HomeMy WebLinkAbout1929-01-02 l REGULAR MEETING, JANUARY 2, 1929 II A regular meeting of the Board of Selectmen was ` held at the Selectmen 's Office at 7 P M. Messrs. Burnham, Uustance , Chamberlain and Robertson were present. The Sunt, of Public Works and the Clerk were also pre„gent The Board met at the Town Office Building and proceeded to the home of Miss Ellen M. Tower at Resolutions . 4 Pelham Road where they received from her the deed of the Tower Park located on Mass. Avenue opposite Miss Ellen her home, and which has been accepted by the Town, M. Tower. together with a check of $10,000. to be a fund for maintenance of said park. The Board presented to Miss Tower in return for the gift of the lend the resolutions adopted by the Town. Senator Joseph R. Cotton came before the Board and presented to them a form of proof of bill to be presented to the Legislature in connection with having a representative form of town government in the Town of Lexington. This form is substantially Petition similar to the form adopted by the Town of Winchester with some &light changes . IIIlegislature The Board expressed. the feeling that the Chair- re man of the Cemetery Committee should be included Rep. Town as a Town Meeting vember at Large . Government. The Board signed the petition to have the bill printed and placed before the Legislature, inas- much as Mr Cotton informed them that they would have ample opportunity to study the bill and suggest whatever changes they desire made when the bill .comes up for hearing. Hearing was declared open apon the application of Mr. Louis W. Bills for permission to build a three car garage with one story above the garage , the same to be placed in the rear of his present Louis W.Bills barn and facing on Coolidge Avenue. Mr. Bills together with Mr. Elmer Leonard hearing appeared before the Board to speak for the ap- plication. garage. Mr Bills stated that the final _plans were not finished in time to bring before the meeting, but that he would bring in the plans -,s soon as possible. The Board therefore informed him that they would take the matter up again next week. Letter was received from Mr. Neil McIntosh re- questing that he be given a hearing some time in January, 1929 so that he may talk with the Board in regard to highway betterment assessments upon his property. ' It was decided to request Mr. McIntosh to come 2 to the next meeting of the Board for e hearing. = In this connection it was also decided to Neil McIntosh lay over the matter of abatement of assessment on lots on Prospect Hill Road as requested by Highway '`yrs . hazel M. Barry and. Mr. Charles Harold, inasmuch as Ar. McIntosh desires to consult : Assessments , with the hoard in regard to these lots. The weekly report of the Supt. of Public Works is as follows : For week ending December 29, 1928. Highway Department The Highway Department was occupied with regular maintenance wor'r cleaning streets , gutters , catch basins , patching street surfaces, cutting back narrow places in East Street. Next week it is planned to mace gravel, to fill ruts and low places in a number of the out- lying streets spreading and grading with road. grader. Moth Department. Gypsy moth nests treated with creosote on Watertown street, Bowman Street, Fern Street, and Follen Road . Report of Park Department. Supt. of Regular maintenance work carried on in this Public Department . Works Water Maintenance. Two men have been tying in services . A water service was installed for Roy Ferguson on North Hancock Street; water service for Walter Black on Bloomfield Street; water service for F. B. LeVally on Spring Street. Tater Construction. 'fork was started. on Friday, December 28 on the e7tension of the 12" water main j,-)b at the junction of Bedford Street and Elm Avenue. Sewer Construction. The Edgewood Road se•.'er job has been com- pleted, an ' a total number of 474 ' of nipe have been laid. The Hastings Road sew nr has also been completed , and 415 ' of sewer pipe have been laid. Three manholes have been constructed. in Edgewood Roar , and two manholes have been constructed in Hastings Roar . $ Sewer service for Trask on Massachuset s Avenue has been completed. The work contemplated for the week ending January 12 is as follows water and sewer services , continuation of the 12" main in Bedford Street. Engineering Department. Sewers Lines andgrades for construction at Edgewood Road. Highways . Completed Hill Stre-t survey from Bedford Street to Cedar Street. Miscellaneous. Completed plans showing location and dimensions of overhanging signs. Completed plan showing 54ft. contours within Marrett Road, Massachusetts Avenue, and School Street. Very truly yours , William S. The question of abatement of sewer assessment against the Russell House property was again brought before the Boa-d, inasmuch as no decision had been made on the matter. The report of the Supt. cf Public Works having Russell House shown that some of the property would be available for house lots on Woburn Street, and that 13,000 sq. sewer asses- ft. would not be available for use owing to the fact that it bordered the Railroad property, the Board ment. decided to abate the assessment on 13,000 sq. ft. of land which would amount to $202.85. Owing to the fact that the old Town Hall pro-Derty was used by the Town during the months of April , May and June, 1928, in accordance with agreement made with Solomon H. Rubin & Rose Seligman, owners