REGULPR SELECTMEN 'S MEETING
JULY 31, 1928.
A regular meeting of the Selectmen was held at the Selectmen's
Room at the Town Office Building at 7 30 P.M. Messrs. Burnham,
Custance, Ballard, Chamberlain and Robertson were present.
The Supt. of Public Works and the Clerk were also present .
The records of last meeting were approved.
Bids for sidewalk work, in accordance with the contract sent
out by the Supt. of Public Works were received as follows :

Walter G. Black, being the lowest bidder, was awarded the
contract at the sum of $2261.88 plus such extras as may need to be

done at the same unit price.
Mr. Frederick L. Emery, Mr. W. D. Milne, Clarence H. Cutler,
and J. Henry Duffy came before the Board at their request to dis-
cuss the application of rrendergast Brothers for a gasoline
filling station to be located at the junction of Fottler Avenue
and Mass. Avenue.
The Board explained that inasmuch as a building line was not
established on Mass. Avenue, that stores could be erected on the
street line , and they felt that it might be good business to
grant the application for a filling station at this location al-
though many filling stations existed in that vicinity.
Mr. Emery explained that he felt that the more filling
stations that were erected, the higher the cost of gasoliny,
inasmuch as these stations all have to be supported.
Mr. Chamberlain informed the meeting that ''ir. Prendergast stated
that he would have to put stores in right away if the gasoline
permit were not granted, inasmuch as he had his money tied up in
the land, and he would have to get some income from same, and he
would place the stores right on the street.
Mr. Emery felt that this was more or less of a threat, but
that possible negotiations could be made with rrendergast Brothers
to set the stores back, provided something were done by the Town
in the wayof an approach to the stores .
Mr. ffy felt that as far as a business proposition was

concerned and the return of the money invested, a filling station
or stores would be about a fifty-fifty proposition regarding
the income.
After discussing the matter quite fully, the Board voted to
lay the application on the table for two weeks . In the meantime ,
Mr. Emery agreed to consult with the Town Counsel to see if
proceedings could be started on the establishing of a building
line.
It was decided to invite the Veteran 's Memorial Committee
and the former Committee that constructed the present Memorial
on the Town Hall Lot to come before the Board on Tuesday evening
next to discuss the matter of moving the present Memorial.
The Board discussed the matter of Water and Sewer Survey quite
completely, Mr. Ballard having presented a letter from l'etcalf & Eddy
giving their proposal under date of July 17 , 1928 to make an
independent investigation and report on the advisability of combining
with the Mass. Department of Mental Diseases and the City of Waltham
and the Town of Watertown in constructing a loin# sewer in the Beaver
Brook Valley as outlined in the proposition of June 8, 1928, item one .
The Board discussed the advisability of employing Metcalf & Eddy
or Fay, Spofford and Thorndike from whom a bid was also received.
It was finally decided that the bid of Metcalf & Eddy was less
than Fay, Spofford & ihorndike and they being also a very reputable
concern, it was voted to employ them as Engineers, in accordance
with their letter of June 8, 1928 and July 17, 1928.
The application of William Viano for permission to erect a
marquise over the sidewalk at the Lexington Theatre was again taken
up, and it was voted not to grant Mr. Viano a permit to ereet the
marquise.
In regard to his request for a public hearing on the matter,
the Boar' decided. to notify Mr. Viano that inasmuch as they felt it
was for the best interests of the Town to again decline his
, application, they do not Lrlieve there would be anything gained by
granting his request for a public hearing on his application.
It was voted by the Selectmen, acting as a Boa^d of Water and
Sewer Commissioners under the authority conferred by Statute 1897,
Ch. 504 and acts in amendment thereof and in addition thereto, and
of votes of the Town of Lexington pursuant thereto that a sewer
be constructed in Glen Road, from Upland Road to Oakland Street;
Eliot Road, from Mass. Avenue through land of James F. Munroe and
Sumner Robinson, Trustees, to Tavern Lane, thence in Tavern Lane to
Eliot Road, and in Eliot Road from Pelham Road. to Warren Street,
substantially in accordance with plans made by John T. Cosgrove,
Town Engineer, dated July 1928 and entitled, "Plan of Proposed
Sewer in Eliot Road , Lexington , " Scale, one inch equals 40 feet,
John T. Cosgrove , Town Engineer, also plan dated , July 1928, entitled,
"Plan of Proposed Sewer in Eliot Road, Lexington, " Scale one
inch equals 40 feet, John T. Cosgrove, Town Engineer, and plan dated
April 30, 1928, entitled, "Plan and Profile of Proposed. Sewer in Eliot
Road & Tavern Lane, Lexington, " Scale one inch equals 40 feet, hor. ,
one inch equals 6 feet ver. , John T. Cosgrove, Town Engineer, and
plan dated April 1928 entitled, "Plan and. Profile showing Sewer Right
of :lay from Tavern Lane to Mass. Ave. , Lexington. " scale one inch
equals 40 feet hor. and one inch equals 6 feet ver. , John T. Cosgrove,
Town Engineer.
The Supt. of Public Works was therefore authorized to proceed
with the work of constructing the sewer.
In regard to the installation of a sewer in Glen Road, it whs
voted to lay this matter over for one week.
In regard to installation of sewRr in Hastings Road, it was =�

