ADUOURNED SPECIAL MEETING, NOVEMBER 16, 1928.

An ad-6ourned hearing was held at the Selectmen's Room on
November 16, 1928 at 7:30 P.M. Messrs. Burnham, Chamberlain '
Custance and Robertson were present.
The Town Engineer, John T. Cosgrove, the Supt. of Public
Works, William S. Scamman, and the clerk pro -tem were also
present.
Estimates were presented on the following streets Baker
Bennett, Butler and Chase Avenues leaving off the assessment on .
the ;cart of each street which was suggested last week. The cost
per foot was not changed.
Mrs. August N. Nicklarson, 156 Tarvell Avenue, thought that
$3.00 per foot was too high, and she was informed.that this price
is the outside figure for the work.
Mr. Joseph L. Dalkastrom stated that he would be willing to
pay 50% of the cost of building the street, but he felt that 100%
betterment was high. He stated that the Town would receive some
benefit from the construction of the street for fire purposes.
Mr. Carlson asked why the figures were less than last week
and he was informed that the ends of Baker, Bennett and Chase Avanues
were left off,
Mr. Henry Bowker, 48 Baker Avenue, asked if the Town I could not help the abuttors to lay out the street by standing
one half of the expense.
Petitions were presented WXd the persons present were asked
to sign same if they wished the streets laid out.
Commitment was signed for unapportioned highway betterment
assessments in the amount of $200918.78.
The Board signed the order of the layout of Bennett Avenue
as follows:
COMMONWEALTH OF MASSACHUSETTS
Middlesex, ss. Lexington, M#ss., Nov. 16, 1928.
Town of Lexington, Selectmen's Room.
At a meeting of the Board of Selectmen of the Town of Lexington,
after having given written notice 6f the intention of said Board., as
required by law, to lay out as a Town way Bennett Avenue from Baker
Avenue to Chase Avenue two hundred feet 200.00) more or less,
all as hereinafter more fully appears, and after public hearing
thereon held on the 16th day of November 1928 and no objections
having been made;
Now upon consideration of the matter, it is
ORDERED: that the Board of Selectmen is of the opinion that

public necessity and convenience require that said Bennett Avenue
be laid out and established as a public town way, and the same
hweeby is laid out and established as a public town respectively
as follows
The northerly line of Bennett Avenue begins at its junction
with the easterly line of Baker Avenue, thence south 440 301,
east distant 200.00 feet to its junction with the easterly line
of Chase Avenue.
The southerly line of Bennett Avenue begins at its junction
with the easterly line of 'Baker Avenue, thence south 440 301
east distant 200.00 feet to its junction witIg the easterly line
of Chase Avenue. .
The above deseril;ed lines are parallel with and distant 40.00
feet from each other.
The above description is intended to conform to the plan
of said street entitled, "Plan of Bennett Avenue, Lexington, Mass.,
Scale l inch - 40.feet, October 25, 1928 John T. Cosgrove, Town
Engineer," which plan is on file in the town Clerk's Office in
said Lexington and a copy of wrich will be recorded with Middlesex
South District Deeds with a cony of this order.
And said Board having considered the question of damages
sustained by the owners of lands across and through which said
ways have been laid out and established as aforesaid, hereby
determines that no damages are sustained and no damages are
awardedip and said Board hereby declares that all acts done herein
are done under the provisions of law authorizing the assessment of
betterments.

The Board signed the order of the layout of Baker Avenue as
follows:
COMMONWEALTH OF MASSACHUSETTS.
Middlesex, as, Lexington, Mass., November 16, 1928.
Town of Lexington, Selectmen's Room.
At a meeting of the Board of Selectmen of the Town of Lexington,
after having given written notice of the intention of said Board,
as required by law, to lay out as a Town way Baker Avenue, from
Oak Street to Butler A,.,enue eight hundred and ninety feet (•890.00)
more or less, all as hereinafter more fully aprears and after public
hearing thereon held on the 16th day of November 1928 and no objections
having been made;
Now upon consideration of the matter, it is
ORDERED: that the Board._of Selectmen is of the opinion that

public necessity and convenience require th-=t said Baker Avenue
be laid out and established as a public Town way, and the same
hereby is laid out and established as a public Town way res-
pectively a s follows:
The westerly Line of Baker Avenue begins at its junction '
with the southerly line of Oak Street, thence south 45 30t
west distant 890.00 feet to its junction with the southerly
line of Butler Avenue.
The easterly line of Baker Avenue begins at a point opposite
the junction of the westerly line of Baker Avenue with the southerly
line of Oak Street, thence. south 450 30+ west distant 890.00
feet to a point opposite the junction of the westerly line of Baker
Avenue with the southerly line of Butler Avenue,
The above described lines are parallel with and distant 40.00
feet from each other.
The above description is intended to conform with the plan of
said street, entitled "Plan of Baker Avenue, Lexington, Mass.,
Scale 1 inch - 40 feet, October 25, 1928, John T. Cosgrove, Town
Engineer," said plan fa divided into two lengths on sheets numbered
one and two which plan is on file in the Town Clerk's Office in
said Lexington and a cony of which will be recorded witl- Middlesex
South District Deeds with a copy of this order.,
The said Board having considered the question of damages
sustained by the owners of lane's across and through which said
ways have been laid out and established as aforesaid, hereby
detemfffines that no damages are sustained and no damages are
awarded, and said Board hereby declares that all acts done
herein are done under the provisions of law authorizing the
assessment of betterments.

The Board decided not to pass an order to lay out Chase Avenue
and Butler Avenue.
The hearing was declared closed at 8:10 P.M.
