The bids were as follows: John E. Barnes $253.00 Theodore A. Cuetance 254.00 Buckley & Mc�ormack 310.00 'VY. H. Burke & Co. 370.00 Ezra F. Breed 478.00 George n4. Bay 484.50 The Board voted to award the contract to John E. Barnes pro- vided he si=ed the specifications pent him. A second hearing was declared open on the petition of Fred- erick Lundergan for a community garage at the corner of Sylvia Street and Maes. avenue. 1v:r. Marshall of 13 Sylvia Street and Mr. Max Bornstein of 14 Mase. Avenue spoke in favor of the garage. Mr. Max Ebustein and Mr. Michael Curran of 24 Mase. Ave. objected to the permit being granted. The Board decided not to grant him a permit. They requested ' Mr. Lundergan to present a plan of the proposed garage. The Board also informed him that he should clean up the drainage matter in that section before he proposed to build a building on that land. Mr. William H. Burgese, Mr. Jay 0. Richards and 1vr. Kellaway for the Lexington Building Truct came before the Board relative to the hearing held at the previous meeting on the petition of the Lexington Building Trust for a gasoline filling station at the corner of North Hancock and Bedford Streets. They informed the Board that they had received the withdrawal of all the objectors in that vicinity who signed the petition opposing the filling station. The Board requested that they get the signature of all the persons in writing. They also requested a sketch of the pro- posed filling station to be presented to the Board. i1r. Charles Henrick of Lrew Hvenue came before the Board and reminded them of the promise that had been made a long time ago that the Town Engineer would give him a grade on the streets in that section so that they could be put in proper condition for acceptance by the 'Town. i,r. Uotton suggested that as long as the Board promised to do this that it should be done as soon as possible. yr. Duffy submitted an estimate whereby he could reduce the cost of the sidewalk on the Kelley property $90.00. The Board therefore voted to have this sidewalk built in accordance with the new figure presented by u:r. Duffy, said amount being $120.00. , Mr. Robert L. Ryder, Eegq Town uouneel came before the Board in regard to the Smith case against the Town. ir. Ryder reported that the case was taken away from the Jury and that he thought possibly he might make a settlement for $4000 although the nearest figure talked of was $4250.00. Mr. Ryder stated that he would report at a later date. Mr. William C. O'Leary came before the Board and stated that he had been now about four (4) years on the Civil Service List doing duty when called upon, and he requested that he be given a permanent position. The Board informed him that they would take the matter up and let him know their decidion. Nothing was done about the matter, however. A letter was written to the Lexington Gas Light Co., giving permission to install their pipe in the water trench on Carville Avenue. The Board approved of this being done at this particular place, as the Gas Company would not be able to extend service to Carville Avenue, owing to lack of funds, but this is not to be established as a precedent. It was voted to grant the Lexington Gas Light Co. permission to install gas service at 172 Mase. Avenue, house of Herbert L. 1Iacl)onald provided the same met with the approval of the Engineers. A letter was written to Mayor ha.ines of Medford, ;,Mass., in which the Board informed him they would be willing to grant him a special permit to speak in the lown.of Lexington, but not a general permit. Communication was received relative to zoning districts. This appeared to be of great interest to the Board and they requested the Clerk to write a letter to the City of Newton asking that a copy of their Zoning District Law be Aent to our Board. A letter was received from the County Commissioners in which they stated that they would contribute $2000 for the construct- ion of that part of Bedford street which is to be rebuilt. In reply to the letter received by ilise Marian P. Kirkland,. the Board voted to allow a photograph taken of the portrait of Earle Percy. The portrait hangs in the Library and is the property of the Town. A form of agreement to be signed by the Board securing the permission of the Boston & Maine RR for use of the 12" pipe and culvert under Maple Street Bridge was presented. The Board having been informed by kr. Duffy that this permission had been given by the Boston & Maine RR in a letter to iir. Duffy, they decided not to sign the form of agreement as perhaps this matter might be held up owing to the channels. The Board signed the contracts in duplicate for the construct- ion of Lowell and Maple Streete. ' Water & Sewer Dept. Mr. DeFelice, sir. kelanson and Mr. Brucchi came before the Board to secure an extension of the water pipe to Summer Street, No. Lexington. i.1r. Beaudry was requested to find out whether or not this 1,,,as an accepted highway and also give an estimate of the cost of extending the pipe from the present end of the 211 line. 150 Ivr. Sam Lippa came before the Board and stated that he was building houses on Fottler rivenue on the rrilbur Land Uo., and asked that the water pipe be extended so that they could put water service into the houses. He was informed by the Board of the ' present rules and regulations of the Board of Survey, and thl they could not extend the water pipe in that street as it was a private way. He was informed that if the ailbur Land Uompany would comply with the rules and regulations of the Board of Survey in having streets put in condition for acceptance that they would consider the same. He was also instructed to get in touch with his Attorney who would consider the proposition with our Town Qounsel. The deed of the water main in Follen Road was received from Frank i. Peirce and Philip Lockwood. Copy of it follows: "Know All !=en by These Presents That we, Frank D. Peirce of Lexington,t4iddlesex County, vlaesachusetts, and Philip C. Lockwood of 'Manchester, hillaborough County, New Hampshire, as I am Adminis- trator of the Letate of Richard G. Tower late of said Lexington, deceased, in consideration of Ten Thousand Seven hundred and twenty- one dollars to us paid by the Inhabitant© of Lexington. a municipal corporation in 11iddleeex County, 16-laseachueetta, the receipt whereof hereby ereby acknowledged, do hereby severally sell, assign, transfer and deliver unto the said Inhabitants of Lexington, a certain eight inch ^rater main owned by us and situated in Follen Road in said Lex- ington and extending throughout the entire length of said Fallen Road. Being the same water main mentioned in but not included in a deed of Frank D. Peirce et al., to the Inhabitants of Lexington, dated January 6, 1915 and recorded with iEiddleveex South District ' Deeds, Book 5941, page 107. To Have and To Hold the said water main unto the Inhabitants of Lexington, their successors and aseiRna, forever. In _�+'itness Whereof we, the said Frank D. Peirce and Phillip C.
