HomeMy WebLinkAboutPlanning Board Minutes, 1999-09-22 PLANNING BOARD MINUTES MEETING OF SEPTEMBER 22, 1999 The meeting of the Lexington Planning Board held in the Selectmen's Room Town Office Building,was called to order at 7.35 p.m. by Chairman Davies with members Galaitsis,Merrill,Planning Director Bowyer,and Assistant Planner Garber present. Ms. Bridge-Denzak and Mr. Colman were absent. ************ ADMINISTRATION OF LAND DEVELOPMENT REGULATIONS ************* SUBDIVISION OF LAND 134 87 Hancock Street Subdivision.Gerard Moloney. Accent Covenant.Endorse Subdivision Plans: On the motion of Mr.Merrill, seconded by Mr. Galaitsis,the Board voted unanimously, 3-0,to accept the covenant, dated September 9, 1999, and to endorse the Property Rights and Dimensional Standards Plan for the 87 Hancock Street 7 4.5 subdivision,dated June 1, 1999 135 246 Concord Avenue Subdivision. George Issaians: Accent Covenant.Endorse Subdivision Plans: On the motion of Mr.Merrill, seconded by Mr. Galaitsis,the Board voted unanimously, 3-0,to accept the covenant, dated September 9, 1999, and to endorse the plans for the 246 Concord Avenue 7 4.5 subdivision, dated June 2, 1999 136. Prerecorded Substandard Residential Lots.Review of Draft Guidelines: Mr Bowyer presented some historical background on a provision in the State Zoning Act relative to recorded lots and the current possibilities for developing those lots. The draft document before the Board tonight, draft#2 of Guidelines, Policies on Prerecorded, Substandard Residential Lots, dated September 14, 1999, suggests guidelines for dealing with these lots as applications are made to build on them. After some discussion a number of revisions were made.The Board agreed to ask for a legal opinion from Town Counsel. On the motion of Mr. Galaitsis,seconded by Mr Merrill,the Board voted unanimously to adopt the proposed guidelines, subject to review and modifications by legal counsel, as amended. 137 Section 7 4.5 Subdivision Guidelines: Review of Revised Guidelines: The Board held a detailed discussion on proposed revisions to their Guidelines to the Zoning By-Law's Section 7 4.5,Reduced Frontage in Small Subdivisions. The revisions have to do with public benefits and the size of houses in such subdivisions. On the motion of Mr.Merrill, seconded by Mr Galaitsis,the Board adopted the 7 4.5 Guidelines, as amended, by a vote of 3-0. *************************** PLANNING DIRECTOR'S REPORT ************************** 138. Recent Activity a. 87 Hancock Street Subdivision,Halyard Builders,Minor Revision to House Footprint: Mr Garber reported that Gerard Moloney,the developer of the 7 4.5 subdivision at 87 Hancock Street,has requested a minor revision to the house footprint. The change will not increase the size of the house or decrease the side setback. b. Pending Development Table: Mr.Garber went over the pending development table for the Board. The table provides s snapshot of development applications entering the pipeline and in progress. c. Del Monte Dunes vs.the City of Monterey Mr. Bowyer called the Board's attention to a recent U S. Supreme Court decision that favored a property owner over the City of Monterey in a case having to do with property rights. Minutes for the Meeting of September 22, 1999 2 ******************************* EXECUTIVE SESSION ********************************** Mr.Davies polled the members at 9.16 p.m. and the Board voted unanimously to go into Executive Session to discuss personnel matters.
