HomeMy WebLinkAboutPlanning Board Minutes, 1991-03-04 PLANNING BOARD MINUTES MINUTES OF MARCH 4, 1991 The meeting of the Lexington Planning Board held in Room G-15, Town Office Building, was called to order at 7 37 p m by the Chairman, Mrs Wood, with members, Klauminzer, Domnitz, Grant, Williams, Planning Director Bowyer, Acting Assistant Planner Marino and Secretary Peters present. ***************************** REPORTS ******************************** 47. Planning Director a. Lexington Ridge Mr Bowyer reported that tomorrow morning in the Selectmen's Meeting Room, Town Office Building, the State Housing Appeals Committee will hold a hearing session on the appeal by Lexington Ridge of the comprehensive permit, granted with conditions by the Board of Appeals, and filed with the Town Clerk on December 14, 1991. They will also visit the site. He added that it is anticipated the hearing will then be adjourned to a later date since Palmer and Dodge has not received much of the material they requested from the attorneys for Lexington Ridge ************ ADMINISTRATION OF LAND DEVELOPMENT REGULATIONS **************** PLANS NOT REQUIRING APPROVAL UNDER THE SUBDIVISION CONTROL LAW 48. Form A/91-2, Butterfield Road. Robert Cataldo The Board reviewed a plan showing the redelineation of the side lot line between Lots 9A and 10A on Butterfield Road, with both lots conforming to the frontage and lot area requirements of the zoning district On the motion of Mrs. Klauminzer, seconded by Mr. Grant, it was voted 5-0 to endorse the plan entitled "Plan of Land in Lexington, Mass. (Middle- sex County)" , dated September 12, 1990, by The BSC Group - Bedford, Inc. , certified by Roger M. Corbin, Professional Land Surveyor, with application Form A/91-2, by applicant Robert Cataldo, as it does not require approval under the Subdivision Control Law. SUBDIVISION OF LAND 49 Munroe Village. Woburn Street, Decision on Preliminary Plan The Board reviewed and edited a draft decision disapproving the preliminary cluster subdivision plan. On the motion of Mrs Klauminzer, seconded by Mr Grant, it was voted 5-0 to approve the wording of the decision, as amended, and to disapprove the preliminary cluster subdivision plan ******************* ARTICLES FOR 1991 TOWN MEETING *************************** 50 Article 31 Parking Factors The Board reviewed a draft report and motion as of 2-27-91 Mr Domnitz proposed, and the Board agreed, that the take-out parking factor in the CB district be increased from 1/75 sq. ft. to 1/100 sq. ft. The Board also agreed that flexibility to move from retail to restaurant and back is the real issue, and more explanation should be made to Minutes for the Meeting of March 4, 1991 2 concerned groups, such as the Chamber of Commerce, on how this works. It was suggested that a meeting be scheduled with the Chamber of Commerce, so that Mr. Domnitz could present his and staff research on uses and parking factors, before and after the proposed revisions, and explain why the Board is propos- ing these revisions. On the motion of Mr Domnitz, seconded by Mrs Klauminzer, it was voted 3-2 (Mr Grant and Mr. Williams voted in the negative) to recommend the Town Meeting approve Parts A, B, and C of the proposed amendment and to approve the report, as amended. On the motion of Mr Williams, seconded by Mrs. Klau- minzer, it was voted 4-0-1 (Mr Domnitz abstained) to recommend the Town Meeting approve Part D of the proposed amendment and to approve the report on Part D, as written. 51 Article 30. Religious Educational Institutions The Board reviewed a draft report and motion for the article, as of 2-27-91. On the motion of Mr. Grant, seconded by Mr. Williams, it was voted 5-0 to recommend the Town Meeting approve the proposed amendment and to approve the report, as written 52. Article 32 Exemptions for Agricultural Uses The Board reviewed a draft report and motion for the article, as of 2/27/91. On the motion of Mr. Williams, seconded by Mrs. Klauminzer, it was voted 5-0 to recommend the Town Meeting approve the proposed amendment and to approve the report, as written. 53 Article 33. Day Care Centers The Board reviewed a draft report and motion for the article, as of 2-26-91. It agreed to ask Mrs Davison, who was elected today to fill a Planning Board vacancy, if she would present this article at Town Meeting On the motion of Mr Williams, seconded by Mrs Klauminzer, it was voted 5-0 to recommend the Town Meeting approve the proposed amendment and to approve the report, as written. 54 Article 34. Pet Grooming Services Mrs. Klauminzer asked whether pet grooming services could be allowed in the CS district, where veterinarians and kennels are now permitted. Mr Bowyer said it could be done in the future, but not in this petition, since the words "or act in any other manner in relation thereto" were not included in the petition. Mrs. Wood agreed to present the Board's comments on this petitioner's article The Board reviewed a draft report as of 2/27/91. On the motion of Mrs. Wood, seconded by Mr Williams, it was voted 4-1 (Mr. Domnitz voted in the nega- tive) , to recommend the proposed amendment be approved. The Board amended the report to say that the Board plans to propose an amendment next year that would allow pet grooming services in other commercial districts, where appropriate. On the motion of Mrs. Wood, seconded by Mr. Williams, it was voted 5-0 to approve the report, as amended. 55 Article 35. Private Postal Services The Board reviewed a draft as of 2/27/91, recommending the petitioner's proposed amendment not be approved by Town Meeting On the motion of Mrs Wood, seconded by Mr Williams, it was voted 5-0 to recommend the proposed amendment not be approved On the motion of Mrs. Wood, seconded by Mrs. Klauminzer, it was voted 5-0 to approve the report, as written Minutes for the Meeting of March 4, 1991 3 56 Article 29. Technical Corrections The Board reviewed and edited a draft report, explanation and motion for the article, as of 2/19/91. On the motion of Mr Grant, seconded by Mr. Williams, it was voted 5-0 to recommend the Town Meeting approve the proposed amendment and explanations through part 5. Action on part 6 was deferred. ************** ADMINISTRATION OF LAND DEVELOPMENT REGULATIONS ************** RECOMMENDATIONS ON APPLICATIONS TO THE BOARD OF APPEALS 57. Hearings Scheduled for March 21. 1991 Mr. Domnitz gave an oral review of the following applications scheduled to be heard by the Board of Appeals. 7 Depot Square, Warm Hearts, Cold Noses, Appeal of Building Commis- sioner's Decision On the motion of Mr Grant, seconded by Mrs Klauminzer, it was voted 4-1 (Mr. Williams voted in the negative) to recommend that the Commissioner's decision, that pet grooming is not an accessory use to a retail store, be upheld. The Planning Board also agreed to make no comment on the applications below 148 Wood Street, August Schumacher, Jr. , variance, to increase the net floor area of the rear unit in a nonconforming four unit dwelling Rte 128 & Bedford St Interchange, Town of Lexington, variances from side and rear yard setbacks to construct a pumping station with a rear yard setback of zero feet and a side yard setback of one foot to replace the existing North Lexington Pump Station. 20 Waltham Street, Eddie's of Lexington, Inc , SP to install a project- ing sign at the entrance of an existing restaurant in the CB district, recently renamed Sweet Peppers.
