SPECIAL MEETING, NOVEMBER 1, 1923. '
A special meeting of the Board of Selectmen was held in
the Selectmen's Room, town Hall, Lexington, on Thursday,
November 1, 1923 at 8 P. U. The following members of the Board
were present, namely: Messrs. Scamman, Blake, Hutchinson,
Burnham and Moulton; the Town Clerk and the Town Counsel were
also present.
Elbridge 7o. Glass was drawn as a Juror.
The hearing on the Pierce License was again called.
Officer villiam C. O'Leary testified that he went by the
Pierce place about two weeks ago on Sunday and during the four
times he went by he did not see any great amount of traffic. He
noticed one machine off the highway on the opposite side of the
street from the stand.
Mr. McIntosh again testified that the traffic Was congested
at various times.
Officer James Irwin testified that three weeks ago last '
Sunday he remained from 2:20 until 6:15 P. 1:. behind a building
where he could watch the traffic. wring that time twenty-three
cars passed. bome care stopped for five minutes, and at one time
four cars were stopped at the side of the road. One stopped in
front of Mr. McIntohAl a drive and remained there about five
minutes. The cars stop about two feet in the highway on the
macadam road,
Chief Leavitt stated that he had observed the condition
there one or two times. He stated that he had received about
fifteen complaints this summer about this stand being a nuisance.
He stated that the stand itself was about eight or nine feet off
the highway and he observed peaches, apples and vegetables being
sold, but he saw no food or facilities for serving food.
Mrs. Ida H. B. Capper stated that she passed lir. Pierce s
place about every Sunday except while on her vacation. She saw
no congestion as there were never more than two cars there at a
time. She did however. observe several men with plans showing
them to people at the Real Estate office of Mr. kcIntoeh and
she dice not believe that this should be allowed on Sunday.
Lugene Swenson stated that he had seen two or three cars
there at a time but he also observed that kr. Pierce askedthem ,
to drive up close and none of the cars stopped on the msmtaa .
road but drove in on the sanded road.
Mise hannaford stated that she passed on Sunday quite
frequently and saw no blocking of the traffic.
George H. Pierce stated that the largest number of care
he had at a time was five and that there was no obstruction. He
sold apples, cider and cigarettes on 2undays. lie had no Victuallers
sign up as the one he had up was blown down by the wind. He only
had calls for sandwiches about fifteen times and those could be
obtained in the house. He never had over 25 to 37 care stop on
a Sunday and the most he took in was $7 a day.
Mr. Hallie �,. Blake of the Board of Selectmen stated that he
went over there to observe conditions and he saw nine care parked
on Mr. Mclntoeh's side of the street and four in front of the
Pierce place. A woman was dodging about the automobiles so that
she would not get hit. He called Mr. Moulton on the 'phone and
he came over and saw the same conditions.
Mr. Moulton stated that ithen he went over to observe the
conditions he could not get into Mr. Mcintosh's driveway to
park hie car.
The hearing was declared closed to the public and the matter
taken under consideration by the Board.
Xfter considering the matter the Board voted unanimously to
revoke the Victualler's license held by George H. Pierce.
The Chief of Police was also requested to notify all
persons that they must not sell vegetables on Sunday.
