SPECIAL MEETING, June 23, 1927. D
A special meeting of the Board of Selectmen was held at the
Selectmen's Office at 8:00 P.M. Messrs. Custance, Ballard, and
Chamberlain were present. The Clerk was also present. ,
Hearing was called at 8 P.M. on the notice of the Board to
lay out a part of Smith Avenue over lands of Bay State Builders
Supply Company and George F. Harrington. Inasmanh as the Bay State
Builders Supple Company had negotiated for the sale of their property,
their representative, Mr. Oscar Beckvold, came before the Board in
their behalf. Mr. George F. Harrington and Mr. Jay e. Richards
were also present as interested parties. Mr. Richards was present
to represent Mr. Morgan, the purchaser of the Bay State Builders
Supply Company's lot. He stated that Mr. Morgan felt that he
should be paid the same amount that he paid for the'are& to be
taken for street pruposes, inasmuch.as he was losing 28.03 feet
frontage whereas the original lot had a"frontage of 98 feet.
Mr. Harrington also objected to the taking of his land for
street purposes, inasmuch as it would not be of benefit to him.
However, he did not wish to stand in the way of getting a roper
lay out of streets in this section. He also felt that he'should
not have any betterment assessment made upon his pimperty, and
that he should be paid for the land taken.
The suggestion was made that inasmuch as a town meeting will
not now be held in the near future that an agreement be dvawn up
between Smith & Robbins and George F. Harrington and the Bay State
Builders Supply Company, the latter two named to secure paymend
from Robbins & Smith for use of their land for street purposes '
and to have ggrscdlgned to this effect. The hearing was then
declared closed.
At 8:30 P.M. hearing was declared open upon the petition of
Caroline A. Harrington of 393 Mass. Avenue for claim of damages
as a result of establishing a building line on her premiess.
Mr. T. H. Stearns of the office of Joseph Wiggin, came before the
Board representing Mrs. Harrington, who did not appear personally.
Mr. Stearns informed the Board that he was proceeding in accordance
with the statute. He stated that Mrs. Harrington had a lot of
valuable shrubs which she felt she should be paid for. He was
informed that the shrubs or the sidewalk would not be moved.
Mrs. Harrington also felt that she suffered from damages from the
commercial value of the property inasmuch as if stores were built
on the front of the property, the house would have to be moved
back and she felt it rather impossible to move a stone house and
the house would also face the rear of the stores, and would
therefor be of no value. Town Counsel, S' dney R. 9ii :ngton,
I
who was present at the hearing, informed r. Stearns that it was
entirely possible to move this stone house, and that it could be
placed facing Grant Street. Mr. Stearns stated that he might not
entirely agree with Mrs.Harrington himself in regard to her claim,
but that he desired to put forth her claims and he would then talk
with her. She might feel that she would get an award by a jury.
The Chairman informed Mr. Stearns that he was turning the matter over '
to Vt-. Ballard whom he felt is better qualified to pass uponthe
value of real estate.. The hearing was tban'declared closed.
