REGULAR SELECTMEN 'S MEETING
August 7, 1928.
Regular meeting of the Board of Selectmen was held at the
Selectmen 's Room at the Town Office Building at 7 30 P.M.
Messrs. Burnham, Custance, Robertson and Chamberlain were present.
The Supt. of Public Works and the Clerk were also present.
The records of last meeting were approved.
Hearing was declared open upon the application of Hallie C. Blake
for permission to erect a garage at 29 Harding Road. Mr. Blake appeared
for the petition, and as no persons appeared against it, it was voted
to grant him a permit to maintain a garage
At the request of the Board, Mr. Hallie C. Blake and Mr.
George L. Gilmore, donors of the "Honor Roll" which stands on the Town
Hall Lot came before the Boardto talk over the matter of moving the
"Honor Roll" or disposing of it in some manner.
Mr. Gilmore statedthat he felt the monument should hot be
placed upon RevIlutinnary grounds , but he suggested that it might
possibly be placed upon the park in front of the depot, inasmuch as
t1 is Memorial is a temporary one .
Mr. Custance informed them that it would probably cost $200
to move this Memorial inasmuch as it would have to be taken down
and cleaned and it probably would be just as easy to rebuild the
stand rather than attempt to move it.
Mr. Blake suggested that a permanent Memorial similar to
the one that is located in Watertown Square might be located on •
the triangle in front of the Masonic Building, inasmuch as this
property was "No Man's Land. " As far as he could ascertain, this
triangle at the present time does not stand in the title of anyone,
and he felt therefore, it belonged to the Town. On this triangle he
thought that a large granite tablet could be placed and the names
of the eight dead heroes could be placed on the tablet at the base
and that this would be a very fitting Memorial. He stated that he
would be willing to contribute toward the expense of such a Memorial
and he felt that perhaps Mr. Leroy S Brown would likewise contribute.
it was suggested that the Moderator be requested to appoint a
Spanish War Veteran to take the place of mr. W. F. Young who
resigned and request that he call the Committee together, no that
the Committee on Veteran 's Memorial could organize .
Charles Healey was appointed as a special police until Sept. 1,
1928 for duty on Mass. Avenue Highway Construction Work.
Letter was received from the Chief of Police reporting the
accident of Officer James Lima, and stating that Mr. Lima was now
at the Peter Bent Brigham Hospital os a result of the injury
received by him while he was on duty.
The Boardfelt thot the proper thing to do would be to pay
his hospital bill.

Letter was received from the Edison Electric Ill. Co.
acknowledging receipt of the Board ' s order for increase in candb
power of the street lights from Woburn Street to Clarke Street,
and stated that the differende in the cost of this change to the
Town would be 31577.25 a year.
Letter wns received from James Prendergast in which he in-
formed the Board that he had now waited long enough to obtain
information as to whether he was to be granted a permit for a
filling station or not, and he desires some information from
the Board in regardto same. ast
The Board again discussed the application of ""r. Prendergast
and inasmuch as the Planning Board are intending to establish a
30 ft. set-back, it was "Voted th t Prendergast Brothers be
granted a permit for a filling station in accordance with the
application and revised plans , provided they will agree to sign
the necessary agreement to establish a building line as contemplated
by the Planning Board, and that Mr. Chamberlain be delegated to
communicate with Prendergast Brothers to affect said. agreement. "
Complaint was received from Andrew Preslly relative to I''r.
Wadman at the Edgewood, Hancock Street, allowing campers to camp
out upon his premises .
It was decided to call Mr. Wadman 's attention to the fact
that complaint was received in regard to the campers, and to ask
him to discontinue this practice.
It was voted to issue notes in the amount of 014,000 payable
in 14 years for sewer construction. This is the issue authorized
11at the Town Meeting held in March for the construction of sewers
in Tower Street, Independence Avenue Smith Avenue, Robbins Road,
Locust Avenue, Glen Road and Upland Road ..
It was also voted to transfer , 7500 from the Sewer Assessment
Fund to Sewer Construction.
This contract was carried out so that the sewer can be con-
structed in Tavern Lane and Eliot Road.
Letter was received from the Buckman Tavern Community As-
sociation in which they advised the Board that they intended to
open, in the Post Office wing of the Buckman Tavern, a tea room,
The Board advised the Association that they did not believe they
could grant a Common Victualler ' s License to them, inasmuch as the
property was in a residential district under the Zoning Law.
The Board signed orders for sidewalk work to be done on the
following streets

