Open General discussion regarding rules for the NCD 4) a.Neighborhood compatibility with respect to new construction – cannot modify town zoning rules. For example i.The town’s zoning permits a house with 30 feet frontage, i.e., 30 feet from the street. The NCD Commission may or may not approve a similar proposal when placed amongst a row of houses that are, for example, 60 feet from the street, depending on NCD regs. b.The same compatibility principal would apply to a new structure with respect to the height of the structure. c.Public view exemptions i. It was noted that for other NCDs the public visibility requirements are generally focused on public views which ordinarily include only the street view but we need to consider and decide upon visibility from, either public views or street views or both, say, the power lines, Paint Mine Trail, or Hennessey Field. ii.We can be specific about what public land views are exempt but there has to be consistency in what we propose Sally Zimmerman will provide information about the original property owners. The rules in the SC Report should trace back to our defined neighborhood characteristics. Bob Creech is still trying to track down someone from Peacock Farm who knows about their tree rules. The goal is to make the Trees section advisory. We will want to identify the types of trees that are typical in the neighborhood (white pine, oak, beech, hickory) and include language we’ve gathered from neighbors ‘… enjoy having a buffer between Action Item: neighboring houses, watching wildlife …’ Bob will investigate the Wellesley NCD tree rules. Sally Zimmerman will work on the letter. At the December 13 meeting, the SC reviewed photos of all the properties in the NCD area and categorized them by style. These style assignments were incorporated in the Neighborhood Information Spreadsheet and distributed to the SC members. This is fine for now – the SC will address the few unclear style assignments once the higher priority tasks are complete. Discussed ways to approach height and set back restrictions with the goal of being consistent with the current conditions. Discussed ways to define exemptions. It was noted that for other NCDs the public visibility requirements are generally focused on the street view but we may want to consider visibility from, say, the power lines, Paint Mine Trail, or Hennessey Field. Timing:The study report draft needs to be complete by January 10. This will allow a week or two for review and feedback before a vote at the January 24 meeting. Richard Canale noted that there is some concern in the Planning Department about the impact of creation of the NCD on PD workload. 5)Prepare for January 10 meeting Sally Zimmerman will work with Diane Pursley to prepare the Study Report draft. They will delegate to others as needed. Bob Creech will work (with Diane) on the requirements for trees. o We need to invite a few (~4) original owners to this meeting. Suggest short talks about how the neighborhood came together to o manage issues over the years. They need to be prepared with a script. o The meeting will be taped. o Letter to NCD Neighbors. 6) The letter has been drafted but needs additional information: a.Link to the NCD Bylaw on the Town of Lexington website. b.Link to the Turning Mill NCD page from on the Planning Board Website. c.Link to the SC meeting schedule.
