1929, I inspected the
piggeryagain and observed only one pig on the premises .
I did not see Mr. Canisius. The three piles of -
refuse were still outside and uncovered. The odor
was very strong around the piggery. Garbage is
scattered around the premises, and in one place the

ground is covered for approximately twenty =
square feet with swill that the hens, ducks , AS
and dogs feed from. Inside the barn it
dirty and is not whitewashed; swill or garbage
is scattered everywhere and in general the
premises are very dirty and objectionable.

After further consideratio# of the evidence
submitted upon the Canisiusgg y i er on Ward
p
Street, the Board of Selectmen, acting as a
Board of Health, decided that the exercise or
trade or employment of keeping swine by Frank
Canisius at Ward Street, is attended by noisesome
and injurious odors , and it is a nuisance and
harmful to the inhabitants of the Town, and it is
therefore voted to adopt a formal older, ,a copy
of which is to be served upon Frank Canisius
by a Constable.
ORDER OF PROHIBITION
The Board of Selectmen of Lexington, acting
as a Board of Health, under Section 143, Chapter 111
of the General Laws and of every other power them
thereto enabling, hereby prohibit the exercise
of the trade or employment or keeping swine upon
the premises of Frank Canisius on Ward and Ash
Streets , Lexington, Mass.
Canisius Piggery. In accordance with Section 147 of said
Chapter whoever is aggrieved by this order is
entitled within three days after the service of the
order upon him to give written notice of appeal
to the Board, and file a petition for a Jury in
the Superior Court of Middlesex County.
In accordance with the provisions of Section 148
of said Chapter, if the said Frank Canisius shall
appeal from this order in accordance with the
provisions of Section 147 the exercise of such trade
or employmentis hereby specially authorized by
the Board while such proceedings are pending.

application could be accepted except from the

in this particular case to waive their ruling and
accept the application from Mr. Burgess, who clime
he will have the deed of the premises by the time
of the hearing.

Letter was received from the Town Manager
of the Town of Norwood in which he made the
suggestion that various towns join in the municipal
league for the purpose of having the laws changed
so that taxes may be collected from January and Letter from

particular item amounted to $12,000. He felt that
the extra clerical hire for the collection of the
taxes would amount to very little, inasmuch as the
second bill would be a stub on the first tax bill.
The Board was very much in sympathy with the
problem and so decided to inform the Town Manager
of Norwood, and also to inform him that as soon
as any concrete information could be obtained on
this project they would be ready to consider this
again.
All of the members of the Board being present,
it was decided to discuss the application of Granfield
Wil �� �. Granfield for permission to install two application.

It was decided not to grant this permit,
it being felt that public convenience and necessity
did not require the location of a gasoline station
at this point.
The following bids were secured for a fence
to be built around the Swimming Pool:

It was decided not to take any action to accept
this bid until such time as the Supt. of Public corks
could communicate with the Sam Brown Company
to see what bid could be received from this Company
Proposal was received from Louis W. Bills in L. Bill 's
the sum of $3,470 for the installation of traffic bid, traffic
signals in accordance with plans approved by the signals .
State covering location of poles at Elm Avenue and
Bedford Street, Clarke Street, and Waltham Street
and Marrett Road.
The Board signed the contract subject to
the filing with them of a bond for the faithful
performance of the contract and also a copy of his
certificate of compensation insurance.

Letter was received from Clifford Walker, 45
Walker girl 102 Bedford Street, explaining that his daughter
thrown from was knocked down by the street sweeper and
bicycle. thrown from her bicycle when he was sweeping
the streets and had been taken to the doctor.
He enclosed bill for $12 . for doctor's services
and asked that the Town pay the same.
Report of the accident was received from
the street sweeper, Mr. Meehan. The Boq.rd
decided to pay the bills for the doctor s care
provided Mr. Walker signs proper releases to
the Town.
The Board voted to construct a sewer

only a connection.
Mr. Blake reported that there were only two
or three pieees of furniture at the Alm House that

