SELECTMEN' S MEETING
EXECUTIVE SESSION
April 26, 1993
PRESENT: Chairman Dailey, Mrs . Smith, Mr. McSweeney, Mr. Busa,
Mr. White, Town Manager; Mrs . Novak, Assistant Town Manager; and
Mrs. Peters , Executive Clerk.
LITIGATION - MUZZEY SCHOOL CONDOMINIUMS
The Board discussed the "Amendment To Deed" prepared by
David R. Rodgers , Palmer & Dodge, that reflects what has been
tentatively agreed to by the Town, the Trustees of the Muzzey
High condominium Trust and the owners of all of the units in the
Muzzey High Condominium.
Mr. White reported that Attorney Rodgers thought he had a
legal obligation to present the amendment to the Trustees with
the signatures of each and every condominium owner on the deed
amendment , and leave it up to the Trustees to decide if their
signatures are required.
Mr. White noted the only change is that all agree that the
resale restrictions can increase from 4% to 5%, and that such 5%
increase may be applied and compounded annually from the date on
which any such unit was conveyed to the current owner thereof, in
the manner provided in the Deed.
POTENTIAL LITIGATION - FUNERAL VAULTS
Mr. White reported that Mr. Cohen wished to call the Board's
attention again to the vault issue in light of a letter from
Attorney John J. Masiz , representing the Massachusetts Concrete
Burial Vault Association, dated April 16 , 1993 . Mr. White added
that the Town was again going out for bids , including concrete
vaults .
Upon motion duly made and seconded, it was voted to adjourn
at 8 : 03 p.m.
