Present: Betsey Weiss, Chair; Joel Adler, Norm Cohen, Marilyn Fenollosa, Richard Pagett, Judy Pearson, Sandy Shaw, Dick Wolk. At 4:20 p.m. a motion was made and supported unanimously by roll call vote for the Community Preservation Committee to go into Executive Session with intent to return to open session. The purpose of the Executive Session was to discuss a matter of litigation. The Committee was asked to join with other municipalities in filing an amicus brief in support of the City of Newton’s appeal of a Superior Court decision holding that CPA funds could not be used to reconstruct a playground that was not originally funded by CPA funds. The legal costs were estimated to not exceed $7,000. It was the consensus of the CPC to not use administrative funds for this purpose. Following this discussion, a motion was made and supported unanimously by roll call vote to go out of Executive Session and return to open session at 4:30 p.m. Respectfully Submitted, Judy Pearson Administrative Assistant to the CPC J.