The Board requested him to dispose of these
nieces and obtain what he could for them.
Supt . of Public Works was re ue�ted to stop

dumping on Pleasant Street, inasmuch as complaint
Dumps. had been received of this dumping. He stated
that signs had been placed Caere, but had been
removed by parties unknown but he would endeavor
again to post the dump and stop any refuse being
placed there.
Commitment. Commitment in the amount of $1841.48 was
signed for sewer assessments on Waltham Street.
The Board signed sewer orders for Belfry
Sewer Orders . Terrace and Smith Avene which are as follows :
ORDER OF 'TAKING BY THE TOWN OF LEXINGTON
OF RIGHT OF WAY AND EASEMENT UNDER CHAPTER
504 OF THE ACTS OF 1897 AS AMENDED.
Belfry Terrace.
WHEREAS, by Chapter 504 of the Acts of the
year 1897, entitled "An Act to authorize the Town
of Lexington to construct a system of sewerage, "
the same being hereinafter referred to as "said
Act," said Town was authorized, among other
Belfry Terrace things, to lay Gut, construct, maintain and
operate a system of sewerage, with the powers and
authority set forth in said Act, including full
power to take by purchase or otherwise any lands,
rights of way and easements in said Town necessary
for the establishmenttherein of a system of sewerage
or sewage disposal or for any of the purposes

mentioned in Section 1 of said Act; and
WHEREAS said Town of Lexington duly accepted
said Act in the manner provided therein; and
WHEREAS the system hereinafter referred to as
about to be constructed, and plans showing in detail
the work to be done in constructing the same, have
been duly approved by the State Board of Health; and
WHEREAS, by Chapter 277 of the Acts of the year 1909,
which was duly accepted by a majority of the voters of
said town in the manner provided in Section 5 thereof,
the then Board of Water Commibsioners of said Town
and the Board of Sewer Commissioners elected under the
provisions of said Act ( Chapter 504 of 1897) were
consolidated in one Board to be called the Board of
Water and Sewer Commissioners, with the provision
that all the powers and duties of said Board of Sewer
Commissioners should thereafter devolve upon said Board
of Water and Sewer Commissioners; and
WHEREAS, by Chapter 1 of the Acts of the year 1922,
which was duly accepted by a majority of the voters of
4 said town in the manner provided in Section 5 thereof,
the powers and duties of the Water and Sewer Commissioners
were assigned to the Board of Selectmen as a Board of
Public Works; and
WHEREAS, Albert H. Burnham, Theodore A. Custan ce,
Francis Chamberlain, Hallie C. Blake and Clarence
Shannon, citizens and residents of said Town, have
been duly qualified and are now the duly elected,
qualified and acting Board of Selectmen pursulint
to law and the provisions of the Acts hereinbefore
referred to, and
WHEREAS said Town, by vote passed at a town
meeting held on the eighteenth day of June, 1924
authorized and requested said Board of Water and
Sewer Commissioners (hereinafter referred to simply
as "the Board" ) to proceed under the provisions of
said Act as amended by Chapter 322 of the Acts of the
year 1913 and the acts referred to in the first section
thereof, to lay out, construct, maintain and operate
a sewerage system; and said Board has, conformably to
law and pursuant to said vote, laid out such system
and is about to construct the same; and
WHEREAS the system, as so laid out, required
the construction of a sewer in the location hereinafter
described, the same to be maintained and used as
part of a system of sewage disposal for a part of
said town; and
WHEREAS the location adopted for said sewer is
shown approximately in the following described line,
hereinafter called the "line of location", viz:

