REGULAR MEETING, JULY_12, 1927 `

A regular meeting of the Board of Selectmen was held at
the Selectments office at 8:00 P. M. "Lessrs. Custance, Burnham,
Robertson and Chamberlain were present. The Clerk and the Supt.
of Public Works were also present.
The records were approved.
Permission was granted to the Edison Electric I11. Co. and
New Eng. Tel & Tel Co. for a joint location of poles (7) on Reed St.
#oaring was declared open at 8:30 P, M. on the application
of George A. Schlichte of 40 Crescent St.'Somerville, for permission
to erect a two car garage on his premises, at Follen Road.
No persons appeared to object and it was voted to grant the
permit.
Application was received from ttarry H. Adamian of 66 Graigie
St.• Somerville, Mass. for permission to install gasoline tanks
underground in the amount of 15,000 at the corner of Fottler'Ave.
and Massachusetts Avenue.
Application was also received from James J. Morgan of
48 Parkway Cresent, Milton, Mass. for a permit to install gasoline
tank of 2 000 at this same location.
The board considered the applications and decided not to
grant a hearing for either application inasmuch as they did not
intend to grant a permit for this location.
Letter was received from the Town Counsel informing the Board
that the Supreme Court has confirmed Judge Bishop's decision in the
Miskell case, and that the decree provides "that the defendant be
and he hereby is forever enjoined against exercising the trade or
employment of keeping swine in the Town of Lexington in violation
of the regulations of the Board of "ealth'and until a permit shall
be issued to him for the keeping.of swine."
Counsel stated that he talked with Mr. Withington, attorney
of Miskell, and he asked that action be taken on Miskell's
application for a permit which was made last spring. Counsel
advised that the Board take formal action on the application and
to advise Mr. Miskell, Mr. Withington stated that if the Board
did not grant the permit he wished to have a reasonable opportunity
to dispose of the pigs before enforcing the decree. It was under-
stood that Mr. Withington was to take up with Mr. Wrightington
on July 25th the length of time which Miskell should have.
The Board considered the application of Ar. Miskell
under date of April 30, 1927 for a permit to keep 600 swine
at his premises on Concord .Avenue and voted to refuse the
application.
In'another letter `"r. tWrightington made the suggestion
that lur. Prentiss make a careful investigation and report on
each piggery that is maintained without a permit and that
the parties operating without permits be notified of a hearing
to be held on July 26th at which time an opportunity will be
given them to show cause why an order of prohibition should
not be issued against them.
Hearing was declared open at 8:35 P. M. on the application
of Clayton F. Beach of 24 Oakland St. for permission to erect a
two car garage on his premises
No persons appeared to object and it was voted to grant the
permit.
Letter was received from the Board of Assessors in
reply to the request of the Board, explaining about the increase
in valuation when street lights are installed.
Plan was received from Mr. Kitson relative to the proposed
lay out of Depot Park. No action was taken on same.
The Board viewed the plan of Massachusetts Avenue widening /
and made the request that the Town Engineer stake out the same
on the ground so that it could be viewed by the Board on Tuesday.
Letter was received from Edwin B. Worthen suggesting that
street signs be exec'ted at the junction of.Waltlham St. and Mass.
Avenue directing parties to the North shore. He stated ,that was
most usually asked by parties traveling through the centre of
the town.
The Clerk was directed to get in touch with the "epartment
of Public Works and the Autombile Legal Assocation to see if
they could co-operate in the erection of a sign or signs at this
corner
The Board signed the following Committments:
Sewer Assessments $4,820.79
• Sewer dharges 513.97
Water Charges 119782.31
The following abatements were also signed;

Letter was received from Frederick L. Emery, Chairman of
the Planning Board, enclosing bill of Metcalf & Eddy in the
aW—n- of $2,616.53 and asking that the Board take action on
same. The Board directed the bill returned with the request
that the Planning Board approve same inasmuch as the work was
done under their direction.
,Letter was received from Robert P. Trask of 6LO "loss, Ave.
in which he enclosed bill of $2.50 for pullet killed by dog
owned by 'A. Webb of Lincoln St.
Letter was sent to Mr. Trask informing that inasmuch as he
knew the owner of the dog, he should apply to him for payment
of damages.

Figures on the installation of sewer in Percy Road from
Highland Avenue, a distance of four hundred twenty-five feet
were received from the Town Engineer.
No action was taken in regard to same.
Letter was'received from D. C. Linscott, attorney for
Miss Mary Fitch, stating that the damages claimed by his client
amount to X500.
Copy of the attorney's letter was sent to town counsel
with the expression of opinion that the'Board did not feel
that Miss Fitch was entitled to damages.
The following names were suggested by Mr. Robertson as
men, one of whom might be appointed as the third fire engineer:
Edward Buttrick, ?Halter Kew, Clarence MacPhee, lWalter Filson,
Fred H. Moulton and George A. Jaynes.
The license for the Middlesex & Boston St. RwjT Co. to
operate busses in the Town was signed by the Board.
The Board signed the warrant for the dog officer,
Patrick J. Maguire, to kill all unlicensed dogs.
The meeting adjourned at 10:30 P.M.
