A regular meeting of the Board of Selectmen was held at the
Selectmen's Office at 7:30 P.i�l. Yessrs. Burnha,,:., Custance, Ballard,
and Chamberlain were present. The Supt. of Public Works and the
Clerk were also present.
The following commitments were approved, Water Dept. $14,553.42,
and Sewer Dept. $1,146.05.
Amos Holman came before the Board in reply to their request that
he sign a letter agreeing to get rid of his pigs on November 1, 1928
in connection with obtaining a slaughter license.
Mr. Holman was informed that Lr. B. Connors had already agreed
to get rid of his pigs on November 1, 1928, and the Board also felt
�hat.he should cooperate and get rid of his pigs.
Mr. Holman stated that he felt that to get rid of his pigs
on November 1, 1928 would be a hardship to htlm, but he would be
willing to get rid of them on May 1, 1929, provided he was allowed
to keep pigs for slaughtering.
Mr. Holman therefore signed the statement that he would get
rid of his pigs on May 1, 1929 and a permit to keep 100 pigs was
therefore granted to him.
Mr. Holman stated that he owned the water main from his house
and from which a number of water takers were drawing water and
inasmuch as it was only a 2" main they could not get any water pres-
sure. The Supt. of Public Works was requested to give Mr. Holman
an estimate of the cost of installing a 6" main.
It was voted to request the Supt. of Public Works to bring in
his recommendation as to what should be done in the way of taking up
the tracks and doing street work on Mass. Avenue along the property
which Ellen Tower intends to give to the Toiri.
It was suggested that he might figure upon placing a sidewalk
along this property, grass border, and qurbing.
Hearing was declared open upon the q)plication of William F. Downe
for permission to erect a one car garage at 286 Marrett Road.
The Building Inspector appeared to inform the Board that he
favored the granting of the permit.
No persons appeared to object, and it was voted to grant him a
permit.
Hearing was declared open upon the application of Prendergast
Bros. for permission to install a gasoline filling station of 2500
gallons at the corner of Fottler Avenue and Blass. Avenue in East
Lexington'.
• Mr. Prendergast presented plan showing the location and outline
of the building.
Mr. John A. Kenego of Brandon Street cppeared and spoke against
the erection of the Filling Station at this point, owing to the
danger to the children who go through Fottler Avenue every morning
on their way to school, and another filling station added to what was
already in the vicinity would certainly enganger the lives of the
children.
Mr. George F. 10,elick, 70 :"ass. Avenue, also appeared to object
to the filling station being located at the corner.

conditions have not changed since
Mr. Whalen made application.
The question was asked whether
or not L -r. Kenego would feel
that stores on both corners of
Fottler Avenue would be less
objectionable, and he stated that
he felt that they would, inas-
much as the cars would not be
continually driving in, and the danger
would be less.
The application was laid
on the table for one week.
Letter was received from the Supt. of Public Works in which he
informed the Board that the bills for rental of the Compressor
Machine for the month of June were $285, and he felt that it would be
well for the Town to purchase a Compressor machine wriich would cost
about $1980. The Board referred the matter back to ,1r. Scamman
with the request that he get bids upon the machine inasmuch as the
amount would be over $1,000.
Complaint was received fron. Harry G. Frost in regard to the con-
dition of the town dump on Lincoln Street. It was voted to request
the Supt. of Public Works therefore to "Fire" it and to erect two
signs warning persons against dumping organic matter on the dump.
It was decided to have a hearing on Tuesday evening next at
which time the Board will "

q r. Robert L. Ryder to appear
before them so that they may discuss the letters received from
George Gibson, Fred L. Lord, and William E. Mulliken in regard .
to the nuisance caused by the Ryder pigs.
It was also decided to request the Town Counsel to be present
at that time.
It was voted to instruct the Supt. of Public Works to install
seven street lights in Cary Avenue according to the authorization
of the Town at the Town Meeting on June 28, 1928.
Verbal application was received from Rubin & Seligman requesting
additional street numbers on Mass. Avenue on the Town Hall lot where
they intend to build.
The Town. Engineer some time ago suggested that Mass. Avenue be
re -numbered by his Department so that there will be enough numbers
for several years to come.
It was voted to request the Town Engineer to bring before
the Board a plan of what he has in mind in regard to renumbering
Mass. Avenue for its entire length through the town. ,
Mr. Custance brought up the fact that Mr. T. R. Keegan of Belmort ,
who has now purchased the Fitch estate on Nass. Avenue about opposite
the High School, states that his house is situated partly in the
roadway called Rowland Avenue. He suggested that if a street were
laid out that it might be possible that the Town will stand some
of the expense of the moving of the houserand presented figures
amoa ting.to $4,296.46 showing Lost of the moving. This was submitted
for the Board's consideration, but nothing was done about the
matter, however.

