MEETING OF OCTOBER 3, 1994
The meeting of the Lexington Planning Board held in Room G-15, Town Office Building, was called to
order at 7.38 p.m. by Chairman Domnitz, with members Canale, Davison, Grant, Merrill, Planning Director
Bowyer, and Assistant Planner Marino present.
194 Review of Minutes: The Board reviewed and corrected the minutes for the meeting of September 19,
1994 On the motion of Mr. Merrill, seconded by Mrs. Davison, it was voted unanimously to approve the
minutes, as amended.

195. Recent Activity
a. Munroe Village. Definitive Subdivision Plan. Rollout: Mr. Marino rolled out a definitive plan for the
Munroe Village development, off Woburn Street, that was submitted by Robert Cataldo on September 20,
1994 The staff has not reviewed the plan in detail yet. The time for action on this plan expires on
February 2, 1994
b. Hunt Road, Definitive Street Construction Plan. Rollout: Mr. Marino rolled out a definitive street
construction plan for Hunt Road that was submitted by Rick Curtin on September 28, 1994 The staff has
not reviewed the plan in detail yet. The time for action on this plan expires on November 12, 1994
b. SPS. Maguire Road: Mr. Bowyer reported that the Board of Appeals granted the Special Permit with
Site Plan Review for an office building at One Maguire Road. The applicant offered mitigating measures to
address Section 12 of the Zoning By-Law They included a financial contribution to the reconstruction of
the Hartwell Avenue/Maguire Road intersection, preferred parking for multi-occupant vehicles, special
facilities for bike commuters, and some amenities for bikepath users adjacent to the bikepath.
c. 12 Stedman Road: Mr. Bowyer reported that the Board of Appeals voted to refer to the Planning
Board a repetitive petition for a variance for an addition to a dwelling at 12 Stedman Road. The first
application was denied on July 14, 1994. The Board of Appeals determined that the application is
sufficiently different from the first application to warrant a rehearing. The Planning Board is required to
hold a public hearing, notify parties of interest and determine if it is sufficiently different to be considered
without the two-year waiting period stipulated for repetitive petitions.
d. Planning Board Procedural Rules: Mr. Bowyer related that the version of the Procedural Rules
distributed at this meeting is the most up to date available. Mr. Domnitz said that the Board had amended
the section on elections. Mr. Bowyer said he rememberd the Board discussing that section but said the staff
had searched and was not able to find a reference in the minutes to that amendment.

RECOMMENDATIONS ON APPLICATIONS TO THE BOARD OF APPEALS
196. Applications To Be Heard on October 13, 1994 Mr. Merrill gave an oral review of the following
applications:

90 Lowell Street. Melvin Savage, renewal of special permit to continue to use part of residence as an
office

8 Carmel Circle, Mason and Laurie Tenaglia, variance to allow a wooden fence to be secured to an
existing concrete retaining wall
675 Lowell Street, Kitchen, Etc., special permit for an internally illuminated wall sign
36 North Street, James and Ellen Caouette, special permit to add second floor to dwelling
The Board agreed to make no comment on the four applications.
************************ ARTICLES FOR 1994 TOWN MEETING ************************
197 Yard Setbacks. (or Jumbo Houses): The Board continued their discussions on how best to present
this article. Mr. Bowyer reported he had talked with the American Planning Association office in Chicago.
They said the problem is common and is best dealt with by performance standards rather than set
dimensions as in the Lexington Zoning By-Law APA is sending material to Lexington.

198. Fall Meeting and Hearing Schedule: The Board set meetings for November 14 and 28 and
December 12. They will also meet with the Conservation Commission on October 11 at 7 45 p.m. to
discuss the processing of subdivision applications.
199 Election of Officers: Mr. Domnitz nominated Mrs. Davison for Chairman, Mr. Canale for Vice
Chairman, and Mr. Merrill for Clerk, to be effective at the beginning of the meeting on October 17, 1994
Mr Canale seconded the nominations. On a vote of 3-0-2, Mr. Merrill and Mrs. Davison abstaining, the
slate was elected.
Mr. Grant left the meeting.

200. Special Permit to Waive Frontage: The Board continued their discussion of this article. They
agreed to ask Town Counsel to review it in its present form. One of the questions for Town Counsel is
whether the Planning Board could invoke the jurisdiction of other agencies in making a special permit
decision.
The meeting was adjourned at 10.48 p.m.