of the property Abatement the Board voted to ab^te the tax against saidowners tax. in the amount of $415.00. In regard to the Town Meeting, January 7, 1929 , it was decided that the Chairman should make a brief state- ment at Town Meeting expressing the position of the Report on Board of b„lectmen in regard to the report of the Committee on the- Fire and Water Depa dr,ments , and in- Fire and form the meeting that the Board is entirely in accord Water Depts. with the report. In accordance with the vote of the Town "that II 4 the Selectmen should arnoint a committee of ten citizens who shall be representative of all sec- tions and conditions of the Town to unite with = the Plan-ing Board as "Committee for the Review of the Present Zoning By-Laws" to see if iteis n-cessary to add to, alter, correct or amend the present Zoning By-Laws" so that the Town as a Zoning Law whole may be substantially served and such meetings as may be held by said Zoning Committee be open to Revision the public, and that said Committee report its recommendations as soon as it convenie-,tly Can, Committee. the Board decided to appoint the following committee William E. The Board discussed the application of William A. Granfieldfor gasoline tanks. The Chairman reported that he had been to 4. Granfield 's property and he indicated on the plan where Mr. Granfield was willing to place the tanks, the locati n of which was back of the building William A. now located on the property. It was decided to, request Mr. Granfield. to Granfield, either correct the blue print now on hand or nresent to the Board a new plan drawn by an Gasoline tanks. engineer to scale , designating the exact location of the tanks, and the Board would then take the matter under consideration further. Forest Warden It was decided to apnoi -t Osborne J. Gorman as appointed. Forest Warden. Letter wan received from the Town Counsel in which he advisedthat if the Board int,nds to have a hearing on the Moretti apnlication, they might as well Moretti have a public advertised hearing. After considering the matter, the Board decided application, to advertise a public hearing, andto notify the immediate abuttors and the parties who had previously 2 family house. objected to the house being used as a two family house in a single family district. The hearing is to be held on January 22, 1929 at 8 P.M. the Board discussed sidewalk bills of Harry M. Aldrich for sidewalk at the junction of Waltham Street and Mass. Avenue in the amount of $259.15, Rubin & Seligman for sidewalk work in front of the new block Sidewalk bill on Mass . Avenue opposite Waltham Street in the amount $346.50, and Theodore A. Custance for work on Audubon Road in the amount of $344.93. After discussing the matter quite completely as to whether the methodof procedure w^ s entirely correct to let the contractor do the work and charge it to the Town, Mr. James G. Robertson informed the Boars that it was a customary occurrence for sidewalk work to be done in this manner as long �v�p V as it was done to specification. It was also felt that the abuttor would not receive any financial benefit from the layout of a sidewaly along the property. II it was therefore decided to arnrove these bills for pnyment. The following commitments were signed: Water & Sewer Water Rates $6456.26 Sewer Rentals 266.44 CommitmentS4 Sewer Rentals 1055.48 In regard to renewal of insurance, it was found that during the month of January, 1929 the following policies expired: Insurance Jan. 14, 1929 , George W. Taylor & Son, $18,284 Jan. 14, 1929, E. A. Lord & Co . 19,400 Renewal Jan. 15, 1929, Arthur A. Marshall, 19,400 It was decided to hand to Joseph Swan the insurance held by George W. Taylor & Son but to renew , the insurance held by Elmer A. Lord & Co. and Arthur A. Marshall. Cary P emorial The Supt. of Public Works presented 'forms ibr application for the use of the Cary Memorial Building Bldg. rental. and license for same w ich were approved by the Board. I The Board also an-roved form of license for License , transportation of garbage through the Town, and garbage trans- votedto make a charge of $1.00 for the license. nertation. The following licenses for the pasteurization of milk were signed Pasteurication F. H. Reed Lowell Street Swenson Brothers 210 Marrett Road. of milk Both licenses were annroved by the Health linenses. Inspector. The Supt. of Public Works reported that the Water Department was proceeding very well on the laying of the water main in Mass . Avenue from Elm Avenue, but hadreached the point where some Mass. Ave. ledge was encountered near the Buckman Tavern. He requested permission to continue with the Water Main. work, inasmuch as the traffic donditions were ideal. The Board therefore voted to authorize the Supt. of Public Works to order 1,800 feet of pipe and proceed to lay the pipe to the High School and there to connect with the 12" main IILetter was received from Mr. Frederick L. Criticism Emery in which he stated that at some of the hearings previous to the Town Meeting held for Selectmen, the purpose of discussing the prlpesed amendment 6 isC to the Zoning Law, there were objections on the G'" part of the re'ple present , and some of the lafJamo objections were that the Board of Selectmen do not give tnrties appearing before the-i, any satisfaction, and that it was useless for them to a-real to the Boar-1 o ' Selectmen, inasmuch as trey did not get any actinn.