Beginning at a point in the easterly exterior ZS
line of Forest Street distant 20.00 feet northe
westerly of the terminus of a curve of 44.57 feet
radius in said easterly exterior line of Forest
Street thence north 26u 29' east distant 45±` feet.
For further description of the line of location
see plan by the Town Engineer dated July 2, 1929,
hereinafter mentioned and referred to.
And Whereas the right of way and easement
hereinafter described and taken are necessary for the
establishment of said system of sewerage and sewage
disposal and for the purpose of providing better
drainage as authorized by said Act;
Now then, said Board, acting for and in behalf of
saad Town, hereby takes under the authority of said
Act (Chapter 504 of the Acts of 1897 ) the following right
of way and easement, viz :
A right of way and easement, in and through the
land through which the line of locationnruns in Belfry
Terrace, for a sewer, including manholes and appurtenances,
said sewer to be laid and maintained intthe ground in
substantial accordance with said line of location.
The easement covered by this taking includes the right
on the part of the Selectmen of said Town, or other duly
authorized agents of the Town, to enter upon, dig up,
open and use the land embraced within said way as may
be reasonably necessary for the purpose of laying the
sewer, manholes and appurtenances initially and maint-
aining, operating, inspecting and repairing the same
from time to time thereafter; said Town being always
bound to see that the ground directly after the com-
pletion of the work in each case is cleared of all surplus
material, and surface left in as smooth and good condition
as at the time of entry.
The right of way shall include so much of the line
of such way as is necessary for the taking and purposes,
not exceeding twenty (20 ) feet on each side of the line
of location.
Betterments will be assessed for this improvement
in accordance with the provisions of Chapter 221 of the
Acts of 1926.
A plan made by John T. Cosgrove, Town Engineer, dated
Duly 2, 1929, entitled "Plan of Proposed Sewer in Belfry
Terrace, Lexington, Mass . , Scale 1 inch - 40 feet, July 2,
1929, John T. Cosgrove, Town Engineer", is hereby
referred to and made a part of the present description
of taking, which plan is to be recorded herewith in
the Registry of Deeds for the Southern District of
the County of Middlesex.
The area which it is expected will receive benefit

or advantage other than the general advantage to
the community from such improvement is described as
follows :
The same being lands of Fred A. and Walter M.
Stan Ward and shown on a plan showing Sewer Right of Way,
dated July 2, 1929, above referred to.
The said area comprises the several lots shown
upon the plan hereinbefore referred to, which are designated
in the schedule hereto annexed and made a part hereof.
We estimate the betterments that will be assessed
upon each parcel of land to be as shown in the schedule
which is hereto annexed and made a part hereof.
We determine that no damages have been sustained
and none are awarded.
To have and to hold said right of way and easement
to the Town of Lexington, its successors and assigns,
to its and their own use and behoof forever, agreeably
to the provisions of said
Chapter 504 of the Acts of
the year 1897, and any and all pertinent acts in amendment
thereof or supplemental thereto.
IN WITNESS WHEREOF the said Albert H. Burnham,
Theodore A. Custance, Francis Chamberlain, Hallie C. Blake,
and Clarence Shannon of the Board of Selectmen aforesaid,
have hereunto subscribed their names this 2nd day of

WAY AND EASEMENT UNDER CHAPTER 504 OF THE ACTS OF 1897

WHEREAS, by Chapter 504 of the Acts of the 'ye.r
1897, entitled 'An Act to authorize the Town of Ler-4-.1
ington to construct a system of sewerage", the same
being hereinafter referred to as " said Act, " said
Town was authorized, among other things, to lay but,
construct, maintain and operate a system of sewerage,
with the powers and authority set forth in said Act,
including full power to take by purchase or otherwise

work to be dine in constructing the same, have been 'duly
approved by the State Board of Health; and
WHEREAS, by Chapter 277 of the Acts of the year 1909,
which was duly accepted by a majority of the voters of
said town in the manner provided in Section 5 therd ,
the then Board of Water Commissioners of said Town
and the Board of Sewer Commissioners elected under
the provisions of said Act (Chapter 504 of 1897} were
consolidated in one Board to be called theBoard of
Water and Sewer Commissioners , with the provision that
all the powers and duties of said Board of Sewer Commissioners
should thereafter devolve upon said Board of Water and Sewer
Commissioners; and
WHEREAS, by Chapter 1 of the Acts of the year 1922.,
which was duly accepted by a majority of the voters of
said town in the manner provided in Section 5 thereof, the
powers and duties .of the Water and Sewer Commissioners were
assigned to the Board of Selectmen as a Board of Public
Works ; and
WHEREAS, Albert H. Burnham, Theodore A. Custance,
Francis Chamberlain, Hallie C. Blake and Clarence Shannon,
citizens and residents of said Town, have been duly
qualified and are now the duly elected, qualified and.
acting Board of Selectmen pursuant to law and the
provisions of the Acts hereinbefore referred to, and
WHEREAS .said Town, by vote passed at a town
meeting held on the eleventh day of March, 1929 authorized
and requested said Board of Water and Sewer Commissioners

