MEETING OF MARCH 22, 1993
After attending the Board of Selectmen's meeting in the Selectmen's meeting
room, the Lexington Planning Board meeting was called to order at 8 35 p.m. in
Room G-15, Town Office Building, by Vice Chairman Domnitz with members Canale,
Davison, Grant, and Planning Director Bowyer present Mr Williams was
absent.
*********************** ARTICLES FOR 1993 TOWN MEETING ***********************
45 Positions on Non-Zoning Articles Mr. Domnitz asked that members
identify any non-zoning articles on which the Board may want to have a
position.
a. Article 4. Operating Budget. Planning Department The Board will sup-
port full funding for the three current positions in the Planning
Department
b. Article 15. Pine Meadows Master Plan The Board will not take a
position.
c. Article 21, Muzzev Condo Repair The Board will not take a position.
d. Article 23, GEIR, Hanscom Field. The Board will support the appro-
priation of $10,000 for this item Mr. Canale reported the Selectmen
may include this item in the operating budget and it may not come up
under Article 23.
e. Article 32. General By-Laws. Surface Water Disposal The Board will not
take a position.
f Article 38: Marrett Road/Route 2A Resolution Mrs. Davison said she
plans to comment as a private citizen and not as a member of the
Planning Board. She advocates a simpler plan without two traffic
signals. Mr. Canale reported that a revised motion, asking for a study
committee, to include a representative of the Planning Board, may be
offered The Board agreed it would welcome having a representative on
the study committee. It was agreed the Board would defer taking a
position until more information was available
g. Article 40. Bowman School Property for LexHAB. Mrs. Davison suggested
that the Planning Board support LexHAB for its fine program of con-
structing single-family houses using students from the Minuteman
Vocational Technical School. It was agreed the Board would defer taking
a position until more information was available.
h. Article 41. Amend Quitclaim Restrictions. Muzzev Condos Mr. Domnitz
thought it was important to retain the Muzzey units as affordable
housing. Allowing a higher annual percentage increase in the maximum
resale price may move the units out of the affordable range. It was
agreed the Board would defer taking a position until more information
was available
46. Article 31, Westview Street Mr. Domnitz said he was uncomfortable with
the owner of this land being left with no permitted use. He suggested that
the Planning Board indicate to the Town Meeting that it would support a change
in the zoning district boundary line to place the land in the RO One-Family
district. Mrs. Davison disagreed stating that the property owner had bought
land in the commercial zoning district in good faith and a change to a

residential district would decrease his property value. Mr. Canale would
support a rezoning to residential.
Colin Richardson, owner of the land, stated it is a poor location for a house
The automotive service use is allowed by zoning and is acceptable to the
courts. He is not interested in rezoning to residential. He is interested in
commercial use and will pursue that if it takes 10 years.

RECOMMENDATIONS ON APPLICATIONS TO THE BOARD OF APPEALS
47 Applications To Be Heard on April 8 1993 Mr. Grant gave an oral
review of the following applications
329 Marrett Road. Ann F. Bergin d/b/a Taira Boutique, sign. It was agreed the
Board would not make a recommendation but would comment that it has concerns
about the aesthetic character of the proposed sign, but would defer to the
Design Advisory Committee in this regard.
475 Bedford Street. The Lexington Club, special permit for satellite receiving
antenna to remain where installed. It was agreed the Board would recommend
against the application for the following reasons The Planning Board notes
that subparagraph 5 7.2 b 2) requires that a satellite receiving antenna be
permanently secured to the ground and not installed on a building Based on
the information available for the Planning Board to review, the Board ques-
tions whether the applicant can meet the test imposed by 5.7.2 c on this
large, level lot by demonstrating that there are conditions that prevent an
antenna attached to the ground from receiving satellite transmitted signals.
The Planning Board believes that there should be some independent evaluation
of signal reception conditions and an unsubstantiated claim by an applicant
should not be the sole basis for satisfying the test imposed by 5 7 2 c.
The Board agreed to make no comment on the applications below also scheduled
to be heard by the Board of Appeals on April 8, 1993.
33 Marrett Road, Museum of Our National Heritage, special permit for
temporary signs six to eight times a year to advertise new exhibits z
8 Carmel Circle, New England Construction Corp. , special permit to allow
portion of driveway to serve as common driveway
927 & 945 Waltham Street, Nicholas Cannalonga d/b/a Wagon Wheel Nursery, O
renewal of special permit
1-3 Sherman Street, variance to add a second-floor bathroom
The meeting was adjourned at 10 09 p.m.
