Pursuant to notice in the Lexington Minuteman,a newspaper of general circulation in the Town,
published on July 27 and August 3,2000 and notice sent by mail,postage prepaid,to all interested parties
pursuant to the provisions of Massachusetts General Laws,public hearings were held in the Town Office
Building on the petitions listed below
Acting on petitions were Chairman Robert V Whitman,Vice Chairman Edwin P Whittemore,
Robert F Sacco,and Associate Members Nyles B Barnert and Elizabeth Sahatiian
22 Sherburne Rd,Dr Jeffrey Arbetter requested a special permit,pursuant to Zoning Bylaw Section 4 2,
Use Table 1,Line 1 25,to use a portion of a residence as an office to see psycho-therapy clients on an as-
needed basis at 22 Sherburne Road
19 Vine Brook Rd James T Fearnside requested a variance from dimensional controls,Table 2 of the
Zoning Bylaw,for construction of a garden shed with a 2-foot rear yard setback and a 2-foot side yard
setback instead of the required 15-foot rear yard and 10-foot side yard setback at 19 Vine Brook Road
1736 Mass Ave,Great Harvest Bread Co requested a special permit,pursuant to Zoning Bylaw Section
4 2,Use Table 1,Line 9 12,to operate a food take-out service at 1736 Massachusetts Avenue
9 Barberry Rd,Vivian Berman appealed a decision by the Zoning Enforcement Officer that 9 Barberry
Road(assessors' map 11/lot 80B)does not constitute a separate,buildable lot from 11 Barberry Road
(assessors' map 11/lot 80A)
9 Locust Ave,Victoria Rothbaum requested a variance from dimensional controls,Table 2 of the Zoning
Bylaw,for a 1-story addition to a nonconforming single-family dwelling with a 5-foot side yard setback
instead of the required 10 feet at 9 Locust Avenue
153 Reed St,Lucy and Bart DeWolf requested a variance from dimensional controls,Table 2 of the
Zoning Bylaw,for the installation of a garden shed with a rear yard setback of approximately 1 foot instead
of the required 15 feet at 153 Reed Street
44 Greenwood St,Kenneth and Gail Flowers requested a variance from dimensional controls,Table 2 of
the Zoning Bylaw,for construction of an addition including an attached garage to a nonconforming single-
family dwelling with a 19-foot front yard setback instead of the required 30 feet at 44 Greenwood Street
44 Greenwood St,Kenneth and Gail Flowers requested a special permit,pursuant to Zoning Bylaw Section
6 4 1,to add a 2nd floor to a nonconforming single-family dwelling with no increase in site coverage within
the minimum yard setback at 44 Greenwood Street
3 Stonewall Rd,Nicolaas Bloembergen requested a variance from Section 11 6 1 of the Zomng Bylaw to
move a driveway off abutting property so that it will have a setback of 0 5 feet instead of the required 5 feet
at 3 Stonewall Road
59 Worthen Rd,Grace Chapel requested variances from(a) Section 7 9 2 and dimensional controls of the
Zoning Bylaw to enclose an existing courtyard and construct an addition,and(b)from the parking
requirements of Section 11 3 1 of the Zoning Bylaw at 59 Worthen Road
451 Lowell St, St Paul's Evangelical Church requested a determination that a change in signage(approved
by the Design Advisory Committee on 8/1/00)is a minor modification of an existing special permit
