HomeMy WebLinkAbout1929-06-11 239 SELECTMEN'S MEETING - JUNE 11, 1929. The regular meeting of the Board of Selectmen was held at the Selectmen's Room, Town Office Building on June 11, 1929 at 7:30 P.M. Messrs. Burnham, Custance , Chamberlain, Shannon and Blake were present. The Supt. of Public Works and the Clerk were also present . Hearing was declared open at 8 P.M. upon the application of Utrthi r E. Locke of 62 Farmcrest Avenue for permission-to build a private garage on his premises. Mr. Locke did not appear at the hearing. Mr. Thomas J. Doherty, however, Locke 's appeared and registered his objection to the garage location of the garage . application. He statedthat he felt it should be set back at least 20' from the line where Mr. Locke intended to place the garage. He stated that the reason the garage was placed where it is, is that it is necessary to fill the rear land. He felt , however, that the placing of the garage in the location intended was a detriment to his property; that is the reason he was objecting. The Board felt that if Mr. Locke placed his garage back further it would also be a benefit to his own nroperty and therfore voted to grant Mr. Locke a permit for his garage provided he set it back 20' from the line designated on the plan he filed with his application. Mrs. Anna Goloboy, her daughter and counsel Anna Goloboy, came before the Board to ask what Mrs . Goloboy milk business . would have to do to fix up her premises so that she could sell milk. The Board informed them that they would ask the Milk Inspector to visit their premises and give a notice in writing as to what was necessary to be done. It was voted to authorize the Supt. of Public Sewer Con- Works to start construction of sewers on Charles struction. Street from Cherry Street to Taft Avenue, and Taft Avenue to Baker Avenue, and in Baker Avenue to Oak Street. Letter was received from the Board of Health of the Town of Belmont in which they advised that an order hadbeen passed restraining dogs in the TOM of Belmont. It appears from the Police records that a dog owned by J A. Feirce on Merrett Road bad bitten Mrs. feirces ' servant and Restraining then got away and went pinto Belmont and had Dogs. bitten three or four persons in Belmont. The Board considered the matter of restraining dogs in Lexington and decided 1-o pass an order c� restraining them from June 15 to September 1, 1929. Letter was received from Frederick L. Emery, Chairman of the Planning Board, in which was incorporated the suggestion that before doing any Letter from work on Massachusetts Avenue, the Board consider Mr. Emery. putting in twin services of all public utilities in each side of the street so that the street will not have to be dug up to make connections for some time to come. The Board decided to acknowledge receipt of the letter. It was voted to pass the following orders for sidewalks: Mrs. Mary E. Newell, 20 Percy Road Heirs of Abram C. Washburn, Georgie A. Washburn, Extrix, 21 Parker StrBitt. Alex Ohlson & Signe E. Ohlson, 88 Bedford Street. Margherita Coscia, 90 Bedford Street. Sidewalk Celina V. Walsh, 1433 Massachusetts Avenue. Construction. Felix Viano, 1668 Massachusetts Avenue. Felix Viano, 1792 Massachusetts Avenue. Maria L. Bonney, 1437 Massachusetts Avenue Norman J. Pero, 847 Massachusetts Avenue. Letter was received from the Missess Frances & Sarah Robinson, 9 Stratham Road, in which they thanked the Board for fixing the drain in Massachusetts Avenue near the entrance to Stratham Road, but in Fence , Mass. which they also called attention to the condition Avenue . of the fence along Massachusetts Avenue andasked that the same be fixed. The matter w^s turned over to the Supt of Public works. Letter was also received from the Missess Frances & Sarah Robinson, 9 Stratham Road, stating Curb, Hayes that they understood that the curbing was to be Fountain. removed in front of the Hayes Fountain and the rocks replaced. Opinion of the Town Counsel was received in regard to the rules and regulations for acceptance of Town ways. The opinion was more particularly in regard to the meaning of the phrase "owners add mortgagees of at least 75% of the-propert*es abutting on said street". Mr. Wrightington stated that he felt this meant 75% of the properties and not 75% of the owners. The question also arose in regard to obtain- Option of ing the signatures of the mortgagees. This part Town Counsel of the regulations has never been lived