ORDER OF TAKING BY THE TOWN OF LEXINGTON OF RIGHT OF WAY
AND EASEMENT UNDER CHAPTER 504 OF THE ACTS OF 1897
AS AMENDED
TAVF4 N LANE TO MAIN SEWER, MASSACHUSETTS AVENUE.
WHEREAS, by Chapter 504 of the Acts of the year 1897, entitled
"An Act to authorize the Town of Lexington to construct a system of
sewerage, " the same being hereinafter referred to as "said Act,"
said Town was authorized, among other thingsto lay out, construct,
maintain and operate a system of sewerage, with the powers and
authority set forth in said Act, including full power to take by
purchase or otherwise any lands, rights of way and easements in said
Town necessary for the establishment therein of a system of sewerage
or sewage disposal or for any of the purposes mentioned in Section 1
of said Act; and
WHEREAS said Town of Lexington duly accepted said Act in the
manner provided therein; and
WHEREAS the system hereinafter referred to as about to be
constructed, and plans showing in detail the work to be done in
constructing the same, have been duly approved by the State Board Of
Health; and
WHEREAS, by Chapter 277 of the Acts of the year 1909, which
was duly accepted by a majority of the voters of said. Town in the
manner provided in Section 5 thereof, the then Board of Water
Commissioners of said Town and. the Board of Sewer Commissioners
elected under the provisions of said Act ( Chapter 504 of 1897 )
were consolidated in one board to be called the Board of Water and
Sewer Commissioners , with the provision that all the powers and
duties of said Board of Sewer Commissioners should thereafter devolve
upon said Board of Water and Sewer Commissioners; and
WHEREAS, by Chapter 1 of the Acts of the year 1922, which was
duly accepted by a majority of the voters of saidtown in the manner
provided in Section 5 thereof, the powers and duties of the Water
and Sewer Commissioners were assigned to the Board of Selectmen
as a Board of Public Vtiorks; and
WHEREAS, Albert H. Burnham, Theodore A. Custance, William H.
Ballard, James G. Robertson, and Francis Chamberlain, citizens and
residents of said town, have been dyly qualified and are now the
duly elected , qualified and acting Board of Selectmdn pursuant
to law and the provisions of the acts hereinbefore referred to, and
WHEKEAS said Town, by vote passed at a town meeting held on the
twenty-eighth day of June, 1928, authorized and requested said

