REGULAR MEETING, JULY WI 1928
IRegular meeting of the Board of Selectmen was held at
the Seiectments Room at the Town Office Building, at 7:30 P.M.
Messrs. Burnham, Custance, Robertson, Ballard and Chamberlain
were present. he Supt. of Public V rks and the Clerk were
also present.
The State Kid pay roll amounting to $26.00 was approved
by the Board. Hunt

It was voted to turn this application, together with plan,
over to the Planning Board for their study.
Application was received from William Viano for erection
of a marquise on the Lexington Theatre.
The application was laid on the table.
Contracts in duplicate were received from the State in which
the sown was to enter into a contract with them for the construc-
tion of Massachusetts Avenue from Oak Street to Marrett Road, under .
Chapter 90 of the General Laws.
It was decided to turn this contract over to the Supt. of
Public Worksfor him to look over d see if iis inproper form
and o get he corresponence together and find out whether t e ,
Countyyagreed to pay a like sum to the Town before they would sign
the contract.
Mr. Charles A. Henrich Drew Avenue, Mr. Louis C. Campbell,
Cliff Avenue and Mr. W. C. Bartels 42 Cliff Avenue came before the
toard to take several matters that they felt should be called to
he Board s attenion.
They stated that the garbage should be collected at their end
of the Town.
The Board informed them that they were at work on the matter
of establishing the garbage collection in that section of the Town.
air. Henrich also asked the Board about what was to be done about th4
widening of Bow Street. He said that it was some time ago since
he came before the Board in regard to this matter, and he thought
that something was to be done immediately. Nothing has been done,
and they feel that it is a dangerous condition and should be widened
at onee.
The Supt. of Public Works was requested to do some work on
fixing the culvert at Bow Street on Thursday of this week.

They made complaint of the violation of the Zoning Law and the
Building Law as follows:
P. Moretti of 80 Bow Street obtained a permit for a one family
3 dwelling and has three families living to the house. He has now
obtained a permit for a sun parlor located within 20? of the street
Moretti house on Melrose Avenue permit was granted for one
t III family house. The Building Inspector ordered him to tear the sink
out when he was making it into a two family house. He then
filed petition to the Planning Board to have the house turned over

to a two family house, and while permission was not granted, he C :
turned the house into a two family house, and it is now rented C7
to two fwmilies .
Moretti house 31aa Rindge Avenue next to Aquaro's house is
located 3' from the -treet line and three families live in the
house built within the last year.
On Albermarle Avenue a man named Cordillo who works for the
Town lives in a house without a cellar under it. They believe that
this house was not in compliance with` he Building Law and was a
menace to the community.
Off Fottler Avenue a house n_lw occupied by a colored man was
condemned by the Building Inspector and the previous owner sold
to the present occupant. The man is occupying without an occupancy
permit. He is using water that they feel should be condemned.
Pete Penta, 96 Bow Street, has built an outhouse in his back
yard. This they do not feel should be allowed by the Board of
Health.
They stated that the assessors assessed their property just
as high as if they were on Massachusetts Avenue, and they are not
getting any protection from the Building and honing Laws of the
Town inasmuch as they believe they are not enforced.
They also complained of Tony Cataldo of 62 Rindge Avenue who
works for the Town boasting that the Italian people in his section
of the Town could get what they wanted in the Town.
Mr. Campbell stated that Hillcrest Avenue had been laid out as
a 401 street, and he felt that the Board of Survey had made a
layout of the street at the width of 40' and that sometime ago
the width of the street had been increased to 50' in front of Mr.
Bartel' s house.
They also complained that there was no sign for Cliff Avenue
as you cross the R. R. tracks and come to the junction of Bow Street
and Cliff Avenue, and there should be a sign directing to Cliff
Avenue as well as Bow Street.
Four complaints were received in regard to the Ryder piggery
on Waltham Street from Caroline T. Reed of 72 Wachusett Drive
Ada � . Whitmore, 69 Wachusett Drive, Robert B. and Caroline R: Lane ,
151 Fair Oaks Drive and Mr. and yrs . F. W. Pierce, 77 Wachusett
After discussing the matter of complaints, the Board decidedto
premises to view the conditions .
"�r. Custance made report regarding his visit to the premises
on Sunday, July 15, 1928 in the afternoon as follows
On Sunday afternoon, July 15, 1928, I was called bn the
telephone by Pers . Whitmore, 69 Wachusett Drive, Fair Oaks section.
She complained about the great number of flies which were

