HomeMy WebLinkAbout1926-11-23388_ REGULAR MEETING, N6vember 23, 1926. � A regular meeting of the Board of Selectmen was held.at the Selectmen's Office at 7:30 P.M. Messrs. Custance, Burnham, Miles, , Ballard, and Robertson were present. The Supt. of Public Works and the Clerk were also present. The following residents from the Building Trust property came before the Board to request snow plow service on Bertwell.Road, Dexter Road, Harding Road, Simonds Road, Dee Road, Gleason Road, and Fuller Road: Roy A. Ferguson, Elton B. McCausland, Rudolph Gfroerer, Clarence A. Small, Leon C. Burt, R. Comen Savoye, and Albert J. Kranz. The Board agreed to insert an article in the Town Warrant asking for this service. The Chairman reported and gave a written account of the meeting at the County Commissioner's Office, November 17, 1926 with Mr. Ken- dall in reference to securing the Cooperation of the County on Mass- achusetts Avenue from Waltham Street to the Hayes Fountain, and Bed- ford Street from the Hayes fountain to Elm Avenue. The work on, Mass. Avenue and Bedford Street will cost approximately $27,000, and on Waltham Street from Middle Street to Allen Street it will cost approximately $42,000. He also wanted to secure their cooperation to do some work on Wood Street. Petitions were signed by the Board directed to the County Commissioners asking that they cooperate to the extendd of paying one-third of the cost of construction of Massachusetts Avenue and ' Bedford Street, and of the coat of construction of Waltham Street. r Letter Was also written to the State Department of Public Works asking that they contribute one-third of the cost of construction of these streets under Chapter 90 of the General Laws. Hearing was declared open upon the petition of the Edison Electric Ill. Co. to erectand maintain one pole on North Hancock Street at Hamilton Road. No persons appeared to object, and it was voted to grant the permit. Letter was received from the Boston & Maine Transportation Co. inwI31 ch they stated that they had arranged with the Middlesex & Boston St. Rwy. Co. and the Boston Elevated Co. so that they might take on passengers at Lexington Centre, and they therefor desired to receive their license to operate busses in the Town of Lexington, over Middle Street from the Lincoln -Lexington town line to the Arlington -Lex- ington town line, and from the Lincoln -Lexington town line over Massachusetts Avenue to the centre of Lexington to the Arlington - Lexington town line. They stated that they hope to sive service on a two hour basis, and make some of the trips through Lexington Centre, but they were unable to furnish the Board with a definite schedule at the present time, inasmuch as they have several details to work out with the ' other towns. The Board voted to grant the license. The Board signed the warrant for a town meeting to be held December 6, 1926 after discussing some of the articles contained therein. Hearing was declared open upon the establishment of a building line on Massachusetts Avenue from the Town Hall lot to Fletcher Avenue 'at 8;30 P.M. in accordance with notices served upon the abuttors along the line on Massachusetts Avenue. Mrs. Caroline A. Harrington together with herAttorney, Mr. Stearn$ came before the Board in response to their notice. Mr. Emery, Chair- man of the Planning Board, and Mr. J. Henry Duffy, a member of said board, also Mr. Sydney R. Wrightington, Town Counsel, were present. Mr. Stearns stated that he felt that Mrs. Harrington was entitled to damages owing to the building line which is proposed,ibasmuch as she would lose the use of her property for building purposes. Fie desired to reserve her rights for damages although he declined to state the amount of damages he expected. No other objections were received, and Mr. Emery stated that the Planning Board had secured the signatures of all of the abuttors on the line of the building line except Mrs. Harrington. The hearing closed and the Board voted to adopt an order for the establishment of a building line as follows; COID.TOMMALTH OF MASSACHUSETTS Middlesex, ss. Lexington, Mass. Nov. 23, 1926 Town of Lexingfton, Selectmen's Room. At a meeting of the Board of Selectmen of the Town of Lexington, after having given due written notice of the intention of said Board, as required by law, to establish building lines on Massachusetts Avenue from land now or formerly of Daniel J. O'Connell and the Town of Lexington to the iluAction of Massachusetts Avenue and Woburn Street and on Woburn Street to the westerly side of Fletcher Avenue, all as hereinafter more fully appears, and after public hearing held thereon, and no objections having been made; Now, upon consideration of the matter, it is Ordered thattheBoard of Selectmen is of the opinion that public necessity;and convenience require that said building line on Massachusetts Avenue and Woburn Street be laid out and established as a.Town building line, and that the same is hereby laid out and established as a Town building line respectively, as follows: - Beginning at the