up to' re. Town Ways ,and the question as to whether the regulations acceptance of. should. be changed or in the future the Board should obtain the signatures of mortgagees in all cases should be done. 234 �= It was decided to ask the opinion of the Town Counsel as to whether the regulations should be changed Striking out the tequirement for the signatures of the mortgagees or whether the regulations should stand , and the requirement for the signature of the mortgagees be carried out. Mr. Custance reported that he had a conference with Miss Ellen M. Tower and Miss Tower informed him that she would be willing to give a piece of her land at the Entrance t6 Pelham Road and Massachusetts Avenue , to widen out the curve provided the Town would take action to straighten Widen curve out the curve along Massachusetts Avenue on the at Pelham side opposite her premises near Pelham Road. Road. Mr. Custance stated that the proposition should be given some study so that the work could be done at a later date. Various other corners were suggested to be widened out to give a wide spread for entrance. Mr. Blake stated that he would give his land Giving of at the corner of Somerset Road at Meriam Street, land at turning to Hayes Avenue. He also stated that Mr. corners. Edward C. Stone would give land at the corner of Hayes Avenue and Hancock Street. Dr. Shannon suggested that the corner at Forest and Clarke Streets be widened in a like manner and also that a granolithic sidewalk be placed along the Hancock School property on various Clarke Street. It was also suggested that Vine Brook Road widening of at its entrance to Waltham Street be widened out. corners. The Supt. was authorized to make this widening and out in the curbing inasmuch as thi's work could be done without making any taking at the corner. The Board viewed the votes prepared for Town Meeting, June 18, and additional information is to Votes for be had on the construction of various streets Town Meeting. and on the Fire Department requests for appropriation before the meeting of the Appropriation Committee. The weekly report pf the Supt. of Public Works is as follows : For the week ending June 8, 1929. Highway Department. Applications of surfacing material, after the surface had been patched, smoothed and rolled, have been made on Lincoln Street-entire length, Spring Street-entire length, Hastings Road, Shade Street, Grant Street, and Sherman Street. Waltham F J eJ Street surface from Concord Avenue to Allen Street has been treated with Bermudez Asphalt covered with pea stone and rolled. The surfaces of Waltham Street and Woburn Street have been patched. Next week the department will be occupied with the regular maintenance. It is also intended to start the construction work on Mass. Ave. and Bedford Street between Waltham Street and Elm Avenue. Moth and Shade Tree Dept. The department has been engaged in the work of spraying the public trees and will be occupied with this and other maintenance work next week. Park Department. Drain from the location of the proposed swimming pool to Vine Brook has been completed. Regular maintenance work was carried on and will occupy the department next week. Water Maintenance. Supt. of Public Water services have been installed for the Works report. following persons : Robbins & Smith, Lot #42, Smith Avenue ; Morgen., Hancock Street; Leonard, Waltham Street; O 'Connor & Quinn, Highland Avenue; Webster, corner Grove and Burlington Streets; Cataldo, Bow Street; renewal for Brown, Vine Street. Water Construction. Unloaded three carloads of 8" water pipe, one carload of 10" pipe. Sewer Maintenance. Sewer services have been installed for the following persons : Robbins & Smith, Smith Avenue; O 'Connor & Quinn, Highland Avenue. Sewer Construction. Approximately 600' of 8" sewer pipe have been laid in Waltham Street. The work contemplated for the week ending June 22nd is as follows Waltham Street sewer; and water and sewer services. Engineering Department. Highways. Curb lines and grades established at the following places: Clarke Street at Library; 236 fronting Hayes Fountain; Mass. Avenue near Maple Street, Mass. Avenue between Curve Street and Pleasant Street. Sewers. Lines and grades for sewer at Waltham Street. Miscellaneous. Relocated connectingroad between Adams Street and East Street and Ledgelawn Avenue in the Dix Development. Granolithic grades on Bedford Street and Parker Street. Playground drain grades.
