HomeMy WebLinkAbout1927-11-29in REGULAR ME ;TING, NOVEMBER 29, 1927. A regular meeting of the Board of Selectmen was held at the Selectmen's Office at -7:45 P. M. Messrs. Custance,'Burnham, Ballard, Robertson, and Chamberlain were present. The Supt. of Public Works and the Clerk were also present. The records were approved. Commitment was signed to the Collector in the sum of $1033.12 for sewer charges. Letter was received from Judge Arthur P. Stone of Belmont in which he reported that evidence was given at a trial before him that the Paul Revere Tavern was engaging in liquor traffic. Inasmuch as the Chief of Police had recently made a raid and found nothing at the Tavern, it was deemed proper to turn the matter over to Elwyn G. Preston, President of the Lexington Trust Co., being the ovTner of the premises occupied by the Paul Revere Tavern. Petition was received from F. H. Stearns, Attorney For Caroline A. Harrington, asking for the abatement of assessment $719.00 on account of Building Line. The petition was turned over to the Town Counsel. Letter was received from the Supt. of set forth the request of 1,1iskell Brothers time of disposing of their pigs on Concord The Board replied to Mr. Miskell that the time beyond December 1, 1927, the time viously notified_ Public Works in which he that the Board extend the Avenue. they would not extend of which he had been pee - Letter was received from the Trustees of the Cary Memorial Library in which they requested the Board to turn over to them the jurisdiction of the lot of land next to the library formerly called the Spaulding Lot. Upon looking up the matter it was found that the Spaulding lot is already under the -jurisdiction of the Library, therefor copy of the vote of the town was sent to the Trustees. Letter was received from Frederick L. Emery enclosing plan of the Vine Brook Drainage project prepared by Metcalf and Eddy dated Nov.15, 1927. The Board stated that they would endeavor to have a hearing very soon with the Planning Board to discuss this matter after another meet- ing of the Selectmen had been held at which the subject would be dis- cussed. , Letter was received from C. Edward Glynn, Clerk of the Traffic Committee in which he requested that the Selectmen provide $100. for the Committee's preliminary expenses. 1 1 1 Mr. Glynn was informed that $50. would be available out of the 1927 unclassified appropriation, and the committee should inform the Selectmen in 1928 as to the amount of money that is necessary so that the appropriation may be made in March. Letter was received from the Town Counsel informing the Board that he had had a request from the Chief of the Fire Department to prepare an article for the next town warrant to place the firemen under the Civil Service law. The Board decided to write to the Engineers of the Fire Department requesting them to give in writing their reasons for requesting that the firemen be placed under Civil Service rules and regulations. Letter was received from the Middlesex & Boston St. Ry. Co. in which they requested permission to'operate a trial bus service between Lexington Center and Arlington Heights via Mass. Avenue, Woburn Street, Lowell Street, Westminster Avenue, Park Avenue and Mass. Avenue to the Boston Elevated yard. They also stated that this service would be put upon a trial basis for the period of two months. The Board replied to the Middlesex & Boston St. Hwy. Co. that they would grant a permit for this service over the streets named in the town of Lexington, but informed the company that they did not believe two months trial was sufficient to determine whether the service would pay or not. Plan of the proposed extension of Parker Street and widening of the entrance to the Play round drawn by the Town Engineer was ' placed before the Board. If was decided to refer this matter to the Planning Board to get their advice on the layout before taking any action. Letter was written to the Edison Elec. Ill. Co. asking them to extend the time of morning street lighting to 6.04 A. X. owing to the fact that persons going to the early train have to go in the dark. They were requested when the regular schedule reaches 6.04 A. M. to then continue their own schedule from that time. Letter was received from Mr. F. L. Emery in which he asked what disposition had been made of several matters, namely, the Railroad Yard used by the Town departments, roadside stands, extension of Parker Street, and the building line in East Lex- ington. The Board requested Mr. Chamberlain to take up the several matters contained in Mr. Emery's letter with the Planning Board. Letter was received from '.Hillard C. Hill in regard to carrying a rent insurance policy of $10,000. Mr. Ballard advised that he did not believe that it was necessary for the Board to carry any further insurance than was now carried on the Town Hall property. This, is in connection with the purchase of the Town Hall property by Rubin & Seligman. ' In regard to the abatement of the tax of Mr. Wilson E. Leighton, Mr. Robertson did not advise any abatement, inasmuch as Xr. Leighton will have the benefit of the sewer, but he did advise that Mr. Leighton be informed that when he isready to make entry to the sewer the Town will agree to make the sewer service at a 1, 6 Mr. Prentiss reported that he suggested to Mr. Wrightington that an article be inserted in the Town Warrant for the March Meeting to authorize the Board to make regulations prohibiting pigs in the Town. The Board decided to request the Town Counsel to get together with the District Attorney to see what could be done in regard to the Board of Survey Act. It appears that any action taken under this act is done without a great deal of authority, and the purpose of the meeting is to see if something could be done to ' make the act worth while. The matter of making a Sewer Department regulation governing or prohibiting entrance to a trunk line sewer under any specific conditions was left with Mr. Robertson to work out with the Supt, of Public 'Yorks. Tn reggard to the abatement of sewer tax on property of H. L* Coolidge.. in view of opinion received from the Town Counsel, it was voted not to abate the assessment on - the three -lots. Mr. Chamberlain reported a letter from the Menotomy Trust Co. of Arlington whereby they stated that they would be pleased to receive deposits in their Interest Department. Mr. Chamberlain took this matter up with the Town Treasurer, and he informed him that he would take the matter up with the Town Accountant to see what balances would be available for this deposit. The Supt. of Public'Vorks was also to take the matter up with the Town Aecountant. Letter was read by 'William H. Ballard from the Davey Tree Expert Co. in reggard to the trees about the Common. Mr. camberlain stated that his father would be willing to vier the trees with the Supt. of Public 'Yorks, and give his opinion on same without any charge to the Town. ' The Clerk was instructed to find out from Mr. warshall what the -status is of the right of way which lies between Mr. Marshall's Undertaking shop and the Cary Library Lot. �7 cost not greater than it would have been had the sewer been R'• carried past his lot on Tower Street, and the Board so voted. Attorney John Devine came before the Board to report pro- ress on the to be , petition filed for the change in the Zoning 119 aw at Mass. Avenue; He stated that he had obtained some of the signatures of the neighbors and he still had others to secure. Russell I. Prentiss came before the Board in regard to the pigs. He stated that he had been talking with the Town Counsel and he advised that authorization be made to him to proceed against 111-11jam J. Miskell in contempt proceedings. The Board therefor voted to authorize Mr. TYtightington to proceed against said Miskell. The Board also voted to request Mr. 'Yrightington to take such action in the Ballou case to have him dispose of his pigs in sixty days. Im Suggestion was made by Mr. Ballard that an article be inserted in the Town warrant to instruct the Selectmen to lay out Waltham Streit from Mass, Avenue -iii the center of the State Road so that the opinion of the Town could be obtained on said widening before the Board petitioned the County Commissioners.