to proceed under the provisions of said Act as
amended by Chapter 322 of the Acts of the year 1913
and the acts referred to in the first section thereof,
to lay out, construct, maintain and operate a sewerage
system; and said Board has, confomubly to law and
pursuant to said vote, laid out such system and is
about to construct the same; and
WHEREAS the system, as so laid out, require.d.
the Construction of a sewer in the location hereinafter
described, the same to be maintained and used as part
of a system of sewage disposal for a part of said
town; and
WHEREAS the location adopted for said sewer is shown
approximately in the following described line, hereinafter
called the "line of location", viz;
Beginning at a point in the northerly exterior line
of Fallen Road said point being opT)osite the northerly
terminus of Summit Road and running N. 370 57 ' 40" W.
distant 201± feet to a point of curvature, thence running
to the right with a curve of radius 570.00 feet distat 141'
feet to the end of the present sewer.
For further description of the line of location
see plan by the Town Engineer dated July 2, 1929, hereinafter
mentioned and referred to.
And Whereas the right of way and easement hereinafter
described and taken are necessary for the establishment
of said system of sewerage and sewage disposal and for
the purpose of providing better drainage as authorized

Now then, said Board, acting for and in behalf of
said Town, hereby takes under the authority of. said
Act (Chapter 504 of the Acts of 1897 ) the following
right of way and easement, viz;
A right of way and easement, in and through the land

for a sewer, including manholes and appurtenances,

easement covered by this taking includes the right on
the part of the Selectmen of said Town, or other duly

ing, operating, inspecting and repairing the same from

The right of way shall include so much of the line =�-

1929, John T. Cosgrove, Town Engineer," is hereby referred
to aid made a part of the present description of taking,
which plan is to be recorded herewith in the Registry

The area which it is expected will receive benefit

The same being lands of George F. Harrington, Robbins
& Smith, Inc. and Robert J. Kelley and shown on a plan
showing Sewer Right of Way, dated July 2, 1929, above
referred to.
The said area comprises the several lots shown upon
the plan hereinbefore referred to, which are rlPsignated
in the schedule hereto annexed and made a part hereof.

The weekly report of the Supt. of Public Works is
as follows:
For the week ending June 29, 1929.
Highway Dept.
The department was occupied with the construction of
Bedford Street, Hancock Street, and Massachusetts Avenue
at the Lexington Green. The loam in the bottom has been
excavated and sub-grade has been laid and crushed stone
applied.

Catch basins and gutters have been cleaned and surface
ZIE
patching has been done.
Next week the department will be occupied with work
on Mass. Ave. and Bedford Street, as well as the necessary
maintenance.
Moth & Shade Tree Depts.
This department has been occupied with the removal
of trees in Mass . Ave . and Clark Street and will continue
work on trees next week.
Park Dept.
Regular maintenance work carried on and will occupy
the department next week.
Supt. of Public Water Maintenance.
Works Report.
The following water eerVices have been installed:
Stockhaus, Spring Street; O'Connor and Quinn, corner of
Highland Ave. and Slocum Road; Ferguson, Highland Ave;
renewals installed to curb on Waltham Street; renewal
installed for Paul Revere Tavern to curb only; two men
were tieing in shut-offs.
Water Construction.
Finished extension of approximately 241 of 6" pipe in
Cliffe Avenue to connect new house of James Irwin, Jr. ;
laid approximately 501 of 6" pipe for swimming pool;
started extension of 12" water pipe in Mass. Ave. and Hill
Ave. ; unloaded eight carloads of 12" water pipe.
Sewer Maintenance.
Installed sewer services for O 'Connor and Quinn, cor.
Highland Avenue and Slocum Road; Ferguson, Highland Ave.;
Paul Revere Tavern ( to curb only) ; working on installing
sewer services to curb line on Waltham Street.
The work contemplated for the week ending July 13 is
as follows: water and sewer services; extension of water
main in Mass. Avenue and Hill Avenue .
Engineering Department.
Highways .
Grades for Bedford Street from Hayes Fountain to
Elm Avenue.
Grades for Hancock Street from Bedford Street to
Railroad property.
Lines and grades for curbing at the following
locations :
1. Percy Road and Tavern Lane.
2. Mass. Avenue between Pleasant St. and Oak St.
3. Southerly entrance to Curve St.
