HomeMy WebLinkAbout2016-09-12-BASS-minBoard of Assessors Meeting Open Session Minutes September 12, 2016 A Meeting of the Board of Assessors was held on September 12, 2016 at 8:45 a.m. located in the Selectmen Meeting Room of the Town Hall Building. In attendance: Gregory Johnson, Chairman, Edmund C. Grant, Member, Casimir Groblewski, Member, Robert F. Lent, Director of Assessing, and Sandra Pentedemos, Administrative Assessor. Upon motion duly made and seconded, the Meeting was called to order at 8:48 a.m. Open Session Public Comment Time: Chairman Gregory Johnson welcomed the public. Mr. James Freehling of Symmes Life Care, Inc., dba Brookhaven at Lexington, an Assisted Living facility of 1010 Waltham Street, spoke of Brookhaven's charitable operations and the medical and nursing care that's provided to their residents. Other members of the Brookhaven community spoke of the 1986 Town Meeting approval with acceptance of the PILOT Agreement (Payment In Lieu of Taxes) with the Town of Lexington, and Town Meeting's approval of Brookhaven's expansion in 2004. Attorney John Newman, Representative for Youville Place, Inc. dba Covenant Health Care, Inc., an Assisted Living facility located at 10 Pelham Road, spoke of the Youville's charitable organization services for medical and nursing care for residents that now include a memory care/Alzheimer component.. Mr. Newman referred to Youville's legal memorandum with the Grey Nuns who obtained Town Meeting approval for a planned residential development of the property in 1986. Brookhaven and Youville had requested continuation of their tax exempt status based on their filed application Form 3ABC's and additional comprehensive information requested by the Board of Assessors. The Board of Assessors requested and performed detailed site visits of each facility in August. Assistant Town Manager for Finance Rob Addelson, and Town Counsel Mina Makarious (Anderson & Kreiger, LLP) were present during these public comments. Upon motion duly made and seconded, the Board of Assessors went into Executive Session at 9:10 a.m. to discuss the Youville Place Assisted Living facility. EXECUTIVE Session occurred here: details may be viewed in separate EXECUTIVE Session folder Open Session Chairman Greg Johnson thanked the officials who were present on behalf of Brookhaven and Youville facilities and was appreciative of the detailed information provided by both facilities. Chairman Greg Johnson made a Motion that the Board finds that the applicant Youville Place doing business as Covenant Health Care, Inc., of 10 Pelham Street has provided sufficient evidence to meet its burden of proof of establishing entitlement to an exemption from the local property taxes pursuant to M.G.L. Chapter 59 Section 5 Clause Third. Motion was seconded. The Board of Assessors unanimously voted 3-0 in favor to grant the Youville Place, Fiscal Year 2017 3ABC application for tax exemption for which it had filed. Upon motion duly made and seconded, the Board of Assessors went into Executive Session at 10:10 a.m. to discuss the Brookhaven, Symmes Life Care Assisted Living facility. Chapter 59 Section 5 Clause Third. Board Chairman Johnson and Member Groblewski voted 2-0 in favor to grant Brookhaven's Fiscal Year 2017 3ABC application for tax exemption for which it had filed. Upon motion duly made and seconded, the Board of Assessors went into Executive Session at 11:35 a.m. to discuss the remaining Items as listed on the Agenda.
