HomeMy WebLinkAbout06-10-04.pdf Minutes of the Lexington Zoning Board of Appeals- 6/10/04 Present, Mrs Uhrig, Chair, Associate Member Mr Williams, Mr Barnert, Mrs Sheehan, Mr McWeeney Petition Address 23 Bird Hill Road Assessors map 48 Plan number 230 The Chairman opened the hearing by reading the notice at 8.12 PM and described information received from the Petitioner, other Boards and Commissions and letters relative to the Petition The Petition was presented by Builder Julio Serrano of Cedar Construction Information presented by Petitioner- Photos of existing and similar properties Petitioner apparently appeared before the Board previously and neighbor objected Since met with neighbor and agreed to a planting plan that satisfied objectors Owners want to be able to have children safe Two retaining walls on other side of house The relief sought is side/rear yard setback The hardship is—Height of Pt floor relative to ground. Questions from the Board—Could you put a deck of west side of house' Questions from the audience -None Speakers in Favor —New owners—Mr &Mrs Simpson, stated need to have deck for children and usefulness given doorways already built Speakers in Opposition-None Rebuttal or comments by Petitioner -Builder said a deck on west side was possible but not as 1 deal and there was still issue of the doors Hearing was closed at 8 25 PM Decision. On a Motion by. John McWeeney, seconded by D. Williams. The Petition was presented by—Mike Ames Information presented by Petitioner- Model of proposed changes to house Description of changes Need to get more space Front porch expansion makes it usable The relief sought is—Variance for height, and front setback The hardship is—Topo of the lot Questions from the Board—Alternative layouts—expand to rear Petitioner explained not practical due to kitchen location—views—where expansion is needed Could porch kneewall be left open? Could shed be moved to make conforming? Questions from the audience -None Speakers in Favor —wife Cindy Ames Speakers in Opposition-None Rebuttal or comments by Petitioner -Petitioner agrees to relocate shed to make it conform Heanng was closed at• 8 12 PM The front yard and height variances were voted separately. Decision On a Motion by Mr Barnert, seconded by John McWeeney The Board by vote of 5-0 Approved the height, the petition, with the following conditions—move shed On a motion by John McWeeney, seconded by Mrs Sheehan The Board by vote of 5-0 approved the front yard variance Submitted by John J. On a Motion by David Williams, seconded by Mrs. Sheehan.
