REGULAR MEETING, JUNE 190 1928.
A regular meeting of the Board of Selectmen was held at the
Selectments Room, New Town Office Building. Messrs. Burnham,
Ballard., Custance,-Chamberlain, and Robertson were present. The
Clerk and the Supt. of Public Works were also present,
Hearing was declared open at 8 P.M. upon the application
for the change in. name of Belfry Terrace, legal notices having
been inserted in the local newspaper in this case, and hearing
held in accordance with the provisions of Chapter 85, Section 3,"
if'the General Laws as amended by Chapter 71 of the Acts of 192%
r. Roy A. Ferguson appeared in favor of the petition, no per-
sons appeared against it and it was voted to sign the order for
the change in name, and to file same together with the plan at
East Cambridge.
Mrs. Anselm A. Mullen of 51 Massachusetts Avenue, came be-
fore the Board in regard to the action of the Board on the ap-
plication of Anselm C. Mullen to increase the capacity of his
gasoline tanks at 51 Massachusetts Avenue.
The Board informed Mrs. Mullen that they could not do anything
further toward granting her permission to increase her business
until she had aprlied for a change in the Zoning Law.
Hearing was declared open on the application of Calvin W.
Childs to increase the capacity of his -gasoline tanks 20,000
gallons. Mr. Childs appeared for the petition, but no persons
appeared to object, and it was therefore voted to grant him per-
mission.
The State Aid pay roll amounting to $32.00 was signed.

The Board approved the bill to cover the cost of the Town
Counsel's services in the Shaler case.

It was decided to request Mr. Ballard to have the engineers
present at a meeting of the Board on .Tune 21, 1828 for the purpose
of discussing matters pertaining to an engineering survey of the
grater and sewer areas of the town. It ms decided to requeapt Pay,
Spofford and -Thorndike to be present at 7:30 P.M., Metcalf' Eddy
at 8:30 P. M. and Mr. J. Leslie Woodfall and son, Harold C. Woad. -
fall, at 9:30 P. M.
The request of William viano-for a marquise in front of the
Lexington Theatre was again laid on the table for one week.

Y Letter was received from George E. Briggs in regard to the
Ware -Swift River proposition explaining thetp6bition of the bill
in the House of Representatives. He stated that the Senate Bill
favored by Mayor Nichols was.adopted by the House.
' Report was received from the Supt. of Public Works in regard
to garbage disposal. He stated that it would cost approximately
$9,000 to operate collection of garbage in the town a year, and
it would be necessary to obtain two trucks for this purpose and
services of four men to cover the more thickly settled districts
of the town.
It was decided to request the Supt. to look into the matter and
name definite routes which he felt should,be covered by town
collection of garbage.
The advisability of letting the garbage collection out to con-
tractors by the Town of Belmont in 1924 showed that.several of the
cities and towns collected by contract. It was also felt that it
was not in all cases satisfactory, although perhaps more economical.
It was decided to wait until more definite information is
bee6ived from the Supt. in regard to garbage collection, before
deciding the amount to be appropriated at the Town Meeting.
The weekly report of the Supt. of Public Works is as follows:
For week ending June 16, 1928.
Highway Department.
Repairing and surfacing of Highland Avenue completed, Winthrop
Road, Washington Street and a part.of Eliot Road repaired and
sealed. Percy Road repaired and surfaced between Warren Street and
Highland Avenue. Shade Street graded and patched. Adams Street
7graded, patched and rolled. Concord Avenue patched and surface
covered with sand and pea stone. Watertown Street covered with pea
stone and sand. Sherman Street, Somerset Road, Parker Street and
Massachusetts Avenue patched. Two catch basins constructed at the
corner of Slocum Road and Highland Avenue. Drain laid across
Cedar Street and a short distance on Massachusetts Avenue and two
catch basins are being constructed at this point.
Moth Department.
The spraying of trees to destroy the gypsy and browntail moths
has been continued during the week.
Water Construction.
The extension in Cedar Street to the, Paul Revere Golf Links
is completed, with the exception of plaeing of two hydrants. 180 feet
of 8" water pipe laid in Independence'Avenue.
Water Maintenance.
' Three services installed. The location of two hydrants - one
in Forest Street and one in Chase Avenue, was changed for the reason
that they blocked the driveways into private property.
Sewer Construction.
180 feet of sewer pipe laid in Independence Avenue, and one

manhole constructed. Work started in Locust Avenue, and ap-
proximately 150 feet of 8" sewer pipe laid. Considerable ledge
was encountered in the beginning of this job. About 20 feet of
sewer pipe laid in Lincoln Street.
Old Reservoir.
The work to drain the old reservoir is practically completed
and the reservoir will be dry within a few days.

Letter was received from the Town Counsel advising the Board
that he recommended the s6ttlement of the McCaffrey case for $500..
Plus the restoration of the ditch to its original condition. The
Board discussed the matter and decided to accept the suggestion
of the Town Counsel for s6ttlement of the case for an amount not
exceeding $500. allowing $50.00 for restoring the ditch, and
authorized the Town Counsel to proceed to carry out the settlement
of the case.
Matters pertaining to the moving from the present Town Hall
to the new Town Office wilding were discussed, and it was decided
to 9bart moving the last of the week.
Prendergast Brothers together with their engineer came be-
fore the Board and presented another plan of proposed filling
station on lot on Massachusetts Avenue adjacent to Fottler Avenue,
and the Board decided to grant a hearing to them on their ap-
plication.
Application was received from Rubin & Seligman for permission
to opef'ate a moving picture theatre on the Town Hall Lot. After
diat ssing the matter it was decided to lay the application on the
table for one week.
The Supt. of Public Works was requested to bring in a report
of the expenditure on the swimming pool for the next meeting.
The Town Counsel presented agreement to be executed by Rubin
& Seligman and the Town of Lexington, releasing to Rubin & Seligman
the Town Hall building which they purchased under deed dated November
17, 1927. The Chairman was authorized to make delivery of the
agreement to cabin & Seligman on June 30, 1928, it being understood
that the Town property will be moved from the building by that date.
Mr. Custance explained to the Board that he attended the meeting
of the Public Works Department at the State House when the bids
were obtained on the construction of Massachusetts Avenue, from about
opposite Oak Street to Marrett Road.
He explained that there were eleven bids as follows:

He explained that all of the bidders did not bid on natural
asphalt but bid on chemical asphalt, although the specifications
called for natural asphalt. The low bidder, M: McDonough Co.
bid on chemical asphalt. He stated that James --H. Fannon was the
second lowest bidder, and that he bid on natural asphalt, there-
fore he felt that the Board should write a letter to the Depart-
ment of Public Works requesting them to accept the bid of James
H. Fannon inasmuch as the results obtained from the use of natural
asphalt instead of chemical asphalt were very much more advantageous.
The meeting adjourned at 11:45 P. M.
