HomeMy WebLinkAbout10-23-03.pdf BOARD OF APPEALS Minutes of Meeting, October 23, 2003 Judith J Uhrig, Chair Arthur C Smith, Acting Clerk Nyles N Barnert Maura Sheehan F David Wells (for John J McWeeney) 1 310 Wood Street Omnipoint Holdings, Inc Vanance for height and setback of a structure Special Permit to install and operate a wireless communication facility The Chair read the legal notices and noted that the Board has received an application, nature and justification for the request, a topographical map, elevations and photographs and a detailed technical report. The Conservation Commission commented that the proposed structure does not impact the wetlands The Advisory Committee stated that the information supplied is sufficient and meets the conditions of the By-Law The applicant was represented by Attorney Sousa, John Coste, and Julio Brown(radio frequency engineer) The applicant is requesting appropriate authonzation to install and operate a wireless communication facility on a stanchion owned by Boston Edison at 310 Wood St In order to achieve the desired coverage, it is necessary to increase the height of the stanchion from the current 55' to 80 ` and this requires a variance with regard to both the height and setback of the stanchion The installation consists of three antennas at the top of the stanchion and associated equipment at ground level No one spoke in favor or against the request The Board had questions regarding the proposed screening of the ground installation and about the necessity for the increase in height ACTION. A motion(by Barnert, seconded by Sheehan)to grant the requested variances and to grant the Special Permit with the condition that the applicant follow the Design Advisory Board's recommendation for screening was voted unanimously 2 675 Waltham Street Carroll Brothers Renewal of a Special Permit to operate the Stone Meadows golf course The Chair read the legal notice and noted that the Board has received an application, nature and justification of the request, several letters from Amando Mancini of 673 Waltham Street complaining of errant golf balls entering his yard, letters from the Zoning Enforcement Officer regarding violations of the conditions of the Special Permit The Conservation Commission asked the Board to remind the applicant that the conservation conditions are ongoing Attorney William Bailey represented the Carroll Brothers He noted that a screen of trees has been planted to block errant golf balls and a 6' fence is in place. The Board questioned the location of construction equipment and was assured that it was on an adjoining lot and did not violate the conditions of the Special Permit The Board noted that the fence does not appear to be constructed as required in the Special Permit Attorney Augustus Camilla represented the abutter at 673 Waltham Street and asserted that many golf balls came onto his client's property and they were concerned about children's safety and vehicle damage as well as damage to the residence He submitted photographs showing the damage to the residence. He stated that the existing trees are minimal protection and requested that adequate protection from golf balls be installed ACTION A motion was made (by Barnert, seconded by Sheehan) to renew the Special Permit with the following changes to the conditions. . 1 Permitted hours of operation are 7 00 AM to one hour after sunset, seven days a week 8 There shall be no lighting of the facility other than secunty lights in the service building and driving range lights used for maintenance purposes and ball retrieval only No patrons will use the dnvmg range when field lights are on Lights will not be turned on until golfing activity has ceased The driving range lights shall be extinguished within an hour after closing Permits will be obtained for existing lights 11. The fence between the parking lot and the abutting lot shall be reconstructed so as to prevent vehicular traffic between the two lots 15 This special permit is granted for one year to allow the applicant time to respond to the concerns of the abutter at 673 Waltham Street and will expire on December 31 2004 with all other conditions remaining the same The motion passed unanimously 3 482 Bedford Street Beth Israel Deaconess Medical Care Center& Children's Hospital in Lexington Special Permit for temporary signage The Chair read the legal notice, and noted that the Board has received an application, nature and justification of the request, photographs and plans for the requested signage The applicant is requesting a Special Permit for temporary signage on the buldmg and banners on six lampposts to acknowledge the completion of ten years of service to the community The special events surrounding this anniversary will continue until June 10, 2004 ACTION. A motion(byBarnert, seconded by Sheehan) to grant the Special Permit to allow the requested temporary signage until June 30, 2004 passed by a vote of four to one (Wells voting in the negative) 4 11-15 Brent Road Sport Court of Massachusetts, agent Special Permit to construct a tennis court, accessory to residential use, on two lots The Chair read the legal notice, and noted that the Board has received an application, nature and justification of the request, a topographic map, construction and lighting plans, a letter from the Conservation Commission that the applicant must satisfy the Town Engineer regarding drainage and a letter from the Planning Board questioning the legality of siting a tennis court on two lots Eric Hughes and Dylan James represented Sport Court and presented plans for the requested court. The effect of increased impervious surface on drainage will be mitigated by construction of an infiltration trench which will have the capacity to store the water from a 100-year storm and allow it to be absorbed on site The tennis court will be fenced Mr &Mrs Sheckoff of 27 Brent Road expressed concern about the noise and lights and Ms Fisher of 25 Brent Road noted that trees had been removed from the site and was concerned about runoff from the site ACTION A motion (by Smith, seconded by Barnert)was made to grant the Special Permit with the conditions 1 There shall be no play and lights shall not be on between the hours of 10 PM and 7AM 2 Lights shall not be on except when the court is in use for tennis The motion was approved by a vote of four to one (Uhrig voting in the negative)