around her building. At about 4:30 o' clock I went up to her
house :nd als. to Mrs . Reed' s, Wachusett Drive.
I found a great number of flies on the sunny side of the
buildings . Shealso made complaint about the odor of pigs which
they had at dirferent times curing the season.
From there I went to the Ryder piggery and went up on the
west side of the brood house where the sun was shining on it.
the day was exceptionally warm and bright and there was a great
number of flies of th same type as I found at the Whitmore
an Reed e d nces .. went through the building with my boy
and his chum, Char es Ward, and counted th total number
of pigs whichwas 602. The building was clean and in good shape
as far as piggeries go. After looking through the buildings, I
went down around the piggery^And on the two flat -forms where the
pigs are fed, there was a great deal of refuse and dirt.
From there I went up through the upper yard where they claim
th have 100 brood sows. I went down to the part of the field
where the pigs are and found several pigs wallowing th the mire.
I came back around the hill and back to the brood house and
about 60 feet from the brood house I found a small dead pig which
was polluted with flies.
At that time I met Mr. Freeman, foreman of the premises, and
he advised me that there were about 1100 pigs on the place at
that time. He also stated thetetkere was no garbage brought onv
the place on Sunday. While standing talking with him, a truck
drove in with a load of garbage which they proceeded to unload.
111 Mr. Freeman said that that load came from the Statler Hotel which
had had a break-down in their incinerator system, and they had been
called in to take care of the garbage and in that case they had to
go there on Sunday.
I left the premises about 6 o' clock.
The Board received a letter from the Town Vounsel in which he
made suggestions relative to the sidewalk proposal which was sent
to him for his approval.
It was decided to mimeograph a notice to Contractors so that
the forms could be used in the future.
The Supt. of Public Works was requested to send out to several
Contractors the proposals for sidewalks. Simpson Brothers and
Tomasello were suggested as names of bidders.
The Board discussed quite lengthy the contracts for garbage
disposal.
Letter was received from the Town Counsel giving his opinion
on this proposal, also, although not unanimously, the Board finally
decided upon Town collection of garbage with a charge of $1.00
to persons who desire this service.
The Supt. of Public Works was instructed to prepare a notice
to be sent to the parties living on the streets where he intends to
establish garbage collection* asking for information as to whether
they want the service and have the notice approved by the Board at
their next meeting Tuesday evening.

Highway Department.
Edgestones have been placed in the following locations:
Corner of Mass. Ave. and oak Street. , corner of Mass. Ave. and
Follen Road, corner of Mass. Ave. and Independence Ave. , and
in front of the block of stores at the corner of Mass . Ave. and
Independence Avenue.
Plainfield Street has been graded and treated with surfacing
material.
Sand was spread on Concord Avenue. Catch basins and gutters
cleaned on Mass. Ave. Patching work done on a number of stdeets.
A small amount of tar was applied to Cedar Street in front of
Mrs. Hennessey' s house. This was done to keep down the dust as
there is sickness in the house.
The Department plans to start the work of constructing Simonds
Road during the week of July 23rd.
Moth and Shade Tree Departments.
Trees have been trimmed on Lowell Street from Woburn Street to
Burlington Town Line, and on East Street and Audubon Road. The De-
partment plans to keep on at this work until it is finished.
Water Maintenance.
Three house services completed. Application has been made for
service in a house ._on Ward. Street. We were unable to make this
connection because a two-inch main in the street belongs to Mr.
James Barrett and he objects to anyone else tapping into the main.
Water Construction.
Approximately 250 feet of 8" water main laid in Independence
Avenue. Started extension of water main in Winn Avenue, and about
180 feet completed.
Sewer Maintenance.
rive services completed. Two others started.
Sewer Construction.
Sewer in Tower Street has been completed. In constructing the
sewer in Tower Street, it was necessary to cross an old culvert. It
has been cleaned out and repaired.
180 feet of 8" sewer pipe laid in Independence Avenue. About 40
feet laid in Lincoln Street.
Engineering Department.
The activities of the Engineering Department for the week ending
July 14 were as follows:
Sewers.
Grades for construction at Lincoln Street, Independence Avenue,
and Smith Avenue.
Drains.

Line for drain through Whittemore property. Line for drain
on Simonds Road from Dexter Road to rreston Road.
Sidewalks.
Set line and grade stakes after study for granolithic on Meriam
Street and Edgewood Koad.
Prepared 11 sketches showing location of proposed granolithic
work.

A great part of our time was spent at Massachusetts Avenue to
establish line and grade for curb at street intersections. A crew
of four men spent the greater part of each daya this work.

of Cedar Street and Mass. Ave. Line for new houses on Follen Road.
Line for wall at Ross property, Cedar Street.
Miscellaneous.
All members of the Deportment worked until 5 P.M. Saturday. In
return for this, only S. A. Higgins and I. will work on Saturday morking,
July 21st. should this be a convenient date to be without the other
four members of the Department.
Although I have spent several hours of all but two evenings in
addition to seven hours on Sunday, I have not been ablb to complete
sewer record plans for July 17th.
It is important, only, that I have same ready before construction
work begins,

Park Department.
Usual maintenance work carried on. In regard to the Swimming
Pool, the matter was taken up with the State Board of health, Who
wishes to come out and get the samples of water themselves.
They intended to come last Friday, but on account of rain did not come.
Consequently, the report on this is held up.
I expect to make a full report by next Tuesday night.

The Board decided upon a motor vehicle- for the collection of
garbage rather than horse drawn vehicle.
The Supt. of Public Works was also requested to draw up some a�
rules and regulations in regard to garbage.
Several letters were received from the Supt. of Public Works on
matters which he was requested to report on.
These were laid on the table for one week.

Mr. austance reported that Miss Ellen Lower' s cesspool is
located in the part whi _h she intends to give to the Town. ne
stated that she has been considering the proposition of connecting
the sewer, and he felt that something should be worked out so
that it might be possble to Connect up with the trunk line
near the Brock Robinson nursery Lo. and he was advised to look
into the matter.
ar. Custance reported that James P. Conroe has agreed to build
Tavern Lane to grade and stand all the expense for the construe-
tion himself:
the Supt. of Public Works was requested to take down the tree
in front of the Lougee house on Mass. Avenue near Joseph Road.
He was also requested to look at the tree in front of the Locke house
to see if it should be taken down.
