CONDOMTNIUM CONVERSION BOARD MEETING- tifi
PURSUANT to ARTICLE XXXIV GENERAL BY-LAWS
TOWN of LEXINGTON
18 February 1988
The meeting was convened at 7 :45 p.m. in Room 201 , Town Office
Building, Lexington, Massachusetts . All members were present. Also
present were Michael Lebner, representing Renbel , Charlene Casper,
representing Properties of Boston, and Bruce Linsky, Esq. , their
attorney.
1 . Michael Lebner presented to the Board his request for an
arrangement which would ensure that the protections afforded certain
tenants c-f Emerson Gardens Condominium would terminate as of January
31 19C12 After discussion, it was voted, subject to the receipt of
the agreement from the Trustees referred to in the preliminary clauses
pf such vote, as follows :
WHEREAS, the Trustees of Renbel/Properties of Boston
Trust, owners of Emerson Gardens Condominium, purchased the
r,roperty on December 18, 1986 , served tenant notices of condo-
minium conversion on January 31 , 1987 , and recorded a master
iced on March 10 , 1987 , all prior to the enactment by the Town
of Lexington of its Housing Conversion and Eviction By-Law; and
WHEREAS, said Trustees will incur substantial hardship
if the maximum period during which evictions may be prohibited
under said BY-Law is five years from the date that said Trustees
filed an application for licenses to evict! and
WHEREAS said Trustees have agreed in writing that they
will not commence any action in the courts of the Commonwealth
contesting the legality of the Town of Lexington Housing Con-
version and Eviction Py-Law;
NOW, THEREFORE, it is
VOTED: That with respect to any application for an
eviction license filed under Section 4 of the Housing Conver-
sion and Eviction By-Law with respect to a resident of Emerson
Gardens Condominium, if a condition prohibiting eviction for a
period of time is attached to such license by the Board, such
period shall not extend beyond January 31 , 1992 .
Following this vote, Mssrs . Lebner and Linsky and Ms . Kasper left the
meeting .
2 . The chairperson reported that an application for eviction
licenses with respect to a listed group of Emerson Gardens Condominium
residents had been filed by Renbel/Properties of Boston Trust on
February 3 , 1988 .
3 . The Minutes of the January 20, 1988, meeting were approved as
corrected
4. After discussion of the proposed Regulations of the Board it was
agreed that comments with respect to them would be submitted to the
chairperson on or before March 15, 1988.
5 . It was agreed that no further meeting need be scheduled at this
time.
The meeting was adjourned at 9: 15 p.m.
