HEARING. SEPTEMBER 1?, 1923 .
A hearing in accordance with the notice of the Board dated
September 6 , 1923 relative to the lay out of Forest Street Exten-
sion was called . The following members of the Board were present
namely, Messrs . Seaman, Blake , Hutchinson, Burnham and Moulton;
the Town Clerk, xse't Town Clerk and Town Counsel were also present.
Mr. William Roger Greeley for the Planning Board informed the
meeting that the Planning Board had studied this lay out shown on
map prepared by the Town Engineer three years ago. He also stated
that according to plane on file in the Town Clerk's office the
lay out of this property, substantially in accordance with the
present plan, was made about fifty years ago . He explained that
the Board of Selectmen in laying these streets out were doing it
not under the Board of Survey Act but under the Police Power.
Mr. George H, Jackson inquired if the Board intended making
Jackson Court a forty foot street . He stated that if this was done '
the houses on the Court would have to be moved back and if moved
back there would not be room enough to comply with the requirement
that houses shall not be placed nearer than seven and a half feet
from the lot line .
The Chairman assured Mr. Jackson that the Board did not intend
to insist upon the street being any wider than twenty-five feet .
Mr . Scamma.n then read the report of the Planning Board on this
lay out , which was as follows:

Dear Sir:
The Planning Board, at a meeting held last evening. voted
to recommend to the Board of Selectmen that -
Forest Street be extended at its present width to Maes-
achusette Avenue , and that Jackson Court be extended at its preeent
width to Forest Street both extensions substantially as shown on
blue print of Plan of Proposed Extension of Forest Street to Mass-
achusetts Avenue , Compiled from Survey and Office Plans , December.
1921 . J . Henry Duffy, Town angineer.
It is understood that the above vote oarriee with it no
approval of the loop indicated on the above plan.
In regard to takings along Vine Brook, it was voted that -
The Planning Board recommends to the Board of Survey that
they proceed to acquire for the Town for street purposes , either by
taking or agreement , a strip of land from Maseachueetts Avenue to
Vine Brook Road, sixty (60) feet in width from the westerly boundary
• of the taking by the Board of Survey under date of November 6th.1918 ,
with proper curves at the approaches .
ASO That said taking be continued across Vine Brook Road to
its junction with proposed boulevard as laid out by the Board of

Survey under date of January E8 . 1916 .
It is further voted:- "17
That action by the Planning Board concerning taking for
said proposed boulevard be deferred until further data be furnish-
ed
as to proposed extension of same to and through the Park
property of the Town: which data the Selectmen are requested to
furnish to the Planning Board as promptly as possible.

Mr. Latimer ,'saver stated that he had recently purchased
land of Carrie Whitaker near Jackson Court and was about to build
a house there. He objected to Jackson Court and was about to
build a house there. He objected to Jackson Court being extended
as he did not believe it necessary to bring it out to Forest St.
Extension.
Mr. Jackson felt that no one on Jackson Court would object
to the Court being extended to Forest St. Extension if the width
of the present court was not disturbed.
Mr. Blake of the Board of Selectmen explained that he was
interested in this project and desired to see it go through. He
did think. however. after consulting with abutters in the vicinity
that the loop, Forest street Extension north and Forest Street
Extension south should be eliminated.
Eugene G. Kraetzer stated that he was speaking for Miss Helen
Blinn and said that she objected to the loop as she would not have
enough property for her own use.
Waldo F. Glidden also objected to the loop being laid out.
Mr. Everett Emery objected to the loop on behalf of the
Hancock Congregational church.
Mrs . Hollis Webster read a letter from Hollis Webster in
which he objected to the loop being laid out , but did not object
to the rest of the development.
Written objection was received from the Blinn Estate in
which they objected to the loop being laid out.
Harriet Row stated Rove tat d that she desired to see Jackson Court
extended to Forest Street Extension as it was a very desirable
short out to the Centre of the town for persons in that locality.
Several persons were present but no Others appeared to oppose
the ley out.
The hearing was therefor declared closed at 9 o'clock P . M.
The Board then passed the following order:

Town of Lexington, Selectmen' s Room.
At a meeting of the Board of Selectmen of the Town of Lexington.
after having given due written notice of the intention of said Board,
as required by Law, to lay out as a town way the extension of Forest
Street from its present terminus to Massachusetts Avenue and also
to lay out as a town way, Jackson Court. so called, and extending
the same so that said town way shall extend from Parker Street
to said Forest Street Extension, all as hereinafter more fully
appears , and after public hearing thereon held this day, and no
objections having been made,

