HomeMy WebLinkAbout1928-01-31REGULAR MEETING, JANUARY 51, 1928. R A regular meeting of the Board of Selecti*en was held at the , Selectments Office at 7.30 P.M. Messrs. Custance, Burnham, Ballard, Robertson, and Chamberlain were present. The Supt. of Public Works and the Clerk were also present. Ezra F. Breed came before the Board to inquire relative to inserting an article in the warrant for the annual Town Meeting asking permission to place a memorial to the Minute Men of Lexington on Hastings Park. Bir. Breed stated that Mr. Kitson was to furnish the money over and above the 1?40,000. that the Committee Soliciting Funds for the Memorial to the Minute Men had on hand. He stated that Bir. Kitson would place a model of the statue in the Town Offices so that it could be viewed by the Selectmen and the Planning Board. The Board agreed to insert an article in the warrant asking the townts.permission to erect this statue. Mr. Elmer Leonard came before the Board to see what was going to be done about the repairing of his lawn. He stated that when Grant Street was built his lawn was not repaired, and he felt some- thing should be done by the town. The matter was referred to the Supt. of Public Works to look into. Mr. Harold Michelson came before the Board relative to obtaining a permit for a sign overhanging the sidewalk on the Michelson shoe store. The Board informed him that they would advise him when they take definite action upon the application. Mr. Neil McIntosh came before the Board together with his engineer, and presented plans of the layout of the Davis property, and stated that he would send in more detailed plans for use by the Board of Survey, and requested that the matter be turned over to the Plan- ning Board. The Board therefor referred the matter to the Planning Board with the information that, the plans would be on hadd for their use at an early date. Ir. Robert H. Holt came before the Board in regard to the George A. goods claim for damages to his property caused by the in- stallation of the sewer in Rowland Avenue and across his property. Mr. Sydney R. Wrightington, Town Counsel, also came before the Board. The Board felt that it might be possible to arrive at an agreement as to what, if anything, could be paid to Mr. Woods on his claim. Mr. Holt stated that he felt Mr. Woods was entitled to some damages, and that he would proceed against the town if nothing was done. He stated that Mr. Woods felt that he was entitled to damages of $500. He stated thatfift case would,go to jury trial and would require testimony of experts on the damages done to the land. He stated that he felt that the Town was entitled to go in on the land at any time to flush the sewer, and that in laying the sewer on the land it has taken away the right of Mr. Moods to use the land at any time. When asked whether or not it would establish a precedent if Mr. Woods was paid ' damages when all the other parties under similar circumstances waived their claims for abatement for the assessment on the back land, Mr. Holt stated that they in no way had anything to do withMr. Wood's case. Mr. Ballard suggested that the abutters might buy 'small strips of land in that section so that the property on either side would be worth while to the abutting owners. No definite decision was arrived at. Application was received from Mr. William A. Granfield for a gasoline filling station at the junction of Middle and Spring Streets. The Board decided to give Cdr. Granfield leave to withdraw his appli- cation. A lengthy report was received from the Supt. of Public Works as to what he felt should be done to repair Village Hall. The Cost to carry out the recommendations would be $2500. The Board decided to request the Town Engineer to make a survey of signs in all the business sections of the town, and have the same ready for presentation at the next meeting. The Board decided to request Mr. Wrightington to give his opinion as to whether the Selectmen have any right to govern the signs over the sidewalk, inasmuch as there is nothing in the Town by-laws in reference to same. The Board decided to ask him if he sFroul: advise making a by-law to cover this or whether the state layer would cover same. The Board voted to authorize the extension of a water main on Fair Oaks Drive to lots 107 and 108 approximately 225 feet, cost of same to be approximately $800. This extension could be made at this time on account of the weather._2nd also it would give work to some men who are out of work. Mr. James P. Jtrwoe came before the Board and presented the plan of Tavern Lame to be signed by the Hoard of Survey. The Board, on' January 28, 1928 agreed to sign the plan, and did the same, but it appeared that the original plan which Mr. Munroe desired to file at the Registry of Deeds had to be signed also by the Board, and therefor he came before them for this purpose. r. Robertson reported that he attended the hearing at the State House in regard tothe layout of a proposed se,,°.,erage system to extend to the State Hospital mhich is to be located partly in Waltham, Belmont, and Lexington. At a previous meeting the Board advised that it might be possible that engineering services would be necessary in determining whether or not Lexington desired to enter into this project. I+Tr. Robert- son stated that he did not feel that it was necessary for the town to employ any engineers to obtain information in regard to the sewer. He felt that it was a question as to whether the tomo would want to enter the sewer and become part of same, and stand the expenses when it might be a long time hence. The Board discussed the estimate of the ?Fater Department for extension of water mains, -7,nd Mr. Robertson stated that he was not as yet ready to recommend the program for the department. The Board also discussed the sAlary of the Supt. of the Water Dept., but no definite -action was taken. It was decided to request the engineers of the Fire Department to send in plan of where they are to put fire alarm boxes, and -how many they intend to put in. In connection with this the proposed under ground system from Meriam Street to 7.oburn Street was discussed, and it was reported that it would cost approximately $4200. to put the wires under ground. 198 .a Q The Board approved appropriation for maintenance of the Water Department in the amount of $65,000.