For week ending July 28, 1928.
Highway Department.
A drain has been placed across Waltham Street near C. W. Ryder's
driveway carrying the surface water into the land of Mr. Ryder from the
catch basins at this point. He would much prefer to have the water
run in on the low land than to have it stand in front of his driveway.
The street surface on Waltham Street, between Marrett Road and
about 200 feet east of Vine Brock Road, has been patched and sealed
with tar, covered With pea sbnne and rolled.
Curbing has been set on the northeast corner of Massachusetts Ave.
and Cedar Street, and the drain through land of Firs. H. C. Whittemore
on Massachusetts Avenue at Cedar Street completed, and street surface
is being prepared for final dressing and sealing.
Surface patches made in Lincoln Street, Watertown Street and
Massachusetts Avenue .
Drainage in Simonds Road, from rrescott Road. to Dexter Road has
been started.
The Department will be occupied with maint4nance work and
construction of Simonds Road during the next few weeks.
Moth and Shade Tree Departments .
Trees on Pleasant Street, Oakland Street and Lincoln Street
were trimmed. Brush was cut on dangerous corners, Lowell St. , East
St , Woburn St , Revere St. , Hancock St , Hill St. , and Cedar St.
This work will becntinued as there are many places in need of
attention.
Park Department.
Regular maintenance work is now occupying the Dept. ►s full time.
Water Maintenance.
One service installed in North Hancock Street. Four services
in Mass. Avenue where the new street is to be constructedhave been
renewed. There are nine services to be installed next week.
Water Construction.
Work has been started on laying a 6" water main in Crescent Hill
Avenue and Franklin Avenue. About 300 feet of pipe has been 3iid
and one hydrant has been set
Approximately 200 feet of 8" pine has been laid in Independence
Avenue, and about 150 feet in Locust Avenue. The Dent . will be
occupied with these three jobs next week.
Sewer Maintenance.
One service has been installed at 168 Mass. Ave. , and one
service has been lain to the curb only at 241 Mass. Ave. The
sewer recently laid in Lincoln Street and Audubon Road has been
flushed. One carload, of 6" pipe has been receivedand unloaded.
Sewer Construction.
280 feet of 8" sewer pipe has been laid inSmith Avenue, and
160 feet in Independence Avenue. 80 feet in Locust Avenue .
The Dept will be on the work in this locality next week, and
will also be ready to srabt construction of the sewer, either in
Tavern Lade, Eliot Road, or Woburn Street.
Engineeripg Department.
The activities of the Engineering Dept. for the week ending
July 28, 1928 were as follows :
Sewers
Grades for Construction at Locust Avenue, Independence Avenue and
Robbins Road.
Grades for house connections at Mass. Ave.
Highways .
Line andgrade for curb at Cedar Street.
Layout of Board of Survey line on part of Vine Street.
Line for abutter on Oak Street.
Sketches of suggested takings at Percy Road and Tavern Lane
where their join Mass. Ave .
Drains.
Grades for drain in Mass. Ave. , at H. C. Whittemore property.
Location of brooks near Tower property for possible drainage .
In Re Developments .
Two days spent on topographical survey at Star Realty Trust
Development.
Remarks.
To give the above mentioned ( line for abutter on Oak St. )
required the work of three men for an entire day. Lack of stone
bounds on Oak Street made it necessary to run the lines from
Chase Avenue along Taft Avenue and thence up Baker Avenue to
obtain correct Oak Street line .

Application was received from the Fuelite Natural Gas Corp. for
permission to ei,ect a building at the Sand Pit, North Lexington.
It was decidtd to set a hearing on the application and to
inquire of the Company whether or not they install their tanks
under ground in other locations, or whether they have the tanks above
the ground.
It was voted to authorize the Supt of Public .4orks to
install 600 feet of 6" water main in Ward Street and Garfield Street,
at the estimated cost of $1800.
The Board signed an order for extra work to be done in the „
amount of $150 for pointing up the culvert under Sickle Brook. 'his
is in connection with the contract for the re-building of Mass. Avenue
from Oak Street to Marrett Road.
The Supt. of Public Works reported in regard to the sewer on
the property of Ellen Tower that it required the construction of
600 feet of sewer and 3 man holes at the estimated cost of $3500.
The Board discussed the matter and felt that 43500 was a large
amount for one connection to a sewer and that there was no harm
in the cesspool remaining where it is at present in the Tower Park
and at a later date, if the property were developed, the con-
struction of a sewer would be done differently.
Thg Supt. of Public Works estimated. the cost of laying the drain
with 12 pipe, catch basin and outlet to be approximately #1200 to
take care of the surface water in the Tower Park.
The Supt. of Public Y°orks was requested to get additional
information in regard to the Tower drain.
The following commitments were signed:
3939.10 for Water Charges .
735.19 for Sewer Charges.
Letter ,was received from Albert B. Tenney of the Special
Committee to study the Fire and `"later Departments, stating that
the Committee was now ready to study the Water Supply and wondered
if the Board would be ready to have the Committee talk with the
Engineer to be employed under same .
The Supt. of Public Works reported. that application for a water
main had been received from James A. Nickerson, who desired to install
a water m&in through a right of way on his property located off Mass.
Avenue near Maple Street. Mr. Nickerson is building houses on the
stre,-t which was tentatively approved by the Board of Survey, bt<t
he was unable to secure the permission from Mr. Rothschild, owner
of the property where the stret is proposed to be located from Mass.
Avenue, over the land of Mr. Rothschild, and for this reason Mr.
Nicke"son desired to place a water main in the private way owned
by him, and the Town could continue a 6" water main in the proposed
street.
The Board felt th t inasmuch as they tentatively approved the
layout of the proposed street off Mass. Avenue, it would be better
to have a Board of Survey hearing and make a lout of this
street from Mass. Avenue over the land of Mr. Rothschild.
It was decided to advettise the hearing.

The Supt . of Public Works reportedthat the cost of �-
Ford Truck would be $987.85 and a Chevrolet truck $1078.00
to be used in connection with the collection of garbage.
He recommended that they purchase the Ford Truck inasmuch
as he felt that it would be more economical.
The Board authorized the Supt. of Public Works to purchase
the Ford Truck.
The meeting adjourned at 12:15 P.M.