The Supt. of Public Works' report for week ending June 3J,
1928 is as follows:
' Highway Department.
Slocum Road oiled and covered with pea stone, and rolled.
Work completed. Adams Street oiled and covered with pea sbnne,
and rolled. Work completed. Spring Street sealed between Waltham
ar„d Lexington Town Line and Shade Street. Some work done at
Massachusetts Avenue and Cedar Street. Patching work done on
a number of streets. It is planned that the Department will install
the curbstones at the corndrs of various streets in East Lexini,ton
from Marrett Road to Oak Street, during week of July 9.
Water Maintenance.
5 House services completed. Hydrant on Cedar Street near
Massachusetts Avenue moved back. Hydrant on Massachusetts Avenue
opposite 131 Massachusetts Avenue moved back to conform with the
new street line to be constructed.
Sewer Maintenance.
Four house connections made during the week, and work of
flushing sewers is going on.
Sewer Construction.
Three -hundred feet of 8” sewer pipe laid in Locust Avenue,
i. and Tower Street. Two manholes constructed in Locust Avenue. Work
on Lincoln Street is progressing but slowly on account of the ledge
and water encountered.
The week commencing July 9 we have planned water construction
in Smith Avenue and Independence Avenue. Sewer Construction in
Tower Street and Independence Aventr,, and in Lincoln Street. Sewer
connections to be made in Lincoln Street and Audubon Road.
Moth and Shade Tree Department.
Spraying of all trees on public streets and public grounds
completed. We are now cleaning up the equipment and putting it away
for the season. When this is completed, it is planned that the
Department will start to trim trees and. remove dead limbs and dead
trees and bushes at dangerous corners.
Park Department.
Usual maintenance work carried on in this Department. The
play -ground supervisors h,,�ve taken up their work this week, which
will be continued for the balance of the season. until Labor Day.
' Engineering Department.
Activities of the Engineering Department for the week ending
June 30th were as follows:

Sewers.

Grades for construction at Lincoln Street, Tower Street, Locust
Avenue, and Independence Avenue.
Two days preparing plans for record of Glen Road, Hastings '
Road, Private Land, Tavern Lane, and Eliot Road. Double sets
of originals are required on the last two streets mentioned be-
cause property to be assessed is of Land Court record.
It was necessary to run out the westerly line of Massachusetts
Avenue from Pelham Road to Percy Road and the easterly line of
Tavern Lane from Eliot Road to Percy Road in order to locate
sewer right of way through private land. Levels of cess pool be-
longing`.;to R. Trask, Audubon Road.
Highways.
Figure curb lengths of intersecting streets along Massachusetts
Avenue from Oak Street to Mhrrett Road'.. Staked out Massachusetts
Avenue widening at Dennis J. Healy property.
Line and grade for new,house on Vine Street. Figure Whittemore

At a meeting of the Board of Selectmen of the Town of Lexington
held the 3rd day of July, 1928, it is
ORDERED, Whereas, the Board of Selectmen of the Town of Lexington,
having determined and adjudged that common convenience and necessity
require that a town wady be laid out in the location hereinafter des-
cribed and having complied with the requirements of law relating
to notice, did on the 19th day of June, 1928 lay out as a town way
the way known as7Prospect Hill Road from Marrett Road to Wachusett
Drive accordingly and duly filed their report of such laying out
with the boundaries and the measurements of the same in the office
of the Town Clerk of said town on the 20th day of June, 1928, and
whereas at a town meetinE duly called, warned and held on the
28th day of June, 1928 in accordance with the provisions of law
applicable thereto, it was,
VOTED: 'That the Town accept the layout as a town way of
Prospect Hill Road from Marrett Road to 'Nachusett Drive, as laid
out by the Selectmen, June 19,,1928, and shown upon a certain plan
on file in the Town Clerkts Office entitled "Plan of Prospect Hill
RomaY Lexington, Mass., Scale one inch equals 40 feet, John T.
Cosgrove, Town Engineer," and further voted t -hat the sum of $59000.
be appropriated and assessed for the purpose of constructing said
street.
NOW, THEREFORE, we, the undersigned, being a majority of the
Board of Selectmen of the said Town of Lexington, duly elected,
qualified and acting as such, do hereby under and by virtue of the
provisions of Chapter 79 of the General Laws and of any and every other
power and authority us hereto in any way enabling, take the right or
easement to use for all the purposes of a town way for the use of
said Town of Lexington, the land in said town bounded and described
as follows:
The easterly line of Prospect Hill Road begins at a Massachu-
setts,Highway Bound in the northerl-v line of Marrett Road (Formerly
Middle Street) near Waltham Street and thence north 880 26t west
along a line tangent to the curve of said westerly line of Marrett
Road at said Massachusetts Highway Bound distant 89.53 feet to
a point of curvature thence bearing to the right with a curve of
597.51 feet radius distant 274.81 f6bt to a poii+mttof compound
curvature thence bearing to the right with a curve of 1933.40 feet
radivaodistant 209.20 feet to a point of compound curvature thence
bearing to the right with a curve of 516.13 feet radius distant

The above description is intended to conform to the plan of
said street, entitled "Plan of York Street, Lexington, Mass., Scale
1 inch equals 40 feet, June 5, 1928, John T. Cosgrove, Town Engineer,"
which plan is on file in the Town Clerkts Office in said Lexington and
a copy of which will be recorded with Middlesex South District Deeds
with a copy of this order.
All trees upon the land taken are included in this taking.
Betterments are to be assessed for this improvement.
