MEETING, BOARD OF SELECTMEN
September 19, 1928.
Meeting of the Board of Selectmen, acting as a Boars of
Health, on September 19 , 1928 at 6 :15 P.M. at the driveway
of the Sand Pit on the farm of Charles W. Ryder the following
members of the Board of Selectmen were present. Messrs. Albert
H. Burnham, Chtirman, William H. Ballard and Theodore A. Custance,
Sydney R. Wrightington, Town Counsel, Dr. William L. Barnes,
Board of Health Physician, and Edward Lennon, Police Officer were
also present. Mr. Theodore A. Custance was appointed clerk pro
tem at the meeting.
The Board viewed the two piles of refuse on the property
and found that the piles were covered with maggots and flies.
Dr. William L. Barnes reported on the case as follows :
It is my opinion that the storage of swill and manure
on this land as it is today is almanacs to the public
health for the following reasons:
(1 ) The numbrous tin cans are an ideal breeding place for
mosquitoes and flies .
(2) The piles of refuse are alive with maggots, fly larvae
and flies.
(3) There is also the possibility of the contamination of
the
brook which runs by this point with surface drainage
from these piles of refuse.
Dr. William L. Barnes was requested to confirm his verbal
report by written report. Copy of his written report is annexed
to the record of this meeting.
After hearing Dr. William L. Barnes ' report, on motion of
Mr. William H. Ballard it was voted that the Board is of the
opinion that a nuisance, source of filth or cause of sickness,
is found upon the said premises, and that the dump contains
offensive material, that the Board considers that a week is a
reasonable time within which to remove same , and further voted
that the owner or occupant of the said premises be ordered, at
his own expense, to remove the same, and,ftrther voted that nobice
be served under General Laws, Crhpter 111, Section 123 upon the
owner and occupant to remove the nuisance within one week from
the date of service of such notice.
It was further voted to adopt the form of ruder submitted
to the Board September 18, 1928 by the Town Counsel which reads
as follows:
ORDER OF THE BOARD OF HEALTH.
Rhe- Board of Selectmen of Lexington, acting as a Board of
Health, under Sections 122 and 123 of Chapter 111 of the General
Laws, and of any other power them thereto enabling hereby order

you as owner or occupant of the premises adjacent to the
Lexington Reservoir and Marrett Road, Lexington, Massachusetts
at your own expense, to remove the nuisance, source of filth
or cause of sickness consisting of a pile or piles of refuse
found thereon within one week from date of service of
this notice.

Written report of Dr. William L. Barnes:
In confirmation of my verbal opinion given to you this day
while on a visit of inspection of conditions on the land immediately
adjacent to the Lexington Reservoir between the latter and Lincoln
St. , it is my opinion that the storage of swill and manure on
this land as it is today is a menace to the public health for
the following reasons:

and flies.
(3 ) Thereis also the possibility of the contamination of the
brook which runs by this point with surface drainage
from these piles of refuse.
