HomeMy WebLinkAboutHeavy Equipment Noise Committee CHARGE TO SELECTMEN' S HEAVY EQUIPMENT NOISE COMMITTEE BACKGROUND It has been brought to the attention of the Selectmen that the Town does not have a By-Law covering the hours of operation of heavy equip- ment, and that in certain instances, such equipment is operated at hours and in such a way as to be a disturbance to residents The Police currently handle such distvgbances under existing "disturbance of the peace" regulations The South Lexington Association, which represents a neighborhood that has had particular trouble in this area in the past year, initially asked the Board to bring to the 1989 Town Meeting a By- Law dealing with the noise from heavy equipment. It was the Board ' s feeling that this was not as simple a matter as might first appear, and agreed to put together an advisory group to further research the matter and make a recommendation to the Board If the recommendation led to a proposed By-Law change, the Board would bring that to the 1990 Annual Town Meeting CHARGE The Committee shall research the matter of noise control of heavy equip- ment used within the Town and any other matters relating to same This research shall include the need for regulation, if any; the impact of proposed regulation on both the residents and the operators of such equipment; the use of such regulation in other communities in the Common- wealth The Committee shall report back to the Board of Selectmen no later than December 15, 1989 - earlier if possible COMMITTEE The Committee shall consist of six members one of whom has background in acousitcal engineering , one familiar with such heavy equipment and its use, one with legal training and three "at large" Adopted - February 27,1989