property line between lands now or fonnerly of Daniel J. O'Connell and Tovn of Lexington being distant twenty-six and seven one -hundredths (26.07) feet from the present northerly exterior line of Massachusetts Avenue and running S. 42 07' 40" E to a point of tangency at the property line between lands now or formerly of Rubin & Seligman and Town of Lexington, said point of tangency being nineteen and fifty one -hundredths (19.50) feet from the present northerly exterior line of Massachusetts Avenge, thence ' running with a curve to the left with a radius of one thousand two hundred thirteen and sixty-six one -hundredths (1213.66) feet dis- tant about two hundred thirty-two and five -tenths (232.5) feet to the westerly side of Grant Street being one hundred (100) feet dis- tant from the present southerly exterior line of Massachusetts Avenue at the westerly side of Grant Street and from the easterly side of Grant Street to a point of taggency about one hundred sixty-three 390 AWN (163) feet easterly of the property line between lands now or formerly of Isaac Harris Cary Educational Fund and William L. Barnes, (Said. � point of tangency being opposite and thirty (30) feet distant from a stone bound marking a point of tangency in the present northerly exterior line of Massachusetts Avenue, one hundred (100) feet distant from and parallel to the present southerly exterior line of Mass- ' achusetts Avenue, thence beating to the left with a curve with a radius of two hundred sixty-eight and forty-five one-hundredths 268,45) feet distant one hundred fifty and thirty-one one-hundredths 150.31) feet to a point of tangency said point of tangency being twenty 20) feet distant from the present northerly exterior line of Woburn Street, thence to the westerly side of Fletcher Avenue twenty (20) feet distant from and parallel to the present northerly exterior line of Woburn Street. All the aforesaid lines being shown on a plan entitled, "Plan, showing Proposed Building Line on Massachusetts Avenue, Lexington, from Woburn Street to Meriam Street, September 3, 1926. Scaled inch 40 feet, Clarence B. French, Town Engineer," which plan is on file in the Town Clerk's Office in the Town Hall. And said Board having considered the question of damages sus- tained by the owners of lands across and through which said building line has been laid out and established as aforesaid, hereby determines that no damages are sustained andno damages are awarded, and said Board hereby declares that all acts herein are done under the pro- visions of law authorizing the assessment of betterments. Prentiss, Health Inspector, in reference to property owned by Mr. Patrick Mulvey in which he stated that the Building Inspector could not find anything wrong with the construction of the buildings. He suggested that a letter be sent to Mr. Mulvey telling him to remove the rubbish and dump back of one of the buildings on his property, and also to put the outhouses in a sanitary condition. It was called to the Boards attention that a case of scarlet fever existed in the home of Mr. Thomas Fardy on Bedford Street, and upon the death of Mrs. Agnes Farcy, the scarlet fever card was removed until after the funeral, and persons allowed to goabout.;in the house as though no contagious disease existed on the premises. The Board decided to ask Dr. Barnes, Health Officer, what he knew of the condition. The Board discussed the matter of recommending to the Town the 35, 1,000 candle power lights asked for by the Board of Trade. If any change was made the Board decided to recommend to the Town meeting the use of 250 candle power lights in the place of the 125 now in existance rather than to pay t:,.e additional expense of maintaining the 1,000 candle power lights. Nichols, Chairman of the School Committee, smd Mr. Fames Stuart Smith, of said committee, came before the Board in reference to the bill of $500.00 for work done by the Highway De- partment between the sidewalk and curbing in front of the Nigh School building. Mr. Nichols desired to know just what work was done, and Mr. Scamman explained that the road was excavated, and the space filled with gravel, and that only the top dressing is now left to be put on. Mr. Nichols stated that he felt that the amount of money expended was exorbitant for what was received, and requested that the Board approve the proposal of extending the present grano- lithic sidewalk to the curbing next Spring, and that nothing further will be asked of the School Department but that an appropriation be made for that purpose. Mr. Smith stated that he felt that granolithic strips to the curbing in front of the walks and drive- ways -might be all that is necessary. Mr. Nichols did not agree, as he felt that this would look like a patched job inasmuch as a side- walk existed on that side of Mass. Avenue from the Town Hall down. The Chairman stated that the Board was interested in the proposition of making the building look right, and that they would take the matter up with the School Committee again before asking for the appropriation.