Board of Water and Sewer Commissioners (hereinafter referred to
simply as "the Board" ) to proceed under the provisions of said
Act as amended by Chapter 322 of the Acts of the year 1913 and the
acts referred to in the first section thereof, to lay out, construct,
maintain and operate a sewerage system; and said Board has, conform-
' ably to law and pursuant to said vote , laid out such system and is
about to construct the same; and
WHEREAS the system, as so laid_ out, required the construction
of a sewer in the location hereinafter described, the same to be
maintained and used as part of a system of sewage disposal for
a part of said town; and
WHEREAS the location adopted for said sewer is shown anproxi-
mately in the following described line, hereinafter called the "line
of location," viz :
Beginning at a point in the southwesterly exterior line of
Massachusetts Avenue distant 2771-feet southeasterly of the inter-
section of said southwesterly exterior line of Massachusetts A-enue
with the southerly exterior line of Percy Hoad and running S 650
48 ' 10" W distant 267.35 feet to a man-hole in the center of a
private way, said private way being known as Tavern Lane. The
above described line passing through lands now or formerly of James
P. Munroe and Sumner Robinson, Trustees. For further description
of the line of location see plan by the Town Engineer dated April
30, 1928, hereinafter mentioned and referred to.
And Whereas the right of way and easement hereinafter des-
cribed and taken are necessary for the establishment of said
' system of sewerage and sewage disposal and for the purpose of pre.
viding better drainage as authorized by said Act;
Now then, said Board, acting for and in behalf of said Town,
hereby takes under the authority of said Act ( Chapter 504 of the
Acts of 1897 ) the following right of way and easement, viz;
A right of way and easement, in and through the land through
which the line of location runs in Tavern raze to Main Sewer,
Massachusetts Avenue, for a sewer, including manholes and appurtenances ,
said sewer to be laid and maintained in the ground in substantial
accordance with saidline of location. The easement covered by this
taking includes the right on the part of the Selectmen of said Town,
or other duly authorized agents of the Town, to enter upon, dig up,
open and use the land embraced within said way as may be reasonably
necessary for the purpose of laying the sewer, manholes and appur-
tenances initially and maintaining, operating, inspecting, and
repairing the same from time to time thereafter; said Town being
always beundd to see that the ground directly after the completion
of the work in each case is cleared of all surplus material , and
surface left in as smooth and good condition as at the time of entry.
The right of way shall include so much of the line of such way
as is necessary for the taking and purposes, not exceeding twenty ( 20 )
feet on each side of the line of location.
Betterments will be assessed for this improvement in accordance
with the provisions of Chapter 221 of the Acts of 1926.

John T. Cosgrove , Town Engineer, " is hereby referred to and
made a part of the present descDiption of taking, which plan
is to be recorded herewith in the Registry of Deeds for the Southern
District of the County of Middlesex.
The area which it is expected will receive benefit or adp
vantage other than the general advantage to the community, from
such improvement is described as follows
The same being lands of James P. Munroe and Sumner Robinson,
Trustees, and shown on a plan showing Sewer Right of Way, dated
April 30, 1928, above referred to.
The said area comprises the several lots shown upon the plan
hereinbefore referred to, which are designated in the schedule hereto
annexed and made a part hereof.
We estimate the betterments that will be assessed upon each
parcel of land to be as shown in the schedule which is hereto
annexed and made a part hereof.
We determine that no damages have been sustained and none are
awarded.
To have and to hold said right of way and easement to the Town
of Lexington , its successors and assigns, to its and their own
use and behoof forever, agreeably to the provisions of said Chapter
504 of the Acts of the year 1897, and any and all pertinent acts
in amendment thereof or supplemental thereto.

WHEREAS, by Chapter 504 of the Acts of the year 1897,

line of Pelham Road and mulling northwesterly 341 feet to a point
of curvature, thence running to the left with a curve of radius
490 feet distant 189.53 feet to a point of tangency, thence in a
northwesterly directinn distant 161.92 feet to a point of curvature,
thence running to the right with a curve of radius 181.93 feet
radius distant 83 t feet to a point about 10 feet southerly of land
of Lexington Historical Society. The above described line passing

thence in Tavern Lane to Eliot Road, and in Eliot Road from Pelham
Road to Warren Street, a distance of approximately 2,000 feet."
VOTED by the Selectmen, acting as a Board of Water and Sewer
Commissioners under the authority conferred by Statute 1897, Ch. 504
and acts in amendment thereof and in addition thereto, and of votes
of the Town of Lexington pursuant thereto, that a sewer be con-
structed in Eliot Road, from Massachusetts Avenue through land of
James P. Munroe and Sumner Robinson, Trustees, to Tavern Lane, thence
in Tavern Lane to Eliot Road, and in Eliot Road from Pelham Road to
Warren Street, a distance of approximately 2,000 feet, substantially
in accordance with a plan made by John T. Cosgrove, Town Engineer, dated
July 10, 1928 and entitled, "Plan of Proposed Sewer in Eliot Road,
Lexington, Scale one inch - 40 feet, John T. Cosgrove, Town Engineer."
Betterments will be assessed for this improvement in accordance
with the provisions of Chapter 221 of the Acts of 1929.
The area which it is expected will receive benefit or ad-
vantage other than the general advantage to the community from such
improvement is described as follows :
Both sides of Eliot Road from Pelham Road to Warren Street.

