HomeMy WebLinkAbout1929-01-22 1 6UL REGULAR MEETING, January 22, 1929 = A regular meeting of the Board of Selectmen was held at the Selectmen's Room, at 7:30 P.M. messrs. Burnham, Ballard, Chamberlain, Custance, and Robertson were present. The Clerk and the Supt. of Public Works were also present. Hearing on the application of Pasquale Moretti was declared open at 8 P.M. Mr. Frank Ramacorti, 73 Tremont Street, Boston appeared as attorney for Mr. Moretti and stated that Mr. Moretti built a house some time ago, and he understood that the section was going to be made into a two family district so that he built his house large enough to take care of two families. e stated that mr. Moretti had a family of ten Moretti chi13.en, and he was now deprived of the income he hearing - should receive from this house. he stated that he Zoning Law. had a tax bill of 164.00 to pay for the house, and he felt he should get something out of his invest- ment of $5,000. Be also stated that there were several other houses in the vicinity that were being used as two family houses which had been erected before the zoning Law went into effect, and he did not believe that the use of this house as a two family house would impair the status of the neighborhood. Be present,,d a copy of the petition showing names of owners of property in the vicinity and stated that he had sent a copy of the petition to the Planning Board without the addresses of the parties who signed the petition, with a request that the section be made a two family district. Mr. Benigo Santosuosso, Mr. Samuel Moretti mr. Louis C. Campbell, Mr. William C. Bartels, and Mrs. Mary E. Coghlan were also present. Messrs. Campbell and Bartels, and Mrs . Coghlan made the statement that they had signed the petition submitted, inasmuch as they were in favor of changing this section into a two family district. They did not feel that the present applicant should be allowed to disobey the law, but if the district was changed, they would be very glad to see him have a two family house. The Board made the statement that they would be willing to take the petition up with the Planning Board to see if some action could be taken in changing this° ection into a two family district. the Board, however, did not discuss the matter, and no action was taken on the hearing or on sending the petition to the Planning Board. Messrs. Stuart and Marshall of the Stuart, Marshall Realty Co. , together with their Architect, Stuart- came before the Board in regard to discussing the Marshall matter in relation to making negotiations about the Conference. Boutelle Block, so-called. 17 Mr. Elwyn G. rreston and Mr. Leroy Brown also appeared as citizens of the Town and as directors of the Lexington Trust Company. Plans showing the layout of Massachusetts Avenue was before the interested. parties. Messrs. Stuart and Marshall stated that they were ready to cooperate with the Board in moving the building back, but they desired to know definitely what was expected they should do, whether the set- . back would be 10, 20, or 25 feet. They stated that they figured that the amount they would be interested in in moving the building back 25 feet would be about $30,400; 20 feet about $25,300 and 10 feet about $15,900 Messrs. Brown and Preston both suggested that a set- back of 25 feet would be .excellent for the Town. Mr. Marshall stated that they might consider the erection of a new building in place of the old one if the consideration paid by the Town would be sufficient to warrant a new building. They might also consider a one or three story building. It was suggested that a pltht plan be sent to the Stuart-Marshall Realty Co. so that they may obtain from the plan the exact area on which to figure their proposition, and they could then present a more definkte proposition to the Board. he suggestion was made that the Stuart-Marbhall Realty Co. might possibly purchase the Engine House lot at a. later date. It was decided that the Town Engineer should bring before the Board next Tuesday night the official plan indicating the establishment of building lines on Massachusetts Avenue from the old Town Hall property to Woburn Street, also the continuous plan of Massachusetts Avenue from Woburn Street to Clarke Street drawn on the same scale as the Block Plan, indicating the present curb and property lines and the building line already established, also the County Commissioners ' plan showing the street line established by them from pot Park to Hancock Street, also the plan of the old Town Hall property indicating the portion of land sold by the Town and the portion r-tained. It was also suggested that the Town Engineer be requested to check up the areas on the sketch plan made by him for use at this meeting, and also to determine the exact dimensions and areas on the Fire Department lot on Meriam Street. In regard to the letter of Richard Mellen, of Boy Scouts the Boy Scout Council, it was decided to notify him Cary Hall. that the charity rate for the use of the halls on the dates requested by him would be made. It was voted that the use of the moving picture machine in either the C-ry Memorial Hall or Estabrook Hall shall not be subject to the reduced prices on the schedule for the rates of the use of these halls. It was decided to obtain the figures as tb the amount of money paid to the Town for the use of Cary and Estabrook Haln_s for the purpose of deciding whether only certain organizations will be allowed the use of the halls at the charity rate. 18 biD mg License was granted to the Hart Mohawk Trail Licenses Lines, Inc. to operate busses through the Town of Lexington. Satisfactory bonds haviagg been filed covering overhanging sign at 1745 Mass. Ave. and 1733 Mass . Overhanging Avenue, permits were granted to Forrest E. King and Signs. Rufus W. Blake respectively. It was decided to request the State Board of Health to make a survey of health conditions in the Health Town, inasmuch as it is understood thr,t the survey Survey will be made by the Department free of charge and with no obligation whatever to the town. The weekly report of the Supt. of Public Works is as follows For week ending January 19, 1929. Highway Department. Gravel was spread and graded on School Street, Allen Street, Blossom Street, Shade Street., and Park Drive. The department was busy cutting trees and preparing to cut back high banks on Grove Street. ' Truck plows and sidewalk plows were employed for snow removal on January 14 and 15. The conditions called for sand on bad grades and at a number of street corners and on sidewalks. Next week, the department will be occupied with the regular maintenance work, and if necessary, with snow removal. At this season, the employees of the Department are allowed two weeks vacations with pay, this being the best time of the year to allow the men to be away. Park- Department. Regular maintenance work carried on. Moth Department. Gypsy moth nests were treated with creosote in the Town Woods and on Lincoln Street. Tools were repaired am sharpened. Water Maintenance. About three hundred and twenty feet (320' ) of 12" pipe have been ]aid in Mass. Ave. , making a 4 ly toted of twelve hundred and seven feet (1207 ' ) of ripe laid. If the weather continues to be good, we contemplate working towards the completion of the laying of the 12" main in Mass. Avenue to Waltham Street. Engineering Department Water. Coolidge In regard to the aprlication of Harry L. gasoline Coolidge and Letitia Efnor to install gasoline tanks application at 107 and 109 Massachusetts Avenue, it was voted not to grant the permit. Meeting It was decided not to hold a meeting on February 12, Feb. 13. but to hold the regular meeting on February 13, 1929. Gossom sewer On recommendation of the Supt. of Public Works , abatement it was decided to abate the sum of $21. 23, same being a sewer assessment charged to Arthur D. Gossom. In regard to request for abatement on lot 68 on Prospect Hill Road , opinion of the Town Counsel was highway received whereby he stated that the Board could abate abatement the whole or part of the assessment on this lot and Lot 68 could assess the property when the street is con'strtacted by that lot. It was decided to request the Supt. of Public Works to prepare an abatement of the entire tax on Lot 68 20 G') It was decided to grant William A. Granfield a gasoline permit to locate two tanks on his Granfield premises , both being located aprroximately 40 gasoline feet distant from Warrett Road in accordance application with plan filed by Mr Granfield. t Buckley Daniel A. In regard to Mr. Worthen's letter, it was therefore decided to acknowledge receipt of his letter and to thank him for the information contained. therein.