Now, upon consideration of the matter. it is
Ordered. that this Board of Selectmen is of the opinion
that public necessity and convenience require that said Forest
Street Extension be laid out and established as a public town
way, and that Jackson Court be laid out and the same hereby is
laid out and established ae a public town way respectively. as
f o mlowir:
The easterly line of said Forest Street extension, as shown
on the plan hereinaftermentioned, begins at a point on the present
easterly line of Forest Street, said point being the terminus of
the easterly line of said Forest Street as at present established
asset public town wayithence running North 36 degrees 21 ' 40" West
by lands now or formerly of the Inhabitants of Lexington. Raymond
Nickerson. and William W. Ferguson one hundred sithteen and thirty-
two one-hundredths feet to a point, thence continuing on in a
curved line with a radius of 44 .57 fest by land now or formerly of
said Ferguson forty-eight and eighty-nine one-hundredths feet to a
point, thence turning and running northwesterly 63 degrees 30' 40"
West by a private way , as stnbwn on said plan, forty feet; thence
turning and running by a curved line with a radius of 25 .13 test in
a Southerly and Westerly direction forty-one and twelve one hundred-
the feet by land now or formerly of Latimer Seaver to a point,
thence continuing on in a curved line with a radius of 443.05 feet
four hundred thirty-one and twenty-five one hundredths feet by
land now or formerly of said Seaver and land now or formerly of one
Alexander M. Tucker to a point; thence oontinusing on North 3
degrees 59' 30" West one hundred sixtyand ttnety one-hundredths
feet by land now or formerly of said ucker to a point4 thence con-
tinuing on in a curved line with a radius of 29.83 feet forty-seven
and three one-hundredths feet by land now or formerly of said
Tucker to a point in the present southerly line of Massachusetts
Avenue.
The westerly line of said Forest Street extension, as shown
on said plan, begins at a point onthe present westerly line of Forest
Street , said point being the terminus of the Westerly line of said
Forest Street as at present established as a public town way and
being opposite and forty feet distant from the beginning of the
aforesaid Laeterly line of said Forest Street extension; thence run- 1

Clara A. Glenn sixty-seven and ninety-three one hundredths feet to
a point; thence oontinusing on in a curved line of a radius of 307,44
feet 125.58 feet by Jackson Court as hereinafter described and herein
laid out and established to a point; thence continuing on by a curved
line with a radius of 483 .05 feet by lands now or formerly of said
Seaver, of said Tucker , and Mary E. Powers four hundred seventy and
eighteen one hundredths feet to a point, thenal running North 3 degrees
59 ' 30" Weet one hundred sixty-one and fourteen one -hundredths feet
by land now or formerly of said Powers to a point; thence continuing
on by a curved line with a radius of 30.17 feet by land now or for-
merly of said Powers forty-seven and twenty-one one-hundredths feet
to a point in the present Southerly line of said Massachusetts
Avenue, said point being South 86 degrees 20' 30" West one hundred
feet from the terminue of the abovedescribed Easterly line of said
Forest Street extension,
The line second above described is parallel with and distant
westerly forty feet from the line first above described so that
said Forest Street Extension shall have a uniform width of forty
feet, with the exceptions of the curved intersections of said lines
with Massachusetts Avenue and with said private way.

plan. begins at a point on the Northeasterly line of Parker '"=7

57 ' East three hundred fifty-nine and forty-seven one-hundredths
feet by lands now or formerly of Charles N. Spender. Lucius A.
Austin, Fred and Nettie B . Butters , Harriet Rowe and of said
Seaver to a point. ; thence continuing on in a curved line with a
radius of 43.33 feet in a general Easterly direction by land now
or formerly of said Seaver and said Glenn sixty-seven and seven
one-hundredths feet to a point in the Westerly line. abovedescribed,
of said Forest Street extension;
The northerly line of said Jackson Court . as shown on said
plan, begins at a point on the Northeasterly line of said Parker
Street and twenty-five and four one-hundredths feet distant from
the point of beginning of said Southerly line of said Jackson
Court, thence running North 54 degrees 57' East three hundred ten
and forty-five one-hundredths feet by lands now or formerly of
George H. Jackson, Louine Peavey. Harold C. Denham and of said
Seaver to a point; thence continuing on in a curved line with a
radius of 105.34 feet by land now or formerly of said Seaver fifty-
two and thirty-two one-hundredths feet to a point, thence continuing
on in a curved line with a radius of 31.45 feet by land now or
formerly of said Seaver forty-seven and thirty-four one-hundredths
feet to a point in the abovedescribed Westerly line of said Forest
Street extension.
The line second above described with reference to said
Jackson Court is parallel with and distant Northerly twenty-five
feet from the first abovedeecribed line of said Jackson Court, so
that said Jackson Court shall have a uniform width of twenty-five
feet with the exceptions of the curved intersections with said
Forest Street extension.
Said Forest Street extension and said Jackson Court are
hereby laid out and established as shown on a plan entitled "Plan
of Forest Street extension and Jackson Court . Lexington, Mass.,
September 17, 1923 , J . Henry Duffy, Town Engineer ." which plan is
1 on file in the Town Clerk's Office in said Lexington and a copy
of which will be recorded with Middlesex South District Deeds
with a copy of this order .
And said Board having considered the question of damages
sustained by the owners of lands across and through which said
ways have been laid out and established as aforesaid . hereby deter-
mines that no damages are sustained and no damages are awarded,
and said Board hereby declares that, all acts done herein are. done
under the provisions of law authorizing the assessment of better-
ments.