The Supt. of Public Works reported in regard to sdwer in
Glen Road that two persons on the street were in need of the
sewer and two persons were not.
It was therefore voted to lay this matter on the table for
one week.
Application for admittance of William Vidette, 59 Bow Street,
Lexington to Rutland State Sanitarium was signed by the Board.
The report of the Supt. of Public Works is as follows:
For week ending August 4, 1928.
Highway Department.
The reconstruction at Massachusetts Avenue and Cedar Street
has been completed. Massachusetts Avenue has been sealed from
Cedar Street to Wood Street. Cedar Street has been sealed from
Massachusetts Avenue to Hill Street. Drainage work on Simonds
Road is in progress. Next week, the department wil? be occupied
with the construction of Simonds Road and the regular highway
maintenance.
Park Department.
Regular maintenance work carried on during the past week, and
will be all that the Department will attend to next week.
Moth and Shade Tree Departments.
Brush cut on Lincoln Street and on the triangle at Marrett
Road and Lincoln/Street, on Massachusetts Avenue and School Street.
Trees were trimmed on Meriam Street and Bedford Street. There is
still enough of this work for several weeks.
Water Maintenance.
Services were installed for Mr.Connor on Marrett Road and
M. B. Judkins , Vine Brook Road; renewals installed for C. A.

The M. McDonough Co . , who is excavating with the ditching
machine for drainage purposes in Mass . Ave . , broke our 6" water main
in five different places during the week. These breaks caused
considerable expense and annoyance. While the water was shut off,
we installed two gates, one at Locust Avenue and one at Independence
Avenue, These gates will reduce the number of houses that will
be without water in case it is shut off in this district.

Water Construction.
Approximately 500 feet of 6" main has been laid in Franklin
Avenue and Crescent Hill Avenue . 235 feet of main has been
laid in Forest Court and one hydrant installed. 400 feet of
6" main has been laid in Ward Street, and about 300 feet of 8"
main has been laid inRobbins Road
Sewer Maintenance.
One sewer connection has been made to the curb at 165 Mass.
Avenue
Sewer Construction.
Approximately 300 feet of 8" pipe has been laid in Locust
Avenue; 75 feet in Independence Avenue through the ledge; 150
feet in Robbins Road.
Work Contemplated for Week of August 12, 1928
Tavern Lane sewer, water in Ward Street, sewer and water in
Robbins, Smith Development, a number of water and sewer connections;
sewer and water pipe to be laid to curb in Mass. Avenue at the
street contemplated to be built by Mr. Fred Moulton.
Engineering Department.
The activities of the Engineering Department of the week
ending August 4th were as follows :
Sewers.
Grades for construction at Independence Avenue and Robbins Rd.
Drains.
Marked grade stakes and set betters for Simonds Road.
Highways.
Checked Eliot Road layout as accepted.
Made sketch of suggested curve at junction of easterly line
of Eliot Road with the northerly line of Pelham Road.
Started survey at Percy Road and Maw. A`enue for release of
approximately 200 square feet from property of N . or F. Tyler.
Sidewalks.
Set line and grade stakes at 633 Mass, Ave. , 54 Bedford Street,
Ward property, Eliot Road and at #4 and 16 Berwick Road.
Miscellaneous.
Line on Woburn Street for garage location.
New house numbers for Belfry Terrace.

Renumbered Tower Street and notified owners.

Mr. Fred L. Emery came before the Board and stated that the
Planning Board had several projects on hand that they desired
to have the Engineers work on, and that they were unable to have
any of this work done owing to the fact that the Engineers were
doing other work for theTown.
The Board felt that additional assistance in the Engineering
Department might help out the work.
The Supt. of Public Works reported that he felt that perhaps
one or two men could be added to the force for a period of time to
assist in getting some of the work out.
Mr. Custance reported that the drainage system in the section
of Tavern Lane should be taken care of, and the drains brought
together at one point.
The meeting adjourned at 11:10 P.M.
