PERMANENT BUILDING COMMITTEE
Minutes of Anril 21 1992 Meetina in Room 105 , Town Office Building, as
approved June 30 , 1992 and October 27 , 1992
The meeting was called to order by Chairman Kennedy at 7 43 p m with
all committee members for school and fire projects present except for
John Kennedy (who arrived at 8 15) and Dan McCabe
School contentions with J P An analysis of J P ' s claim by Mary
Greenwald of Palmer & Dodge (a junior member of the firm) indicates that
the town would have clear advantage in a suit Outside claims
consultant , Lee, has submitted his resume and bid quote of $3 ,000 to do
a specialized analysis of the claims (Barbara Manford is now working
for the state court system ) It appears that the estimate for HVAC and
miscellaneous metal was too low and no bids were received for that
amount The actual amount was about three to four times the estimate
Documentation of J P ' s claims have yet to be produced by the I
contractor, and committee members wondered out loud if some of his
numbers were fictitious Furthermore, with Coscia' s and Chartwell ' s
close monitoring, Lexington may have administered the project better
than many towns
About $4, 700 is still owed J P on the base contract Chairman Kennedy
said, "We were forthright and honest " Furthermore, the town did not
backcharge for the 90-day delay and will forgo damages for the delay
"We will pay you what we own, and that ' s all " was Edson' s
recommendation VOTED unanimously (with a second vote taken after
arrival of John Kennedy) to instruct the town' s lawyer to make this
statement to J P 's lawyer, Ball The town will pay PCO' s and base
contract balances as soon as it receives the Waver of Liens and will not
pursue liquidated damages charges of $100 per day as stipulated in
Article 5 2 3 of the contract with J P
Minutes of November 21 1991 school section (page 2) were approved as
submitted
Minutes of January 16 1992 page 1 , were approved as amended
Minutes of February 13 1992 were approved as amended, with a note that
they contained privileged information not to be given to contractors
Schools Capital Planning data generated by John Moynihan has been put
into spreadsheet form by John Kennedy for easy analysis Expected life
of buildings and cash flow numbers (and maybe some information from the
KLQ study) have been factored in The average age of Lexington' s school
buildings is 40 years , and buildings usually need renewal by age 50
This format will be a good tool for working with the Moynihan and the
schools administration
Fire Department brainstorming session first questioned why the committee
should be involved Will a proposal be needed for 1993 Town Meeting?
Town Manager has recommended no capital expense on this for the next
five years Why is a change needed? Equipment? Health of firefighters
and police? Are we doing this to help consolidate space? cut cost?

other reasons? Committeeman Scanlon met with Police Chief Furdon, who
told of a committee now working on Fire/Police communications A place
must be found for combined dispatch for both departments , preferably in
the front room of the Police Department Booking could be done in the
basement Capital expenditure will be needed for equipment Asked who
are the members of the committee The 911 emergency call number is
coming, and will probably go through a regional center for two or three
towns No leadership has developed for this yet Not all police
communications concerns and equipment needs have been addressed
The Fire Department has already figured communications hardware into its
fire station plans Present fire equipment is of various ages , police
have even older equipment Both departments have upgrade needs
Agreed to put off more complete discussion of this issue until next
meeting, with a story-board approach Chairman Kennedy agreed to talk
further with Town Manager to get more guidance Johnson asked for more
data on response time Chief Bergeron produced a fire chiefs ' study
Suggested that a list of options be tested with the Town Manager
Possibility of privatization of ambulance service mentioned Questioned
whether the Permanent Building was appropriate for this planning task,
as options have non-building elements Obviously Town Manager has a
problem and he is looking to the PBC for some answers
Recommended that analysis of needs of fire station(s) be discussed at
the next meeting scheduled for Tuesday, June 30 , 1992 at 7 30 p m
Meeting adjourned at 9 18 p m
