MEETING OF AUGUST 25, 1994
The meeting of the Lexington Planning Board held in Room G-15, Town Office Building, was called
to order at 7:37 p.m. by Chairman Domnitz, with members Canale, Davison, Grant, Planning Director F,
Bowyer, and Assistant Planner Marino present. Mr Merrill was absent.
170. Review of Minutes: The Board reviewed and corrected the minutes for the meeting of July 28,
1994. On the motion of Mr Canale, seconded by Mr. Grant, it was voted unanimously 4-0 to approve
the minutes, as amended.
************ ADMINISTRATION OF LAND DEVELOPMENT REGULATIONS *************
SUBDIVISION OF LAND
171. Prescott Lane. off Lowell St. The Board reviewed and edited a draft decision, prepared by the
staff, on the Prescott Lane Preliminary Subdivision Plan submitted on July 15, 1994 by Pat and John
Austin. On the motion of Mrs Davison, seconded by Mr. Canale, the Board voted unanimously to:
1. approve with conditions the preliminary subdivision plan entitled "Prescott Lane", by Larson
Associates, Inc. and Meridian Engineering Collaborative, Inc., dated July 5, 1994;
2. approve the wording of the draft decision dated August 25, 1994, as amended.
DETERMINATION OF GRADE AND CONSTRUCTION OF UNACCEPTED STREETS
172. 21 Haves Lane, CUS 94/1 Definitive Street Construction Plan: The Board reviewed a draft
decision on the 21 Hayes Lane Definitive Street Construction Plan submitted by Daniel and Lynn
Perry on July 18, 1994. On the motion of Mr. Grant, seconded by Mr. Canale, the Board, on a
unanimous vote:
1. determined that Hayes Lane, as it provides frontage for lot #216C on Assessors Map #48,
is not presently of adequate grade and construction but will be of adequate grade and
construction if the improvements shown on the plan entitled Site Construction and Utilities
Plan, and the Street Layout and Profile plan, both dated July 16, 1994, prepared by Lanata
and Associates, Inc., for Mr. and Mrs. Daniel Perry, are made;
2. approved the plans entitled Site Construction and Utilities Plan, and the Street Layout and
Profile plan both dated July 16, 1994, prepared by Lanata and Associates, Inc., for Mr. and
Mrs. Daniel Perry, as the definitive street construction plan, with waivers from the Stan-
dards for Grade and Construction of Unaccepted Streets Relative to New Dwellings as set
forth in its decision;
3. approved the wording of the draft decision dated August 19, 1994.
173. 4 Hunt Road. CUS 94a: Preliminary Street Construction Plan: The Board reviewed a draft
decision, prepared by the staff, on the preliminary street construction plan submitted July 14, 1994 by
Richard Curtin. On the motion of Mr Canale, seconded by Mrs. Davison, the Board voted unani-

1. approve with conditions and modifications the Preliminary Street Construction Plan, sheet
3, dated May 31, 1994 with conditions and comments;
2. approve the wording of the draft decision dated August 19, 1994.
RECOMMENDATIONS ON APPLICATIONS TO THE BOARD OF APPEALS
174. Applications To Be Heard on September 8. 1994 Mr. Grantg ave an oral review of the
following applications: I
Lot 1. Kine Street(Man 14. lot 124b). Appeal by Kevin Devereaux of the Building Commis-
sioner's decision that this is not a buildable lot. After some discussion, the Board agreed to
recommend that the Board of Appeals uphold the Building Commissioner's decision.
5 Tewksbury Street. Frank and Marcia Gens, variance for addition to dwelling. After some
discussion, an informal poll was taken. The Board was unable to reach a consensus on this
application. Mr. Domnitz and Mr. Canale voted to recommend denial of the petition. Mr
Grant and Mrs. Davison voted to make no comment.
The Board agreed to make no comment on the applications below, also scheduled to be heard by the
Board of Appeals on September 8, 1994.
141 Mass. Avenue, Dunkin' Donuts Satellite, renewal of special permit to operate a take-out and
fast-food service
199 Mass. Avenue. Nick's Place, renewal of special permit to operate a take-out and fast-food
service
8 Carmel Circle, Woodpark Circle Limited Partnership, variance to allow a concrete retaining
wall to remain as constructed
30 Hancock Street, Raynor Warner, variance to replace bow window with one-story bay
Hearin Scheduled for September 29 1994
SPS. Maeuire Road and Hartwell Avenue: The Board agreed to continue its discussion of this
application at its next meeting. The staff will prepare a Zoning and Site Analysis for the
Planning Board to review.
************************ ARTICLES FOR 1994 TOWN MEETING ************************
175. Jumbo Houses: The Board agreed to invite the Design Advisory Committee to a future meeting
when this article will be discussed. Mr Bowyer was asked to provide the Board with copies of the
material about calculating setbacks he had prepared as a consultant to the Town of Wellesley so they
can share it with the Design Advisory Committee. Mr. Bowyer pointed out that examples of setback
provisions from other towns may be helpful if those other towns are similar to Lexington in size,
density, location and other characteristics.
Mr. Grant left the meeting at 9:09.

177 Summer Street Subdivision Mr. Domnitz wanted to state for the record that the Zacks, who submitted
the 10 Summer Street subdivision plan now before the Board, are personal friends. He does not believes he
has any conflict of interest and can act impartially in decisions affecting this subdivision.
******************************** EXECUTIVE SESSION *********************************
178. Litigation Against the Town: On the motion of Mrs. Davison, seconded by Mr. Canale, the Board
voted unanimously to go into executive session to discuss the appeal filed in Middlesex Superior Court by
Ronald Gold against the Conservation Commission. The Board agreed to reconvene in open session only for
the purpose of adjourning.
The meeting was adjourned at 10.10 p.m.
